VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -1r -2Q AN ORDINANCE AUTHORIZING A SPECIAL USE TO PERMIT A WIRELESS TELECOMMUNICATIONS FACILITY TO BE LOCATED ON THE KATES ROAD WATER TOWER WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on October 8, 2015 to consider the application of Chicago SMSA Limited Partnership, doing business as Verizon Wireless (hereinafter referred to as "Verizon" or the "Applicant') for approval of a special use authorizing and permitting the establishment, maintenance and use of a wireless telecommunications facility on certain property commonly known as the Kates water tower at 700 Kates Road and legally described on Exhibit A attached hereto (the "Subject Property") pursuant to Article 2.08 -M and Article 13.11 of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, said public hearing was held pursuant to public notice duly given and published as required by law and conforming in all respects, in both manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony, documentary evidence and supporting materials offered at said public hearing, filed its report with the Board of Trustees containing its written fmdings of fact and recommendation that a Verizon wireless telecommunications facility with six (6) antennas at the 80 -foot level, ancillary equipment and a ground equipment shelter, should be authorized as a Lesser Impact Facility LIF ") Special Use of the Subject Property in the P -1 Public Lands District pursuant to Article 13.11 and Article 2.08 -M of the Zoning Ordinance of the Village of Deerfield; and 1- WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the proposed Special Use for the Subject Property fully complies with the requirements and standards set forth in Article 2.08 -M and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village will be served by the authorization and granting of said Special Use as provided herein, subject to and in accordance with the plans and supporting materials submitted by the Applicant which are incorporated herein and made a part hereof by this reference; and WHEREAS, the Village of Deerfield, as the owner of the Subject Property, has consented to the application of Verizon, subject to compliance with the terms and provisions of this Ordinance and the approval and continued effectiveness of a Lease Agreement by and between the Applicant and the Village of Deerfield; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are incorporated and made a part hereof as if fully set forth herein. SECTION 2: That the President and Board of Trustees do hereby affirmatively find the proposed Special Use authorizing and permitting the establishment, maintenance and use of a Verizon wireless telecommunications facility at the 80 -foot level of the Kates water tower, together with necessary and appropriate ancillary equipment and a ground equipment shelter therefor, as recommended by the Plan Commission, fully complies with the applicable special use requirements and standards for a Lesser Impact Facility in the P -I Public Lands District as set forth in Article 2.08 -M and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. 2- SECTION 3: That the President and Board of Trustees do hereby authorize and approve a Special Use for the Subject Property in the P -1 Public Lands District to authorize and permit the establishment, maintenance, operation and use of a wireless telecommunications facility by Verizon consisting of the mounting of reception and transmission antennas at the 80 -foot level of the Kates water tower, the installation and maintenance of necessary and appropriate ancillary equipment, cabling, fixtures and fasteners, and the installation of a ground equipment shelter, all as more fully described on Exhibit B attached hereto, and subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance. SECTION 4: That the approval and authorization of said Special Use is granted subject to the following conditions, regulations and restrictions: (i) the establishment, development, maintenance and use of said Special Use wireless telecommunications facility on the Subject Property shall be in accordance with the plans and supporting materials attached to and made a part of this Ordinance as Exhibit B hereof, and with all representations made and submitted by the Applicant to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield; (ii) compliance with all FCC and FAA rules regarding construction requirements, technical standards, interference protection, power and height limitations and radio frequency RF) standards; (iii) compliance with the terms and conditions of the Water Tower Lease Agreement by and between the Village of Deerfield and Chicago SMSA Limited Partnership; (iv) compliance with all applicable requirements of Article 2.08 of the Zoning Ordinance of the Village of Deerfield, as now or hereafter amended; (v) the further restriction that Applicant may not assign or transfer this Special Use permit or any rights thereunder without the approval of the Board of Trustees of the Village of Deerfield; and (vi) compliance with the Zoning Ordinance and Municipal Code of the Village of Deerfield. 3- SECTION 5: That the Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and, if approved by the corporate authorities, to Applicant's successors, grantees, transferees and assigns, and any violation of this Ordinance or the conditions, regulations and restrictions set forth herein by the Applicant or its authorized successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby authorized. SECTION 6: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION 7: That this Ordinance, and each of its terns, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. Verizon Wireless Proposed Wireless Antenna Facility On Existing Village of Deerfield Water Tank Project Summary Petitioner Verizon Wireless is the nation’s largest wireless communication provider, with a Nation-wide wireless network. Collocation Collocation is the placement of cellular communication antennas on pre-existing structures such as existing towers, water tanks, or other buildings. Collocation allows carriers to maximize network coverage while minimizing the proliferation of new support structures and their impacts on local communities. Collocation is the preferred method of municipalities to accommodate the physical needs of wireless carriers while ensuring minimal impact on neighborhood character. Verizon also prioritizes the use of existing structures for its communication facilities in order to minimize visual impact on neighborhoods as well as demands on local infrastructure. Property Description The existing Village of Deerfield water tank is located near the intersection of Kates and Kelburn Roads. The tank is located on municipally owned property directly east of the railroad tracks. The water tank has had an existing communication facility for the last nine years, including nine (9) mounted antennas. Verizon is in the process of entering into a lease agreement with the Village to install additional antennas, and proposes to install antennas at a height of 80’ on the legs of the tank. The proposed facility would be accessed by the existing driveway on Kates Road. Nature of Request/Zoning Impact Verizon Wireless is requesting a Special Use Permit, Setback Variance, and any other permits necessary to allow the installation of its proposed wireless communication facility. Section 2.08-k of the Village of Deerfield’s zoning ordinance governs wireless telecommunication facilities, and provides in relevant part that: 1.Disguised support structures (DSS) shall be permitted as a Special Use in all districts on property which is not used residentially, … 2.The minimum setback for a DSS from the property shall be that required for principal structures in the applicable zoning district, plus three (3) feet for every one (1) foot in height of the DSS unless otherwise authorized. 3.The maximum height of a DSS may not exceed the following: a.On those properties which are zoned P-1, Public Lands District or are residentially zoned but are not residentially used, the maximum height may not exceed sixty (60) feet as measured from the base of the structure unless the facility is to be a co-use facility and/or it is satisfactorily demonstrated that it is technologically unfeasible for the system to operate within the permitted height. Considering the above code section, Verizon’s proposed wireless communication facility requires a special use permit and a setback variance. Verizon’s radio frequency engineer has provided a detailed statement of support, which explains why the installation of Verizon’s antennas at a height of 60’ would not be technologically feasible since the requested height of 80’ is necessary to achieve satisfactory network coverage. It should also be noted that per Section 2.08-D of the zoning code, “Public sites are preferred as telecommunication service facility sites.” Finally, in keeping with the spirit of the Village’s zoning code, Verizon has chosen a site where antennas are currently installed and operational, to minimize any disturbance to the local character of the community. Components and Operations The proposed facilities will be unmanned, and once in service, will only require sporadic maintenance (typically monthly) by a service technician. The facility will be accessible by way of the existing driveway and will not require any additional road construction. These characteristics ensure that the proposed facilities will have no material impact upon local traffic, parking, or storm water control. The proposed facility will be also be monitored remotely for equipment failure, security intrusions, or fires. The Proposed facility will also operate silently, with the exception of noise generated by sporadic maintenance activities. As a result, the site will not generate a material level of noise, glare, smoke, debris, traffic or any other type of nuisance. The proposed facility has been designed and will be constructed to the highest application governmental and industry safety standards. Verizon will comply with all FAA, FCC, and any other applicable federal or local laws, rules or regulations. Please see attached statement of Radio Frequency compliance from a registered RF engineer. Requested Action Verizon Wireless respectfully requests that this body recommend issuance of a Special use Permit, Setback Variance, and any other relief necessary to accommodate the installation of a wireless communication facility on the existing Village-owned water tank, located at the intersection of Kates and Kelburn Roads. Verizon Wireless Security Procedures The Verizon Wireless security for their ground shelter consists of a 6’ chain link fence with 3 strands of barbed wire at the top enclosing the lease area. The fence gate will have a lock on it and we can add a knock box so emergency services can access the ground shelter in case of an emergency. The shelter itself will also have a lock on the door and will be monitored electronically via an alarm system for unauthorized access. Verizon has spoken with the Deerfield Police Department and is aware that we will need to notify the Police Department when we will be accessing the facility due to it being a municipal water supply site. Additional Modeling Assumptions: General Model Assumptions In this site compliance report, it is assumed that all antennas are operating at full power at all times. Software modeling was performed for all transmitting antennas located on the site. Sitesafe has further assumed a 100% duty cycle and maximum radiated power. The site has been modeled with these assumptions to show the maximum RF energy density. Sitesafe believes this to be a worst-case analysis, based on best available data. Areas modeled to predict emissions greater than 100% of the applicable MPE level may not actually occur, but are shown as a worst-case prediction that could be realized real time. Sitesafe believes these areas to be safe for entry by occupationally trained personnel utilizing appropriate personal protective equipment (in most cases, a personal monitor). Thus, at any time, if power density measurements were made, we believe the real-time measurements would indicate levels below those depicted in the RF emission diagram(s) in this report. By modeling in this way, Sitesafe has conservatively shown exclusion areas –areas that should not be entered without the use of a personal monitor, carriers reducing power, or performing real-time measurements to indicate real-time exposure levels. Use of Generic Antennas For the purposes of this report, the use of “Generic” as an antenna model, or “Unknown” for an operator means the information about a carrier, their FCC license and/or antenna information was not provided and could not be obtained while on site. In the event of unknown information, Sitesafe will use our industry specific knowledge of equipment, antenna models, and transmit power to model the site. If more specific information can be obtained for the unknown measurement criteria, Sitesafe recommends remodeling of the site utilizing the more complete and accurate data. Information about similar facilities is used when the service is identified and associated with a particular antenna. If no information is available regarding the transmitting service associated with an unidentified antenna, using the antenna manufacturer’s published data regarding the antenna’s physical characteristics makes more conservative assumptions. Where the frequency is unknown, Sitesafe uses the closest frequency in the antenna’s range that corresponds to the highest Maximum Permissible Exposure (MPE), resulting in a conservative analysis. The FCC developed those standards, known as Maximum Permissible Exposure (MPE) limits, in consultation with numerous other federal agencies, including the Environmental Protection Agency, the Food and Drug Administration, and the Occupational Safety and Health Administration. The standards were developed by expert scientists and engineers after extensive reviews of the scientific literature related to RF biological effects. The FCC explains that its standards “incorporate prudent margins of safety.” The following represents explanations of the most applicable information: Two Classifications for Exposure Limits Occupational –Applies to situations in which persons are “exposed as a consequence of their employment” and are “fully aware of the potential for exposure and can exercise control over their exposure”.
