O-72-18i " ORDINANCE NO. 0 -72- 18 AN ORDINANCE APPROVING A PLANNED DEVELOPMENT (HOVLAND LOT 141) Published in pamphlet form this loth day of April , A.D. 1972, by the President and Board:-of Trustees of Deerfield. ,J ORDINANCE NO. 0 -72- 18 AN ORDINANCE APPROVING A PLANNED DEVELOPMENT (HOVLAND LOT 141) WHEREAS, the Plan Commission of the Village of Deerfield has heretofore held a public hearing on the application of CHESTERFIELD DEVELOPMENT CORP. for the approval of a single - family residential planned development of certain real estate here- inafter described located in the Hovland Subdivision and classified in the R -1 -B District of the Zoning Ordinance of the Village of Deerfield; and WHEREAS,. the said hearing was published notice thereof and was in all to law; and WHEREAS, the Plan Commission after considering the evidence adduced, planned development be approved subject restrictions. held pursuant to duly respects held according of the Village of Deerfield, .recommended that said to certain conditions and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the proposed single - family planned residential ONE: development of the real estate legally described as follows: Resubdivision of Lot 141 in J. S. Hovland's First Addition to Deerfield in the Southwest 1/4 of Section 32, Township 43 North, Range 12 East of the Third Principal Meridian in Lake County, Illinois and as set forth and described on the attached plan of development and preliminary plat of resubdivision, which plan and plat of resubdivision are made a part of this Ordinance, be and it is hereby approved subject to the conditions and restrictions hereinafter set forth. SECTION That the approval of said planned development TWO: is conditioned upon the following: A. That the developer, CHESTERFIELD DEVELOPMENT CORP., dedicate the east 30 feet of Lot 141 to the Village of Deerfield as and for street purposes and that prior to the issuance of a .J • building permit for any portion of said Lot 141, as the same may be redivided, Chesterfield Development Corp. shall deposit sufficient funds in escrow with the Village or make other pro- vision satisfactory to the Village to insure the payment of his proportionate share of the installation of full street improve- ments, including pavement, curb, gutter, storm sewer, street signs and street lighting, in accordance with the applicable provisions of the Village Code for the proposed street to be constructed on said easterly 30 feet of said Lot 141. B. That the developer, Chesterfield Development Corp., construct and install and improve Gordon Terrace from Wilmot Road easterly to the East line of said Lot 141 in the following manner: 1. Complete storm sewer improvements, including all necessary appurtenances and connections. 2. Street pavement (full width of street), including curb and gutter, street signs and street lighting. 3. Complete sanitary sewer improvements, including all necessary appurtenances and connections. 4. Such other subdivision improvements as may be required to serve the lots proposed to front or abut on Gordon Terrace, in accordance with the applicable provisions.of the Municipal Code of the Village of Deerfield, including, without limita- tion, water mains and services. all of which improvements shall be constructed and installed in accordance with the applicable provisions of the Municipal Code of the Village of Deerfield. SECTION That the approval of the planned development THREE: hereby given is subject to the further condition that the developer, Chesterfield Development Corp. submit for approval a final plat of resubdivision of the real estate described in Section One hereof and except as otherwise provided in this Ordinance comply with all requirements of the Village Code of the Village of Deerfield necessary for the approval of said final plat. SECTION That all ordinances or parts of ordinances in FOUR: conflict herewith are, to the extent of such conflict, hereby repealed. SECTION That the Village Clerk is hereby directed to FIVE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and SIX: effect from and after its pasage, approval and publication, as provided by law.
