ORDINANCE NO. 0 -72- 46 AN ORDINANCE REPEALING ARTICLE X ENTITLED "REAL ESTATE BROKERS" OF CHAPTER 17 OF THE MUNICIPAL CODE OF DEERFIELD WHEREAS, on May 6, 1968 the President and Board of Trustees of the Village of Deerfield did adopt Ordinance No. 0 -68 -20 entitled "An Ordinance Amending Chapter 17 and Chapter 27 of the Municipal Code of Deerfield ", by which Ordinance a new Article X entitled "Real Estate Brokers" was added to Chapter 17 of the said Municipal Code of Deerfield of 1963, as amended, for the purpose of regulating real estate brokers operating in and within the Village of Deerfield, requiring that said brokers be licensed, and establishing certain standards of conduct to be adhered to by real estate brokers acting with respect to real estate located within the Village of Deerfield, and to further establish a Real Estate Review Board within said Village to hear complaints filed against real estate brokers and to recommend appropriate action to the President and Board of Trustees; and WHEREAS, on April 28, 1972 there was adopted by the 77th Illinois General.,Assembly Public Law 77 -1818 entitled "An Act 'Providing for the Exclusive Exercise by the State of the Power to Regulate Certain. Professions, Vocations and Occupations" by which legislation-- the State of Illinois did retain unto itself the exclusive exercise of the power to regulate real estate brokers and real estate salesmen in accordance with a certain act entitled "An Act in Relation to the Definition, Registration and Regulation of Real Estate Brokers and Real Estate Salesmen ", approved June 29, 1921, as amended; and WHEREAS, the effect of the adoption of said Public Law 77 -1818 by the State of Illinois is to deprive the Village of Deerfield of the exercise of any authority.with respect to the licensing and the regulation of such real estate brokers and salesmen; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article X entitled "Real Estate Brokers" ONE: of Chapter 17 of the Municipal Code of Deerfield of 1963, as amended, is hereby repealed in its entirety. SECTION That Section 27.1205 of Article XII of Chapter TWO: 27 of the Municipal Code of Deerfield of 1963, as amended, is hereby amended to read as follows: N' 27.1205 Real Estate Review Board - Powers and Duties.) There is hereby created a Real Estate Review Board consisting of five (5) members. Said Review Board shall be composed of a member of the Village Board of Trustees of the Village of Deerfield, a real estate broker who shall have been licensed by the State of Illinois for a period of at least five (5) years prior to his appointment, a member of the Deerfield Human Relations Commission, and two adult residents of the Village, who are neither members of the Village Board of Trustees, members of the Deerfield Human Relations Commission, nor real estate brokers. All members of the Review Board shall be appointed by the President with the consent of the/ Board of Trustees. The member of the Village Board of Trustees, the real estate broker, and the member of the Deerfield Human Relations Commission herein designated shall serve for a term of one (1) year; the other members of the Review Board shall each serve for a term of four (4) years. The members of the Review Board shall select one of its members to act as Chairman and another to act as Secretary. The Real Estate Review Board shall have the following powers and duties: (a) To receive and investigate complaints alleging unlawful real estate practices as defined in this Article XII. (b) To seek conciliation of, hold hearings on, and render findings of fact and recommendations regarding complaints received.," SECTION That the Village Clerk is hereby directed to THREE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall take effect from and FOUR: after its passage, approval and publication in the manner provided by law.
