AN ORDINANCE APPROVING A PLANNED
DEVELOPMENT ('Hovl'and Lots 131: 'arid 132 )
WHEREAS, the Plan Commission of the Village of Deerfield
has heretofore held a public hearing on.the application of
Mrs. Pat Gustie, Owner, for the approval of a single - family residen-
tial planned development of certain real estate hereinafter described,
located in the Hovland Subdivision and classified in the R -1 -B District
of the Zoning Ordinance of the Village of Deerfield;and
WHEREAS, the said hearing was held pursuant to duly published
notice thereof and was, in all respects, held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield,
after considering the evidence adduced, recommended that said planned
development be approved subject to certain conditions and restrictions;
and
WHEREAS, the Owner has petitioned for a certain variation
from the strict provisions of the Zoning Ordinance of the Village of
Deerfield, passed May 4, 1953, as amended, relating to the R -1 -B
District and, in particular, Section VII,C,2 and Section VI,B,2, so as
to permit a side yard along the east line of proposed Lot 1 of the
resubdivision of three feet in lieu of the required seven feet; and
WHEREAS, pursuant to notice duly published, as required by
statute, a public hearing on said Petition was held and conducted by
the Zoning Board of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the
President and Board of Trustees its written findings of fact and
recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
AS FOLLOWS:
SECTION That there are practical difficulties and particular
ONE: hardship in the way of carrying out the strict let-
ter of the provisions of the Zoning Ordinance of the Village of
Deerfield, as applied to Petitioner's property, and a variation from
the provisions of Section VII,C,2 and Section VI,B,2.is hereby granted
and the proposed single - family planned residential development of the
real estate legally described as follows:
Lots 131 and 132 in J.S. Hovland's First Addition
to Deerfield in the Southwest 1/4 of Section 32,
Township 43 North, Range 12, East of the Third
Principal Meridian in Lake County, Illinois
as set forth and described on the attached plan of development and
preliminary plat of resubdivision, which plan and plat of resubdivi-
sion are made a part of this Ordinance, be and it is hereby approved
subject to the conditions and restrictions hereinafter set forth.
SECTION That the approval of said planned development is
TWO: conditioned upon the following:
A. That the Owner dedicate the South 30 feet of Lots 131
and 132 to the Village of Deerfield as and for street purposes, and
that, prior to the issuance of a building permit for any portion of
Lots 131 and 132, as the same may be resubdivided, the Owner shall
deposit sufficient funds in escrow with the Village or make other
provisions satisfactory to the Village to insure the payment of her
proportionate share of the installation of full street improvements
in accordance with the applicable provisions of the Village Code
for the proposed street to be constructed on the South 30 feet of
said Lots 131 and 132.
B. That the final plat of resubdivision herein provided
contain on its face a building line restriction prohibiting the
construction of any structure on proposed Lot 2, nearer than 12 feet
to the west line of said Lot.
C. That the Owner construct and install the following
improvements:
1. Sidewalks in accordance with Village standards
along that portion of Wilmot Road and Gordon
Terrace which abuts the Subject Property;
2. Such other subdivision improvements as may be
required to serve the lots,proposed to front or
abut on Gordon Terrace and Wilmot Road in accord-
ance with the applicable provisions of the
Municipal Code of the Village of Deerfield.
SECTION That the approval of the planned development hereby
THREE:. given is subject to the further condition that the
Owner, Mrs. Pat Gustie, submit for approval a final plat of resubdivi-
sion of the-.re&L ^estate described in Section One hereof and, except
as otherwise provided in this Ordinance, comply with all requirements
of the Village Code of the Village of Deerfield necessary for the
approval of said final plat.
SECTION That all ordinances or parts of ordinances in conflict
FOUR: herewith are, to the extent of such conflict, hereby
repealed.

SECTION, That the Village Clerk is hereby directed to
FIVE: publish this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and
effect from and after its passage, approval and
publication as provided by law.
