ORDINANCE NO. 0 -72- 20 AN ORDINANCE AUTHORIZING A SPECIAL USE (MULDER NURSING HOME) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of PAUL MULDER to authorize the use and occupancy of certain real estate commonly known as 250 Waukegan Road, Deerfield, Illinois, and hereinafter described, for a nursing home as a special use under and pursuant to the provisions of Sections XIII,D,3,n, XIII,D,4, XIII,D,5 and XXIII of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence adduced, made written findings of fact including express affirmative findings of compliance with the provisions of Sections XIII,D,5 and XXIII,B,3 of the Village Zoning Ordinance and recommended that said special use of said real estate be approved and authorized subject to certain conditions and restrictions hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings and recommendation of the Plan ONE: Commission are concurred in and adopted as the findings o -the President and Board of Trustees and the special use of Lot 1 in the Golf View Subdivision (being a resubdivision of the real estate described on Exhibit A hereto, in Section 33, Township 43 North, Range 12 East of the Third Principal Meridian in Lake County, Illinois, as and for a nursing home subject to the conditions and restrictions hereinafter set forth, be and the same is hereby authorized and approved. SECTION That the approval and authorization of said TWO: special use hereby given is subject to compliance by Petitioner with all other applicable provisions of the Zoning Ordinance and all other applicable ordinances of the Village of Deerfield and is subject to the following further conditions: A) That the building housing the proposed nursing home shall not have a ground floor area in excess of 58,000 square feet nor have in excess of 150 patient beds and that the building and premises shall, in all respects, conform with plans and specifications identified as Shayman & Salk Plans, dated 2/22/72, Job #7118, submitted to the Plan Commission of the Village of Deerfield and to other representations made by the Petitioner to the Plan Commission. B) That the proposed nursing home shall be licensed by the State of Illinois and may be operated and conducted only so long as it shall be so licensed. SECTION That all ordinances or parts of ordinances in THREE: conflict herewith 'are, to the extent of such conflict, hereby repealed. SECTION That the Village Clerk is hereby directed to FOUR: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage, approval and publication, as provided by law. AYES: FOUR (4) NAYS: NONE (0) ABSENT`: TWO, ((2�.
