ORDINANCE NO. 0 -72 -61 AN ORDINANCE AMENDING SECTION 11.120 OF CHAPTER 11 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD BE IT ORDAINED BY THE PRESIDENT AND BOARD OF-TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section 11.120 of Chapter 11 of the Muni - ONE: cipal Code of Deerfield of 1963, as amended, be and the same is hereby further amended by striking said Section in its entirety and substituting in lieu thereof the following: 11.120 VIEWS AT CORNERS. (a) Definitions. As used in this section, the following terms shall have the meanings hereafter set forth: Curb: The word curb shall mean and include the edge of the street pavement or the edge of the traveled portion of an improved street surface where there is no curb. Nonregulated Intersection: The phrase nonregulated intersection shall mean an intersection of two streets neither of which is controlled by a stop sign or a traffic control device as de- fined in Chapter 20 of the Municipal Code. Regulated Intersection: The phrase regulated inter- section shall mean an intersection of two streets, one of which is designated as a "stop street" as defined in Chapter 20 of the Municipal Code and the other of which is not controlled by either a stop sign or a traffic control device as defined in such Chapter. Property: The word property shall mean and include public as well as private property. Plants: The word plants shall include trees except those whose branches have been trimmed to a; point not less than six feet above the ground, or which have no such branches. (b) Unsafe Intersection: Whenever a nonregulated or regu- lated intersection shall be declared to be an un- safe intersection, the existence of fences, walls, parapets, shrubs, bushes and other plants at a height in excess of 36 inches above the adjoining street grade at such intersection is expressly found and de- clared to be a public nuisance which unreasonably obstructs or interfers with vehicular traffic visi- bility tending to create a dangerous or hazardous condition whenever such fence, wall, etc., is located within the following areas: (1) Non- regulated Street Intersections. The areas within triangles- -formed by . extending each of the nearest curb lines of the adjoining two intersecting.streets to two points, each up to but not exceeding 90 feet distant from the point of intersection of said curb lines and a line connecting said two points. ,as determined by the Board of Trustees-for the particular intersection. 90 (2) a Regulated street intersections. The areas within triangles- fiormed by extending the nearest curb line of the adjoining regulated street to a point up to but not exceeding 10 feet from the point of intersection of ,the curb lines herein described and by extending the nearest curb line of the adjoining non - regulated street to a point up to but not exceeding 300-feet, distant from the point of intersection of said curb lines and a line connecting said two points, as deft,-ermined by the Board of Trustees for'tYe particular intersection. 300 -2- (c) Prohibition and Abatment: It shall be unlawful for.any person to cons ruc or install a fence, wall, parapet or similar structure or to plant or to allow to grow shrub, bush or other plant in such location and to such a height at such intersections as would constitute a public nuisance, as herein defined and declared. It shall be unlawful for any owner or occupant of any lot or parcel adjoining a street intersection declared to be an unsafe intersection to fail, neglect or refuse to remove any existing fence, wall, parapet or other structure at a location constituting a public nuisance as herein defined and declared or to fail, neglect or refuse to remove, trim, out or prune any existing shrub, bush or other plant at such locations within aO days after such intersection has been declared to be an unsafe intersection pursuant hereto. (d) The following intersections are hereby declared to be unsafe intersections: SECTION That all ordinances or parts of ordinances in TWO: conflict herewith are, to the extent of such conflict-,—Hereby repealed. SECTION That the Village Clerk is hereby directed to pub - lish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage, approval and publication as provided by law.
