O-73-03ORDINANCE NO. 0 -73- 3 AN ORDINANCE AMENDING SECTION 13.705 AND SECTION 13.710 OF CHAPTER 13 OF THE MUNICIPAL CODE OF DEERFIELD Published ih pamphlet form this... 15th day of January 1 1973, by the President and Board of Trustees of Deerfield ORDINANCE NO. 0 -73- 3 AN ORDINANCE AMENDING SECTION. - 13.705 AND-SECTION 13.710 OF CHAPTER :13 'OF THE MUNICIPAL CODE 'OF DEERFIELD BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section 13:705 of Chapter 13 of the ONE: Municipal Code of.Deerfield of 1963; as amended, . be and the same is hereby further amended by striking said Section in its entirety and substituting in lieu thereof the following: "13.705 Prohibited Pictures.) "Jh) It shall be unlawful for any person to knowingly_ exhibit, display or other- wise show a motion picture or theatrical production, for which a fee is charged or in a public theatre, which'is obscene; nor shall any person knowingly assist in the production, exhibition, display or showing of. any such obscene motion picture or theatrical performance. (b) It shall be unlawful for any person to knowingly or recklessly permit or allow a person who has not attained his 18th birthday to see, view, witness, attend or be present at any show, motion picture, theatrical per- formance or display which is obscene to persons under the age of 18. "(c) A motion picture or theatrical production is obscene if, considered as a whole, its predominant appeal is to prurient interests; and it is patently offensive in light of current community standards; those community standards being defined as national community standards; and it is utterly without redeeming social value, or if possessed of slight social value, is pandered to the public. Predominant appeal shall be judged with reference to ordi- nary adults; however, if it appears that persons under the age of 18 shall knowingly or recklessly be permitted to be within the audienceto which a motion picture or theatrical performance'is shown or performed, then, as to such persons, the predominant appeal shall be judged with reference to persons under the age of 18. � I "(d) As used in this Article, the term "person" shall be taken to mean any natural person, firm, partnership,association, corporation or organization of any kind." SECTION That Section 13.710 of Chapter 13'of the TWO: Municipal Code of Deerfield of 1963, as amended, be and the same is hereby further amended by striking said Section in its entirety and substituting in lieu thereof the following: "13.710 Penalty.) Any person who violates any of the provisions of this Article shall be fined not more than $500 for each such violation. 'A separate offense shall be deemed committed on each day during or on which a violation occurs or continues. A violation of a provision of this Article shall be grounds for the revoca- tion of the license herein provided for." SECTION That all ordinances or parts of ordinances in .THREE: conflict herewith are, to the extent of such conflict, i�ereby repealed. SECTION That the Village Clerk is hereby directed to FOUR: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be'in full force and FIVE: effect from and after its passage, approval and publication as provided by law.
