ORDINANCE NO. 0- 72 -40 AN ORDINANCE ALLOCATING MOTOR FUEL TAX FUNDS OF THE VILLAGE OF DEERFIELD TO THE NORTH 'S'UB'URBAN MASS 'TRANS'IT* 'DISTRICT WHEREAS, on July 19, 1971, the President and Board of Trustees of the Village of Deerfield, by ordinance duly enacted, did elect to participate in the creation of the North Suburban Mass Transit District; and WHEREAS, the Board of Trustees of the North Suburban Mass Transit District have determined the financial needs of the North Suburban Mass Transit District for its proper operation, mainten- ance and existence for the fiscal year commencing July 1, 1972, and'ending June 30, 1973; and WHEREAS, the President and Board of Trustees of the Village of Deerfield find that, in view of the recent organization of said District, it is desirable and in the public interest that a portion of its Motor Fuel Tax funds be allocated to the North Suburban Mass Transit District for mass transit purposes on a pro -rata basis with other participating municipalities, so as to provide the neces- sary funds for the operation and maintenance of the District during the coming fiscal year of said District; and WHEREAS, the President and Board of Trustees do hereby expressly declare that the allocation of funds authorized by this Ordinance is not to be construed as a continuing commitment or policy of the Village of Deerfield to provide funds to said District. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That, in accordance with, and by the authority ONE: of Illinois Revised Statutes, Chapter 121, Section 7- 202.14(a), the amount of Six Thousand Five Hundred Fifty -Two ($6,552.00) Dollars, which is a portion of the Motor Fuel Tax Funds allotted to the Village of Deerfield, shall be, and hereby is, authorized for the benefit of the North Suburban Mass Transit District. SECTION That said funds shall be under the exclusive TWO: control of the Trustees of the North Suburban Mass Transit—District, and their use shall be made by them for any legitimate and lawful purpose of said transportation district as set forth in Section 355, Chapter 111 -2/3 of Illinois Revised Statutes. SECTION That the Village Clerk is hereby directed to THREE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage, approval and publication, as provided by law.
