O-72-31ORDINANCE NO. 0 -72 -31 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY COMMONLY KNOWN AS 207,FORESTWAY DRIVE, DEERFIELD WHEREAS, HARVEY S. and SHELIA DULIN have petitioned for a variation from the strict provisions of Section VII,C,2 of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, to permit an 18 foot total side yard in lieu of the required 20 feet; and WHEREAS, pursuant to notice duly published as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendations ONE: of the Zoning Board of Appeals is hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and TWO: particular hardship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to petitioner's property which is legally described as follows: Lot 21 in Third Addition to Deerfield Park, Unit One, a subdivision in the West Half of the South- east Quarter of Section 32, Township 43 North," Range 12 East of the Third Principal Meridian, according to the plat thereof recorded December 22, 1958, as Document No. 1015141 in Book 34 of Plats, page 96 therein, in Lake County, Illinois SECTION That a variation from the strict provisions THREE: of Section VII,C,2 of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended, with respect to the property hereinabove described, is hereby granted so as to authorize the construction of a garage thereby permitting an 18 foot total side yard in lieu of the required 20 feet all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject "FOUR: to compliance by the Petitioner with all other applicable provisions of the Zoning Ordinance and'with all other applicable ordinances of the Village. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law. AYES: FIVE (5) NAYS: NONE.
