O-72-36ORDINANCE NO. 0 -72- 36 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY LOCATED AT 400 COUNTY LINE ROAD, DEERFIELD','I'LLINO'IS WHEREAS, KEEPPER NAGEL, INC., on behalf of the owner of the property hereinafter described, has petitioned for certain variations from the strict provisions of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended; and WHEREAS, pursuant to notice duly published as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of ONE: the Zoning Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and TWO: particular hardships in the way of carrying out the strict letter of provisions of the Zoning Ordinance of the Village of Deerfield, as applied to Petitioner's property, which is legally described as follows: That part of the Southeast Quarter of Section 33, Township 43 North, Range 12 East of the Third Principal Meridian, described as follows: Beginning at the Southwest corner of the Southeast Quarter of said Section 33; thence North along the West line thereof, 467.03 feet; thence Northeasterly toward a point in the center line of Waukegan Road, 750.0 feet Northwesterly of the intersection of the center line of Waukegan Road with the South line of said Section 33, a distance of 169.18 feet; thence South parallel with the West line of said Southeast Quarter, 544.15 feet to the South line of the Southeast Quarter of said Section 33; thence West along said South line 110.0 feet to the place of beginning, in Lake County, Illinois. Except for the West 150.feet of the South 50.0 feet of the Southwest Quarter of the South- east half of Section 33, Township 43 North, Range 12. SECTION That variations from the strict provisions of THREE: Section XVII -B -1 -b and Section XVII -B -3 -d of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended with respect to the property hereinabove described, are granted so as to permit the erection and maintenance of a free- standing sign having six faces and a surface area of 10.68 square feet per face and located 2 feet 5 inches from the front lot line within the required 5 foot front yard, all in accordance with the plans presented and filed with the Zoning Board of Appeals which are by reference incorporated herein. SECTION That the variations hereby granted are subject to FOUR: compliance by Petitioner with all other applicable provisions of the Zoning Ordinance and all other applicable Ordinances of the Village. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval as provided by law.
