O-22-35VILLAGE OF DEERFIELD ORDINANCE NO. 2022- 0-99-35 AN ORDINANCE AMENDING VARIOUS SECTIONS OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, TO AMEND OR REMOVE OBSOLETE BUSINESS AND VEHICLE LICENSING REgUIREMENTS WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code'), contains various requirements for certain types of businesses and vehicles to be licensed and pay to the Village licensing fees (collectively, "Licensing Regulations'); and WHEREAS, the Village reviews its Licensing Regulations from time to time in an effort to ensure that its Licensing Regulations stay current and continue to advance the policy objectives of the Village; and WHEREAS, after a review of the current Licensing Regulations, the Village Board desires to amend the Licensing Regulations to remove or amend Licensing Regulations that no longer serve their policy objectives; and WHEREAS, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to amend the Licensing Regulations pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: REPEAL OF ARTICLE 1 OF CHAPTER 4 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Article 1, titled "In General," of Chapter 4, titled "Amusements," of the Village Code is hereby repealed in its entirety and reserved for future use. SECTION THREE: REPEAL OF ARTICLE 5 OF CHAPTER 4 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Article 5, titled "Coin Operated Music Devices," of Chapter 4, titled "Amusements," of the Village Code is hereby repealed in its entirety and reserved for future use. SECTION FOUR: REPEAL OF ARTICLE 7 OF CHAPTER 4 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Article 1, titled "Junk Dealers," of Chapter 7, titled "Businesses," of the Village Code is hereby repealed in its entirety and reserved for future use. SECTION SIX: REPEAL OF ARTICLE 6 OF CHAPTER 7 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Article 6, titled "Automatic Dry Cleaning Machines," of Chapter 7, titled "Businesses," of the Village Code is hereby repealed in its entirety and reserved for future use. SECTION SEVEN: REPEAL OF ARTICLE 9 OF CHAPTER 7 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Article 9, titled "Laundromats," of Chapter 7, titled "Businesses," of the Village Code is hereby repealed in its entirety and reserved for future use. SECTION EIGHT: AMENDMENT TO SECTION 7-64 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Section 7-64, titled "Definition," of Article 10, titled "Vending Machines," of Chapter 7, titled "Businesses," of the Village Code is hereby amended and shall be as follows: "Sec. 7-64. Definition: The term "vending machine" shall mean and include any e4a cash, credit card, or debit card operated device dispensing food, beverages, or cigarettes for consumption or use by any person, which food or cigarettes are dispensed at a retail price per item of ten cents ($0.10) or more." SECTION NINE: AMENDMENT TO SECTION 7-65 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Section 7-65, titled "License Required; Fees," of Article 10, titled "Vending Machines," of Chapter 7, titled "Businesses," of the Village Code is hereby amended and shall be as follows: "Sec. 7-65. License Required; Fees: It shall be unlawful to maintain or operate a eeifr cash, credit card, or debit card operated vending machine within the village without having obtained a license therefor as hereinafter provided. Application for said vending machine licenses shall be made in writing to the village manager. The annual fee for vending machine license shall be the amount set forth in the annual fee resolution adopted by the corporate authorities." SECTION TEN: REPEAL OF ARTICLE 3 OF CHAPTER 11 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Article 4, titled "Milk Dealers," of Chapter 11, titled "Food and Food Establishments," of the Village Code is hereby repealed in its entirety and reserved for future use. SECTION TWELVE: REPEAL OF ARTICLE 4 OF CHAPTER 12 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Article 4, titled "Landfill," of Chapter 12, titled "Health," of the Village Code is hereby repealed in its entirety and reserved for future use. SECTION THIRTEEN: AMENDMENT TO SECTION 22-138 OF THE VILLAGE CODE. Pursuant to the Village's home rule authority, Section 22-138, titled "Definition," of Article 17, titled "Vehicle License," of Chapter 22, titled "Vehicles and Traffic," of the Village Code is hereby amended and shall be as follows: "Sec. 22-138. Definition: The following words and phrases when used in this article shall, for the purpose of this article, have the meanings ascribed to them in chapter 1 of the Illinois vehicle code 1 as it may be amended from time to time: (a) Antique vehicle. Pursuant to the Village's home rule authority, Section 22-140, titled "Fees," of Article 17, titled "Vehicle License," of Chapter 22, titled "Vehicles and Traffic," of the Village Code is hereby amended and shall be as follows: "Sec. 22-140. Fees: (a) The annual fee to be paid for motor vehicle licenses shall be as set forth in the annual fee resolution adopted by the corporate authorities for the following vehicles: Antique vehicle License transfer Motorcycle Motorized pedal eye47e Passenger cars Recreational vehicle/trailer School buses operated by a not for profit corporation, or a public or parochial school or buses operated by a company on a certificate of convenience and necessity from the Illinois commerce commission Trucks or buses Vehicles titled to the state, any political subdivision of the state or any unit of local government (b) The annual fee for a noncommercial vehicle license for a vehicle owned or leased by a resident of age sixty five (65) or over (as of the due date of the license) shall be the amount set forth in the annual fee resolution adopted by the corporate authorities. (c) The annual fee for a noncommercial vehicle license for a vehicle registered to a person with disabilities as defined in 625 Illinois Compiled Statutes 5/1-159.1, and where said vehicle has been issued handicapped registration plates as provided for in 625 Illinois Compiled Statutes 5/3-616(a), shall be the amount set forth in the annual fee resolution adopted by the corporate authorities. (e) The annual fee for a noncommercial vehicle license for a vehicle owned or leased by a resident on active duty in one of the U.S. military services shall be the amount set forth in the annual fee resolution adopted by the corporate authorities. (f) The annual fee for a noncommercial vehicle license for a charitable vehicle owned or leased by a church or religious organization for the use of a clergyman, minister or practitioner of any religious denomination accredited by the religious body or organization to which he or she belongs shall be the amount set forth in the annual fee resolution adopted by the corporate authorities." SECTION FIFTEEN: SEVERABILITY. If any provision of this Ordinance or part thereof is held invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose and intent of this Ordinance to the greatest extent permitted by applicable law. SECTION SIXTEEN: PUBLICATION The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION SEVENTEEN: EFFECTIVE DATE. This Ordinance will be in full force and effect after its passage, approval, and publication in the manner provided by law.
