ORDINANCE NO. 0 -73 -4 AN ORDINANCE APPROVING A PLANNED DEVELOPMENT (HOVLAND LOTS 16, 17,' 24 and 25-) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of CHESTERFIELD DEVELOPMENT CORP. for the approval of a single - family residential planned development of certain real estate hereinafter described, located in the Hovland Subdivision and classified in the R -1 -B District of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the said hearing was held pursuant to duly published notice thereof and was, in all respects, held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, recommended that said planned development be approved subject to certain conditions and restrictions; and WHEREAS, CHESTERFIELD DEVELOPMENT CORP. has petitioned for a certain variation from the strict provisions of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, relating to the R -1 -B District and, in particular, Section VI- B,D,2,a, so as to permit resubdivided lots having a minimum area of less than 10,800 feet; and WHEREAS, pursuant to notice duly published, as required by Atatute, a Public hearing on said Petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That there are practical difficulties and ONE: particular hardship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield, as applied to Petitioner's property, and a variation from the provisions of Section VI,B,D,2,a is hereby granted and the proposed single - family planned residential development of the real estate legally described as follows: Resubdivision of Lots 16, 17, 24 and 25 in J.S. Hovland's First Addition to Deerfield in the Southwest 1/4 of Section 32, Township 43 North, Range 12 East of the Third Principal Meridian in Lake County, Illinois and as set forth and described on the attached plan of development and preliminary plat of resubdivision, which plan and plat of resubdivision are made a part of this Ordinance, be and it is hereby approved subject to the conditions and restrictions herein- after set forth. 'SECTION That the approval of said planned development TWO: is conditioned upon the following: A. That the developer, Chesterfield Development Corp., shall construct and install and improve Gordon Terrace fi m;Fairview o Avenue easterly to the east.line of Lot�_';17 in the following manner: 1. Street pavement (full width of street)., including curb and gutter, street signs and street lighting. 2. Such other subdivision improvements as may be required to serve the lots proposed to front or abut on Gordon Terrace, in accordance with the applicable provisions of the Municipal Code of the Village of Deerfield. all of which improvements shall be constructed and installed in accordance with the applicable provisions of the Municipal Code of the Village of Deerfield. B. That the developer, Chesterfield Development Corp., shall dedicate, construct and install and improve Country Lane from Fairview Avenue easterly to the east line of Lots 17 and 24 in the following manner: 1. Complete improvements including storm sewer, street pavement (full width of street), curb, gutter, street signs, street lighting, sanitary sewer,.water mains and services, including all necessary appurtenances and connections and all other subdivision improvements as may be required to serve the Lots fronting or abutting on Country Lane and the proposed cul -de -sac in accordance' with the applicable provisions of the Municipal Code of Deerfield. •Yi all of which improvements shall accordance with the applicable the Village of Deerfield. be constructed and installed in provisions of the Municipal Code of C. That the plan of the cul -de -sac, attached hereto and made a part hereof, be made a part of the plan of development of the subject property and that the same be improved in the manner specified including, in particular, a 5 -foot parkway and 5 -foot sidewalk as shown thereon. all of which improvements shall be constructed and installed in accordance with the applicable provisions of the Municipal Code of the Village of Deerfield. SECTION That the approval of the planned development THREE: hereby given is subject to the further condition that the developer, Chesterfield Development Corp.,submit for approval a final plat of resubdivision of the real estate described in Section One hereof and, except as otherwise provided in this Ordinance, comply with all requirements of the Village Code of the Village of Deerfield necessary for the approval of said final plat. SECTION That all ordinances or parts of ordinances in FOUR: conflict herewith are, to the extent of such conflict,-fereby repealed. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and SIX: and effect from and after its passage, approval and publication as provided by law.
