ORDINANCE NO. 2022- 0-99-32
AN ORDINANCE AMENDING ARTICLE 7 OF CHAPTER 6 OF
"THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975,"
AS AMENDED, REGARDING FENCING OF OUTDOOR SWIMMING POOLS
WHEREAS, Article 7 of Chapter 6 of the "The Municipal Code of the Village of
Deerfield, Illinois, 1975", as amended ("Village Code'), regulates the construction and
maintenance of swimming pools in the Village; and
WHEREAS, the Village previously required fencing to be installed around all outdoor
swimming pools in Village ("Fence Requirement'; and
WHEREAS, on July 15, 2019, the Village adopted Ordinance 0-19-19, which, in part,
adopted the Village of Deerfield to adopt the 2018 Edition of the International Pool and Spa
Code and repealed the Fence Requirement; and
WHEREAS, while the 2018 Edition of the International Pool and Spa Code requires
fencing of some outdoor pools, it does not require all outdoor pools to be fenced; and
WHEREAS, the Village now desires to amend Article 7 of Chapter 6 of the Village
Code to re -adopt the Fence Requirement; and
WHEREAS, the Village Board has determined that it will serve and be in the best
interests of the Village and its residents to amend the Village Code pursuant to this
Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.
SECTION TWO: ADOPTION OF FENCE REQUIREMENT. Article 7, titled
"Swimming Pools," of Chapter 6, titled "Building," of the Village Code is hereby amended to
adopt a new Section 6-48 to read as follows:
"Sec. 6-48. Fences and Gates:

placed at the torn of the gate and made inaccessible to small children.

SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to
publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois.
SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and
effect from and after its passage and approval in the manner provided by law_
