AN ORDINANCE GRANTING A VARIATION FROM THE
PROVISIONS OF THE' ZONING ORDINANCE
WHEREAS, UNITED CONVEYOR CORPORATION has petitioned for a
certain variation from the strict provisions of the Zoning Ordinance
of the Village of Deerfield, passed May 4, 1953, as amended with
respect to certain real estate proposed to be annexed to the Village
of Deerfield and hereinafter described; and
WHEREAS, pursuant to notice duly published, as required
by statute, a public hearing on said petition was held and conducted
by the Zoning Board of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the
President and Board of Trustees its written findings of fact and
recommendations; and
WHEREAS, said real estate has been duly annexed to the
Village of Deerfield pursuant to a certain Annexation Agreement,
dated July 17, 1972.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE.OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendations of
ONE: the Zoning Board of Appeals are hereby concurred
in and adopted as the findings of fact of the President and Board of
Trustees.
SECTION That there are practical difficulties and particular
TWO: hardship in the way of carrying out the strict
letter of e provisions of the Zoning Ordinance of the Village of
Deerfield, as applied to Petitioner's property, which is legally des-
cribed as follows:
That part of the South East quarter of Section 31,
Township 43 North, Range 12 East of the 3rd P.M.,
described as follows: Commencing at a point 100
rods North of the South East corner of said Section;
thence North 30 rods; thence West 80 rods; thence
South 30 rods, thence East 80 rods, to the place of
beginning in Lake County, Illinois.

SECTION That a variation from the strict provisions of
THREE: Section XIV -A,3 of the Zoning Ordinance of the
Village of Deerfield, passed May 4, 1953, as amended with respect
to the property hereinabove described, is hereby granted so as to
permit an increase in the allowable building height for the proposed
office structure from 35 feet to 42 feet, exclusive of a penthouse
for the housing of mechanical equipment, provided that the height
of said penthouse shall not exceed 12 feet above the building
height,, all in accordance with plans presented and filed with
the Zoning Board,of Appeals.
SECTION That the variation hereby granted is subject to
FOUR: compliance by Petitioner with all other appli-
cable provisions of the Zoning Ordinance and all other applicable
ordinances of the Village.
SECTION That this Ordinance shall be in full force and
"FIVE: effect from and after its passage and approval,
as provided -Ty law.
