O-18-33VILLAGE OF DEERFIELD ORDINANCE NO. 2018- 0-18-33 AN ORDINANCE AMENDING SECTION 12.02-D OF "THE DEERFIELD ZONING ORDINANCE 1978", AS AMENDED, REGARDING THE MINIMUM SIZE OF SITE FOR RESIDENTIAL PLANNED UNIT DEVELOPMENTS IN THE R-5 DISTRICT WHEREAS, 1219 Partners, LLC ("Developer's desires to construct seven townhomes ("Development's on the parcel of property consisting of approximately 0.89 acres and comprised of three lots of record commonly known as 658, 662, and 702 Elm Street, in Deerfield, Illinois (collectively, the "Property'; and WHEREAS, in connection with the Development, Developer filed an application with the Village seeking approval of, among other things, a special use permit for a planned residential development ("PUYand the rezoning of the Property to the R-5 District (`Rezoning'; and WHEREAS, on Ngy. 5-, 2018, the Village Board adopted Ordinance No. 0' lb'34, which approved the Rezoning; and WHEREAS, Article 12 of the "The Deerfield Zoning Ordinance 1978", as amended ("Zoning Ordinance', regulates the approval and development of planned unit developments in the Village; and WHEREAS, pursuant to Section 12.02-D of the Zoning Ordinance, residential planned unit developments in the R-5 General Residence District ("R-5 District's must have a minimum site size of at least one acre (`2Vlinimum Site Size'; and WHEREAS, in order to complete the Development, Developer also requested an amendment to Section 12.02-D of the Zoning Ordinance to reduce the Minimum Site Size for residential planned unit developments in the R-5 District from one acre to 0.8 acres ("Proposed Amendment'; and WHEREAS, a public hearing by the Plan Commission to consider the Proposed Amendment to the Zoning Code was duly advertised on May 3, 2018, in the Deerfield Review, and was held May 24, 2018; and WHEREAS, on May 24, 2018, the Plan Commission approved findings of fact in support of the Proposed Amendment, in accordance with and pursuant to Section 13.10 of the Zoning Ordinance, and voted to recommend approval of the Proposed Amendment by the Village Board; and WHEREAS, the Village Board has considered the standards for amendments set forth in Section 13.10 of the Zoning Ordinance; and WHEREAS, the Village Board has determined that it will serve and be in the best interest of the Village to adopt of the Proposed Amendment, as set forth in this Ordinance; Additions are bold and double -underlined; deletions are thr-&Rgh. r-&Rg NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as findings of the Village Board. SECTION TWO: MINIMUM SIZE OF SITE. Section 12.02-D, titled "Minimum Size of Site," of Section 12.02, titled "Residential Planned Unit Developments," of Article 12, titled "Planned Unit Developments and Planned Residential Developments," the Zoning Ordinance is hereby amended to read as follows: "12.02-D Minimum Size of Site The minimum gross area of one (1) acre shall be required of each site for consideration of a Planned Unit Development in the R-5 General Residence District. 1. Except as provided in subparagraph 2, the minimum gross area of one (1) acre shall be required of each site for consideration of a Planned Unit Development in the R-5 General Residence District. 2. The minimum gross area of 0.9 acre shall be required of each site for consideration of a Planned Unit Development in that part of the R- 5 General Residence District bounded by Deerfield Road, Forest Avenue, Walnut Street and Chestnut Street. 3 The minimum ross area of 0.89 acre shall be required of each site for consideration of a Planned Unit Develonment in_ at part of the R-5 General Residence District bounded by Sunset Court. Elm Street. Osterman Avenue. and Chestnut Street. SECTION THREE: PUBLICATION. The Village Clerk is hereby directed to publish this Ordinance in pamphlet form pursuant to the Statutes of the State of Illinois. SECTION FOUR: EFFECTIVE DATE. This Ordinance will be in full force and effect from and after its passage and approval in the manner provided by law.
