O-74-18�.r r r ORDINANCE NO. 0 -74- 18 AN ORDINANCE AUTHORIZING A SPECIAL USE (Strub Property - Phase I) WHEREAS, the.Plan Commission of the Village of Deerfield has heretofore held_a_public_ hearing on the application of JAMES O'HALLORAN, S. GUY FISHMAN, EDWIN McGUIRE and JOSEF CEMSEL to authorize the development and use of certain real estate commonly known as the Strub Property and hereinafter described, for a Planned Development - Office Complex and accessory.storage facilities as a special use under and pursuant to the provisions of Sections XIII,D,3,S, XIII,D,4; XIII,D,S and XXII of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact including express affirmative findings of compliance with the provisions of Sections ; XIII,D,5 and XXII',B.13, of the Village Zoning Ordinance and recommended that said special use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby affirmatively ONE: find that the special use, as hereby authorized, fully complies with the requirements and standards set forth in Section XIII,D,5 and Section XXII,B,3 of the Village Zoning Ordinance, and the special use of the real estate, the legal description of which is set forth on Exhibit A attached hereto and made a part hereof, as and for purposes of a Planned Development- Office Complex and accessory storage facilities, be and the same is hereby authorized and approved subject to the'conditions hereinafter set forth. SECTION That the approval and authorization of said special use hereby TWO: granted is subject to the following conditions: A) That all use, construction and development shall be in accordance with a certain Site Plan dated December 26, 1973, • copy of which marked Exhibit B is attached hereto and made • part hereof, the terms of this Ordinance, and all repre- sentations made by the applicants to the Plan Commission and President and Board of Trustees; B) That the total floor area designed for use as offices shall not exceed 75% of the gross floor area of all buildings; C) That no building or structure shall be erected nearer than 150 feet to the center line of County Line Road or to a height in excess of 40 feet, excluding such appurtenances as are permitted to exceed the building height under the provisions of Section V,3 of the Village Zoning Ordinance; D) That the ground coverage of buildings shall not exceed 30% of the total area of the Subject Property and the ratio w ; of gross floor area to gross land area shall not exceed .375; E) That storage area may be utilized only by office tenants and no single tenant shall occupy more than 25% of the storage area unless such tenant occupies more than 25% of the office space and then only proportionately to such tenant's occu- pancy of office space. No building or other permits authorizing construction on the Subject Property shall be issued until the applicants shall have applied for and obtained a permit from the Illinois Environmental Protection Agency to connect to and be served by the Village sanitary sewer system SECTION That any violation of the conditions hereinabove set forth THREE: shall authorize the revocation of the special use hereby authorized. SECTION That the Village Clerk is hereby directed to publish this FOUR: Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and effect from FIVE: and after its passage, approval and publication as provided by law.
