ORDINANCE NO. 2022- 0-22-03
AN ORDINANCE AMENDING "THE MUNICIPAL CODE OF THE VILLAGE OF
DEERFIELD, ILLINOIS, 1975," AS AMENDED, TO ADOPT THE 2021 EDITION OF
THE INTERNATIONAL ENERGY CONSERVATION CODE
WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant
to the provisions of Article VII, Section 6 of the Illinois Constitution and the City has the
authority to adopt ordinances and to promulgate rules and regulations that pertain to its
government and affairs and that protect the public health, safety, and welfare of its citizens;
and
WHEREAS, pursuant to Section 6-2(c) of "The Municipal Code of the Village of
Deerfield, Illinois, 1975," as amended ("Village Code', the Village has adopted the Illinois
Energy Conservation Code, 71111. Admin. Code § 600.100 et seq.; and
WHEREAS, pursuant to Section 45 of the Illinois Energy Efficient Building Act, 20
ILCS 3125/45 ("Act'), a unit of local government, including a home rule unit, may adopt
energy efficient building standards for residential or commercial buildings that are more
stringent than the Illinois Energy Conservation Code only if the unit of local government
adopted standards that are equivalent to or more stringent than the 2006 International
Energy Conservation Code on or before May 15, 2009; and
WHEREAS, on April 20, 2009, the Village Board adopted the 2006 International
Energy Conservation Code pursuant to Ordinance No. 0-09-11; and
WHEREAS, to promote more energy efficient building practices, Village staff has
recommended that the Village adopt the 2021 Edition of the International Energy
Conservation Code; and
WHEREAS, pursuant to Section 1-3-2 of the Illinois Municipal Code, 65 ILCS 5/1-3-
2, at least one copy of the 2021 Edition of the International Conservation Code has been on
file in the office of the Village Clerk for more 30 days, and will remain on file for public use,
examination, and inspection; and
WHEREAS, pursuant to 65 ILCS 5/1-3-1 et seq. and the Village's home rule powers,
the Village Board has determined that it will serve and be in the best interests of the Village
and its residents to amend the Village Code to adopt the 2021 Edition of the International
Conservation Code;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF
DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows:
SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and
made a part of, this Ordinance as findings of the Village Board.

SECTION TWO: ADOPTION OF THE 2021 EDITION OF THE
INTERNATIONAL ENERGY CONSERVATION CODE. Section 6-2, titled "Adoption of
International Building Codes," of Article 1, titled "In General," of Chapter 6, titled "Building,"
of the Village Code is hereby amended to read as follows:
"Sec. 6-2. Adoption of International Building Codes:
The erection, repair or alteration of all structures not regulated or excepted by
other provisions of this Chapter shall be in compliance with the provisions of
the following codes, which are adopted by reference and incorporated as if fully
set forth herein, with the modifications provided herein:

SECTION THREE: EFFECTIVE DATE. This Ordinance shall be in full force and
effect on the later of (i) its passage, approval and publication in pamphlet form as required
by law; and (ii) March 1, 2022.
