I a ORDINANCE NO. 0-72-41 AN ORDINANCE AUTHORIZING A SPECIAL USE '(110' WAUKEGAN ROAD,, MULT'T- BUSINESS 'USE) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of JAMES DI PIETRO to authorize the use and occupancy of certain real estate commonly known as 110 Waukegan Road, Deerfield, Illinois, and hereinafter described, for multiple principal uses including an "automobile accessory store" (Firestone Service Center) and a "contractor's office" (Pile Swimming Pool Company) as special uses under and pursuant to the provisions of Sections XIII,D,3,d; XIII,D,3,j; XIII,D,3,k; XIII,D,4; XIII,B,7; XIII,D,5 and XXIII of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, recommended that said special usesbe denied; and WHEREAS, the President and Board of Trustees reviewed the report and recommendation of the Plan Commission and heard further testimony from the applicant and found that, subject to certain conditions hereinafter set forth, the allowance of said special uses would be in compliance with the provisions of Sections XIII,D,5 and XXIII,B,3 of the Village Zoning Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the President and Board of Trustees do hereby ONE: affirmatively find that the special uses, as hereby authorized, fully comply with requirements and standards set forth in Section XIII,D,5 and XXIII,B,3 of the Village Zoning Ordinance, and the special uses of the real estate legally described as follows: That part of the South 1/2 of Section 33, Township 43 North, Range 12 East of the Third Principal Meridian described as follows: Beginning at a point in the center line of Waukegan Road, 750.0 feet Northwesterly of its intersection with the South line of the Southwest 1/4 of the Southeast 1/4 of said Section 33; thence Southwesterly along a line which is perpendicular to the center line of Waukegan Road, 440.20 feet, more or less, to a point in the West line of said Southwest . 1 i 1/4 of the Southeast 1/4, 467.03 feet North of the Southwest corner of said Southwest 1/4 of the Southeast 1/4; thence South along said West line of said Quarter Quarter section, a distance of 32.03 feet; thence West along a line-parallel to and 435.0 feet North of the South line of said South 1/2 of Section 33, a distance of 200.0 feet; thence North along a line parallel with and 200.0 feet West of the West line of said Southwest 1/4 of the Southeast 1/4, a distance of 100.42 feet; and thence Northeasterly along a line which is perpendicular to the center line of Waukegan Road, to a point in the center line of Waukegan Road, 153.21 feet Northwesterly of the place of beginning; thence Southeasterly along said center line of Waukegan Road, a distance of 153.21 feet to the place of beginning; except therefrom the Northeasterly 50 feet thereof measured at right angles from the center line of Waukegan Road in Lake County, Illinois. as and for purposes of multiple principal uses including an "automobile accessory store" (Firestone Service Center) and a "contractor's office" (Pile Swimming Pool Company) be and the same are hereby authorized and approved. SECTION That the approval. and authorization of said TWO: special uses hereby given is subject to the requirement that all use, construction and development shall be in accordance with all plans and representations submitted and made by applicant to the Plan Commission and President and Board of Trustees and is subject to compliance by applicant with all other applicable provisions of the Zoning Ordinance and all other applicable ordinances of the Village of Deerfield and is subject to the further express condition that the doors providing ingress and egress to the service bays located on the easterly side of the.proposed automobile accessory store shall be closed and remain closed at all times except to permit the entrance or exit of auto- mobiles from said service bays. Any violation of the conditions herein set forth shall authorize the revocation of the special uses hereby authorized. SECTION That the Village Clerk is hereby directed to THREE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and "FOUR: effect from and after its passage, approval and publication, as provided by law.
