O-73-53ORDINANCE NO. . 0 -73- 53 AN ORDINANCE VACATING A CERTAIN STREET 'IN; THE' VILLAGE OF DEERFIELD WHEREAS, the President and Board of Trustees of the Village of Deerfield, after due investigation and consideration, have determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of the street hereinafter described. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS AS FOLLOWS: SECTION That the following described real estate in ONE: the Village of Deerfield, having heretofore been dedicated for public street purposes by a document recorded in the Office of the Recorder of Deeds of Lake County., Illinois on December 13, 1949, as Document No. 686957, commonly known as the South one -half (1/2) of that .portion of Berkley Court extend- ing from Wilmot Road, easterly to.its terminus at the westerly boundary of Woodland Park, as shown on and designated by the words,-."Hereby Vacated," on the Plat hereto attached, which Plat,. for greater certainty., is hereby made a part of this ordinance,. be and the same is hereby vacated and closed, inasmuch as same is no longer required for public use and the public interest will be subserved by such vacation. SECTION That the Village of Deerfield reserves its TWO: interest in all existing easements for public utilities in the vacated portion of said street which is herein - above described and, in addition, reserves a perpetual easement of right -of -way for purposes of laying, constructing and maintain- ing a public sidewalk or other form of public pedestrian right -of- way over and upon the northerly five feet of that portion of said street to be vacated and including the right to enter upon said real estate for the aforesaid purposes and the right to trim,'cut and remove trees, bushes and other landscaping that interferes or may interfere with said public right -of -way.
