AN ORDINANCE AMENDING A SPECIAL USE
(DEERBROOK 'II - THEATER SIGN)
WHEREAS, the Plan Commission of the Village of Deerfield
has heretofore held a public hearing on the application of
JOSEPH E. VALENTI and NORTHWEST NATIONAL BANK OF CHICAGO, as Trustee
under Trust No. 481 , to amend an existing special use approved for
certain premises commonly known as the Deerbrook Shopping Center
and hereinafter described, so as to authorize an increase in the
area of one free - standing sign to be located on the Waukegan Road
frontage of said premises from 120 square feet to 240 square feet,
under and pursuant to the provisions of Sections XIII,D,3,S; XIII,D,4;
XIII,D,5; XXIII,B,2 and XXIII,B,3 of the Zoning Ordinance of the
Village of Deerfield; and
WHEREAS, said hearing was held pursuant to duly published
notice thereof and was in all respects held according to law; and
WHEREAS, the Plan Commission of the Village of Deerfield,
after considering the evidence adduced, made written findings of
fact and recommended that said amendment to the special use approved
for said real estate be denied; and
WHEREAS, the President and Board of Trustees do not concur
in the findings and recommendation of the Plan Commission but rather
expressly find that granting the requested amendment to the heretofore
approved special use on said premises would comply with the provisions
of Sections XIII,D,5 and XXIII,B,3 and would otherwise serve the best
interests of the Village subject to the conditions hereinafter set
forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the amendment of the approved special use
ONE: of the real estate legally described as follows:
That part of the North 1/2 of Section 4, Township
42 North, Range 12, East of the Third Principal
Meridian described as: Commencing at the South-
west corner of Downey's Cook County Country Home
Addition to Deerfield, being a subdivision of
part of the North 1/2 of said Section 4 and running
thence South 250 13' 30" East along the Easterly
right -of -way line of the Chicago, Milwaukee,
St. Paul and Pacific Railroad 365.03 feet to its
point of intersection with the Northerly right -
of -way line of the Northern Illinois Toll Highway;
thence South 590 08' 30" East along said Toll
Highway Northerly right -of -way line 1259.80 feet;
thence North 850 48' 35" East 855.62 feet to the
point of intersection with the Westerly line of
Waukegan Road (said Westerly line being 33 feet
Westerly of, measured perpendicularly and parallel
with the center line of said Road, as occupied);
thence North 27° 07' 05" West along said Westerly
line 1028.59 feet to its point of intersection with
the South line of said Downey's Subdivision extended
Easterly; thence South 890 56' 30" West along
said Easterly extension and said South line of said
Subdivision, 1621.44 feet to the place of beginning
in Cook County, Illinois.
so as to authorize an increase in the area of one free - standing sign
heretofore authorized to be located on the Waukegan.Road frontage
of said premises from 120 square feet to - 22�(A- square feet, subject
to the conditions hereinafter set forth, betand the same is hereby
authorized and approved.
SECTION That the approval and authorization of said
TWO: special use hereby given is subject to the
requirement that all use,construction and development shall be in
accordance with all plans and representations submitted and made
by Applicant to the Plan Commission and President and Board of Trustees
and is subject to compliance by Applicant with all other applicable
provisions of the zoning Ordinance and all other applicable ordinances
of the Village of Deerfield and is subject to the further condition
that all illumination of said sign shall be extinguished each evening
no later than 11:00 P.M. or 20 minutes after the commencement of the
last performance, whichever is earlier.
SECTION That the Village Clerk is hereby directed to
THREE: publish this Ordinance in pamphlet form and to
record a certified copy of this Ordinance in the office of the Recorder
of Deeds of the County in which the real estate hereinabove described
is situated.
SECTION That this Ordinance shall be in full force and
FOUR: effect from and after its passage, approval and
publication, as provided by law.
