RESOLUTION APPROVING THE PURCHASE OF
8,26, DEERFIELD'ROAD
(Piersen Property)
WHEREAS, it is in the interest of this Village that it
acquire for public street, public parking and other related pur-
poses the property commonly known as 826 Deerfield,.Road in the
Village of Deerfield and which property is legally described as
follows:
PARCEL 1
Tie West 25 feet of the East 235 feet of the South
233'feet of the Southeast Quarter of the Southeast
Quarter of Section 29, Township 43'North, Range 12
East of the Third Principal Meridian, in Lake County,
Illinois
PARCEL 2
That art of the Southeast Quarter of Section 29,
Township 43 North, Range 12 East of the Third
Principal Meridian described as follows, to -wit:
Commencing 235 feet West of the Southeast corner
of said Section running thence North 233'feet;
thence West 50 feet; thence South 233 feet; thence
East 50 feet to the place of beginning, in Lake
County, Illinois;
and
WHEREAS, said property is subject to general taxes for
the year 1971 and subsequent years, public road and highway ease-
ments and existing leases, all of which shall expire by no later
than September 30, 1972; and
WHEREAS, Raymond J. Monterastelli and Loretta Marie
Monterastelli, his- wife, are the ownero of the said property and
have offered to sell it to the Village subject to the said unpaid
general taxes, road and highway easements and existing leases for
the sum of Eighty -Four Thousand ($84,000'.00) Dollars, all as set
forth in a certain Agreement entitled, "Real Estate Sale Contract,"
which has been submitted by the owners to the Village, a copy of
which Agreement is attached hereto and made a part hereof; and
WHEREAS, the Corporate Authorities deem it to be in the
best interest of the Village that such offer be'accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK
COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That the offer of Raymond J. Monterastelli
ONE: and Loretta Marie Monterastelli, his wife,
to sell the above- described property in accordance with the
terms of the Agreement entitled, "Real Estate Sale Contract,"
a copy of which is attached hereto, is accepted, and the pur-
chase of the said property by the Village of Deerfield for the
sum of Eighty -Four Thousand ($84,000.00) Dollars is approved.
SECTION That the President and Village Clerk are
TWO: hereby authorized to execute the said
"Real Estate Sale Contract" on behalf of the Village of Deerfield,
and to execute all other documents deemed necessary for the
completion of the purchase of the property in question and the
recording of same.
SECTION That the Village Treasurer is hereby authorized
THREE: and directed to issue a check from the
corporate funds of this Village, payable to said owners, as earnest
money,in accordance with the terms of the "Real Estate'Sale Contract,"
in the amount of One Thousand ($1,000.00) Dollars, and, at the
direction of the Village Attorney, to issue an additional check from
the corporate funds of the Village, payable to the owners, in the
amount of Eighty -Three Thousand ($83;000.00) Dollars, less pro -
rations, at the time that proper title documents are delivered to
the Village.
SECTION That the Village Attorney is hereby authorized
FOUR: and directed to take all steps necessary to
complete tie purchase of the aforesaid property, to record the
Deed and to file the proper tax exemption complaint and obtain an
exemption of such property from real estate taxes.
