O-72-14r r ORDINANCE NO. 0 -72- 14 AN ORDINANCE GRANTING VARIATIONS FROM THE PROVISIONS'OF THE ZONING ORDINANCE WI,'H RESPECT TO THE-PROPERTY.-LOCATED AT 650 WAUKEGAN ROAD,'DEERFIELD,''ILLINOI'S WHEREAS, TEXACO, INC. has petitioned for variations from the strict provisions of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended; and WHEREAS, pursuant to notice duly published gas required by statute and ordinance, a public hearing on said Petition was held and conducted by the Zoning Board of Appeals.of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings ONE: the Zoning Board in and adopted as the findings of Trustees. of fact and recommendations of of Appeals are hereby concurred fact of the President and Board of SECTION That there are practical difficulties acid particular TWO: hardship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property which is legally described as follows: Lot 1 in Block 1 in Hall & Osterman's Addition to the Town of Deerfield in the'Northwest 1/4 of Section 33, Township 43 North, Range 12 East of the Third Principal Meridian in Lake County, Illinois, said property commonly known as 650 Waukegan Road, Deerfield, Illinois. 'SECTION That variations from the strict provisions of 'THREE: Sections XIII,D -3 -c and XIII,G -3 of the Zoning Ordinance of the Village of Deerfield with respect to the property hereinabove described, are hereby granted so as to permit the recon- struction and relocation of an existing gasoline service station ►1 building and accessory structures on the'property hereinabove described having an area of 13;925 square feet in lieu of the required 40,000 square feet and situated at an intersection on cor- ners of which two (2) other gasoline service stations are in opera- tion, and, further, so as to permit a setback of 15 feet along the west lot line (residential district boundary) in lieu of the required 50 feet, all in accordance with the plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject to FOUR: compliance by Petitioner with all other applicable provisions of the Zoning Ordinance and all other applicable ordinances of the Village, and subject to the further condition that Petitioner erect a seven ('7). foot high screen fence along the length of the west property line and except as modified by the terms hereof, comply in all respects with the plans submitted and representations made to the Zoning Board of Appeals. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval as provideU--Sy law.
