DANIEL VAN DUSEN Deputy Village Clerk Prepared by and after recording return to: Daniel Van Dusen Village of Deerfield 850 Waukegan Road Deerfield, IL 60015 850 WAUKEGAN ROAD DEERFIELD, ILLINOIS 60015 TELEPHONE 847.945.5000 FAX 847.945.0214 VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 2022- 4-22-29 AN ORDINANCE VACATING THE STRIP OF PROPERTY ON HAZEL AVENUE BETWEEN PARK AVENUE AND SPRINGFIELD AVENUE Published in pamphlet form by authority of the President and Board of Trustees of the Village of Deerfield, Lake and Cook Counties, Illinois, this 20th day of _ September , 2022. {00128262.2) PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, this 19thday of September , 2022. -1- VILLAGE OF DEERFIELD ORDINANCE NO. 2022- 0-22-29 AN ORDINANCE VACATING THE STRIP OF PROPERTY ON HAZEL AVENUE BETWEEN PARK AVENUE AND SPRINGFIELD AVENUE WHEREAS, The Village of Deerfield ("Village") is the record owner of that certain strip of real property located on the southern edge of Hazel Avenue between Park Avenue and Springfield Avenue in Deerfield, Illinois, and legally described on Exhibit A attached to and, by this reference, made a part of this Ordinance ("Property"); and WHEREAS, the Property is situated within a Deerfield Park District ("Park District") owned property known as Jewett Park, which portion of the property is legally described on Exhibit B attached to and, by this reference, made part of this Ordinance ("Jewett Park"); and WHEREAS, the Property is an unimproved alleyway; and WHEREAS, the Park District has requested that the Village vacate and convey to the Park District the Property; and WHEREAS, Section 11-91-1 of the Illinois Municipal Code, 65 ILCS 5/11-91-1, authorizes the Village Board to vacate any public street, alley, or right-of-way, or part thereof, in order to serve the public interest; and WHEREAS, the Village has determined that the public interest will be served by vacating the Property, as described in and depicted on the Plat of Vacation attached to, and by this reference, made a part of this Ordinance as Exhibit C ("Plat of Vacation"), subject to the terms and conditions set forth in this Ordinance; and WHEREAS, the Village has further determined that, upon the effective date of the vacation of the Property, the Property is to be incorporated into and made a part of Jewett Park, and title and sole responsibility of upkeep and maintenance will vest in the then - owners of the Property; and WHEREAS, the Village Board has found that the vacation of the Property will not inhibit any currently existing street access for any parcel or tract dependent on the Property as its sole means of access; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the approval of the Requested Relief is in the best interests of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as the findings of the Village Board. {00128262.2) -2- SECTION TWO: VACATION OF THE PROPERTY. Subject to, and contingent upon, the condition set forth in Section Three of this Ordinance, and pursuant to 65 ILCS 5/11-91-1 and the home rule powers of the Village, the Village Board hereby: (a) vacates that Property depicted on the Plat of Vacation; and (b) approves the Plat of Vacation. SECTION THREE: CONDITION. Immediately upon the recordation of this Ordinance and the Plat of Vacation, as provided in Section Five of this Ordinance, the Park District must take all actions necessary for the assignment of a new property identification number for the vacated Property. SECTION FOUR: COMPENSATION FOR VACATED PROPERTY. In consideration of the vacation of the Property, as set forth in Section Two of this Ordinance, the Park District must pay compensation to the Village amounting to the costs and expenses incurred by the Village in completing and providing for the vacation of the Property, including specifically, but without limitation, attorney's fees and third -party costs to prepare the plat of vacation ("Vacation Compensation"). SECTION FIVE: RECORDATION. Upon receipt by the Village of the Vacation Compensation from the Park District, the Village Clerk is hereby directed to cause this Ordinance and the Plat of Vacation to be recorded in the Office of the Recorder of Lake County. SECTION SIX: TITLE TO THE VACATED PROPERTY. Upon the recordation of this Ordinance and the Plat of Vacation, as provided in Section Five of this Ordinance, the vacated Property is to be incorporated into and made a part of that certain parcel that is a component of Jewett Park and to which the vacated Property is adjacent, and title will vest in the then -owners of Jewett Park. Following the recordation of this Ordinance, the vacated Property will be and remain a part of Jewett Park, unless and until a plat of subdivision is approved by the Village in accordance with all applicable state and local statutes, ordinances, and regulations. SECTION SEVEN: MAINTENANCE OF THE VACATED PROPERTY. After the recordation of the Plat of Vacation and this Ordinance, the Village will have no obligation to maintain or perform improvements on the vacated Property. SECTION EIGHT: RESERVATION OF RIGHTS. The vacation of the Property will not, and is not to, affect any easement rights the Village may have with regard to the Jewett Park, and such vacation is hereby subject to and limited by the easements and other rights set forth on the Plat of Vacation. SECTION NINE: EFFECTIVE DATE. This Ordinance will be effective only upon the occurrence of all of the following events: A. Passage by the Village Board by a majority vote in the manner required by law; B. Publication in pamphlet form in the manner required by law; and {00128262.2) -3- C.
