ORDINANCE NO. 0 -73 -68 AN ORDINANCE AMENDING CHAPTER 18 OF THE MUNICIPAL CODE OF DEERFIELD BY ADDING A NEW ARTICLE VII BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That Chapter 18 of the Municipal Code of ONE:- Deerfield of 1963, as amended, be and the same is hereby further amended by adding a new Article VII as follows: ARTICLE VII. NURSING AND REST HOMES 18.701 Definitions.) (a) "Nursing Home" shall mean a private home, institution, building, residence or other place, whether operated for profit or not, which provides, through its ownership or management, maintenance, personal care, or nursing for three (3) or more persons, not related to the applicant or owner by blood or marriage, or any similar facility in which maintenance is provided to three (3) or more per- sons who, by reason of illness or physical infirmity, require personal care or nursing. (b) "Sheltered Care Home" shall mean a private boarding home, institution, building, residence, or other place, whether operated for profit or not, which, through its ownership or management, provides sheltered care to three (3) or more persons who are not related to the applicant or owner by blood or marriage, or any similar facility in which mainten- ance is provided to three (3) or more persons, who, by reason of physical infirmity, require personal care. (c) "Maintenance" shall mean food, shelter and laundry. (d) "Personal Care" shall mean assistance with meals, dressing, movement, bathing or other personal needs, or general supervision and oversight of the physical and mental well -being of an individual, exclusive of nursing, who, because of age, physical or mental disability, emotional or behavior disorder, or mental retardation, is incapable of maintaining a private, independent residence or who is incapable of managing his person whether or not a conservator has been appointed for such individual. (e) "Nursing" shall mean professional nursing or practical nursing, as these terms are defined in "The Illinois Nursing Act," Chapter 91, Illinois Revised Statutes, 1973, as heretofore or hereafter amended, for sick or infirm persons who are under the care and supervision of licensed medical practitioners. (f) "Sheltered Care" shall mean maintenance and personal care. (g) "Nursing Home" and "Sheltered Care Home" shall not include the following: (1) A home, institution or other place operated by the federal government or agency thereof or by the State of Illinois; (2) A hospital, sanitarium or other institution whose principal activity or business is the diagnosis, care and treatment of human illness through the maintenance and operation of organized facilities therefor, which is required to be licensed under State law; (3) Any facility for child care. 18.702 License Required.) No person shall establish, conduct or maintain a Nursing Home or Sheltered Care Home within the meaning of this Article without first obtaining a license therefor in the manner provided herein. 18.703 Application for License; Contents.) (a) A person desiring a license shall file with the Village Manager a verified application conforming to the requirements of Section 12.001 of Chapter 12 of the Municipal Code of the Village of Deerfield. (b) The application shall be on a form prescribed, prepared and furnished by the Village Manager. -2- 18.704 Evidence to be Submitted to Obtain License.) (a) Before a license shall be issued, the person applying, if an individual, shall submit evidence satisfactory to the Village Manager that he is not less than eighteen (18) years of 'age, of reputable and responsible character and in sound mental health. (b) j' If the applicant is an association or corporation, evidence of the facts described in Subsection (a) of this Section shall be submitted as to all persons having. charge, direction or super- vision of the home or institution. (c) Every applicant shall, in addition, submit satisfactory evidence of his ability to comply with the minimum standards and with all rules and regu- lations promulgated under this Article. Deleted 11/19/73 1:8.7.05 License Regulations (a) Any Nursing Home or Sheltered Care Home shall be operated in conformity with the miniirium. standards and rules and regulations promulgated from time to time by the State Department of Mental Health pursuant to Chapter 111 -1/2, Sections 35.19 and-35.26, res- pectively, Illinois, Revised Statutes, 1973, as now in effect or as hereafter amended. Pew-- �3e�, -hi- sus- ia�- e- .aggrC_ g ate_ 0b) All licenses and renewals issued under this Article shall be on a form prescribed by Section 12.004 of Chapter 12 of the Municipal Code of the Village of .Deerfield. 18.706 Issuance and Renewal of License'.) If the applicant and the premises to.be licensed -are in compliance with all applicable Village ordinances -3- I I and State laws and the applicant is the holder of a license duly issued, for the premises proposed to be licensed, by the Department of Public Health of the State of Illinois, the Village Manager is hereby authorized to issue and renew licenses for the operation of Nursing Homes or Sheltered Care Homes. SECTION That all ordinances or parts of ordinances in TWO: conflict herewith are, to the extent of such conflict, hereby repealed. SECTION That the Village Clerk is hereby directed to THREE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage, approval and publication as provided by law.
