O-73-31ORDINANCE NO. 0 -73 -31 AN ORDINANCE-VACATING A CERTAIN. 'STREET 'IN THE VILLAGE 'OF' DE'ERFIELD WHEREAS, the President and Board of Trustees of the Village of Deerfield, after due investigation and consideration, have' determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of the street hereinafter described. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECThON That the following described real estate in the ONE: Village of Deerfield, having heretofore been dedicate =or public street purposes by a document recorded in the Office of the Recorder of Deeds of Lake County, Illinois on December 13, 1949, as Document No. 686957, commonly known as that portion of Berkley Court extending from Wilmot Road easterly to its terminus at the westerly boundary of Woodland, Park, and which is legally described as follows: The North 28 feet of Berkley Court from the east side of Wilmot Road to a distance 450 feet east. as shown on and designated by the words, "Hereby Vacated," on the Plat hereto attached, which Plat, for greater certainty, is hereby made a part of this Ordinance, be and the same is hereby vacated and closed, inasmuch as same is no longer required for public use and the public interest will be subserved by such vacation. SECTION That the Village of Deerfield reserves its interest TWO: in all existing easements for public utilities in the vacated portion of said street which is hereinabove described and, in addition, reserves a perpetual easement of right -of -way for purposes of laying, constructing and maintaining a public sidewalk or other form of public pedestrian right -of -way over and upon a\ten -foot wide strip of the aforesaid street to be vacated, described as lying five feet on both sides of the center and including the right to enter aforesaid purposes and the right bushes and other landscaping that said public right -of -way. line of said street to be vacated upon said real estate for the to trim,. cut and remove trees, interferes or may interfere with SECTION That, upon passage and approval of this Ordinance, THREE: the Village Clerk shall file for record in the Office of the Recorder of Deeds of Lake County, Illinois, a certified copy of this Ordinance, together with the Plat hereto attached. SECTION That all ordinances and parts of ordinances in FOUR: conflict herewith are, to the extent of such conflict, hereby repealed. SECTION That this Ordinance shall be in full force and FIVE:, effect from and after its passage, approval and filing for record in the manner herein provided and upon the payment of the fee provided for in Section 11.123'of the Municipal Code of Deerfield of 1963, as amended, and upon the further payment of the sum of $2,000.00 by the owners of the real property abutting said portion of the street to be vacated.
