O-22-19VILLAGE OF DEERFIELD ORDINANCE NO. 2022- 0-22-19 AN ORDINANCE AMENDING SECTIONS 2-156 AND 2-158 OF "THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD, ILLINOIS, 1975," AS AMENDED, TO ELIMINATE THE VILLAGE CENTER COMMISSION AND CHANGE THE COMPOSITION OF OTHER SPECIAL BOARDS AND COMMISSIONS WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, the Village has created a Village Center Commission ("VCC'), which is charged with, among other things, recommending programs, efforts and partnerships to enhance the downtown area within the Village; and WHEREAS, the VCC has achieved success over the years, and the administration of promotional and business advocacy programs for the downtown area is now administered directly by staff, reducing the need for the VCC; and WHEREAS, in consultation with the Chairperson of the VCC, Village staff recommend that the VCC be dissolved; and WHEREAS, the composition and duties of the special boards and commissions are set forth in: (i) Article 12 of Chapter 2 of "The Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code'; and WHEREAS, the Village Board desires to Amend Article 12 of Chapter 2 of the Village Code to eliminate the VCC and to amend the composition of the Family Days Commission and the Sustainability Commission in order to match current practice; and WHEREAS, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to amend the Village Code pursuant to this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE. RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO. NUMBER OF MEMBERS. Section 2-156, titled "Establishment; Number of Members"," of Article 12, titled "Special Purpose Boards and Commissions," of Chapter 2, titled "Administration," of the Village Code is hereby amended as follows: "Sec. 2-156. DUTIES AND FUNCTIONS. Section 2-158, titled "Duties and Functions," of Article 12, titled "Special Purpose Boards and Commissions," of Chapter 2, titled "Administration," of the Village Code is hereby amended as follows: "Sec. 2-158. Duties And Functions: (a) The special purpose boards and commissions shall have the duties and functions set forth below: (6) Reserved. SEVERABILITY. If any provision of this Ordinance or part thereof is held invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance are to remain in full force and effect, and are to be interpreted, applied, and {00125902.1} Additions are bold and double -underlined; a^11^tiens are str- ,,v through. 4 enforced so as to achieve, as near as may be, the purpose and intent of this Ordinance to the greatest extent permitted by applicable law. SECTION FIVE. PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION SIX. EFFECTIVE DATE. This Ordinance will be in full force and effect after its passage, approval, and publication in the manner provided by law.
