O-72-13f_ V I L L A G E 0 F D E E R F I E L D ORDINANCE N06 0 - 72 -.13 AN ORDINANCE DECLARING REBATES ON SPECIAL ASSESSMENT WARRANT NUMBER 94 AND 97 PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 7th DAY OF -tarrh -; A P 1,972; Published in pamphlet form by authority of the President and Board of Trustees of the Village of Deerfield, Illinois the - 7th. day of March , A.D. 1972, ORDINANCE NO. 0 -72-1_3 AN ORDINANCE DECLARING.REBATES ON SPECIAL ASSESSMENT WARRANT NUMBERS 54 AND 97 WHEREAS, pursuant to statute, the Village of Deerfield did heretofore institute special assessment proceedings for local improvements known as Special Assessment Warrant Number 94 (Curb and Gutter along Wilmot Road) Special Assessment Warrant Number 97 (Sewer and Water Main along Rosewood Avenue), which improvements have been completed; and WHEREAS, the Village Treasurer has advised the President and Board of Trustees that after final settlement with the contractor for said improvements and after full payment of all vouchers, bonds and interest coupons-there remains a surplus of funds collected with Interest earned thereon; and WHEREAS, pursuant to statute in such case made and provided, the Village is authorized to utilize such surplus funds to reimburse the public benefit fund and to reimburse the Village for the cost and expense of declaring and making a rebate and to rebate the balance of said funds to the owner or owners of each lot, block, tract or parcel against which such special tax was assessed. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That with respect to Village of Deerfield Special ONE: Assessment Warrant No. 94 (Curb and Gutter along. Wilmot Road), there is hereby found to be a surplus in the amount of $2,484.00, all as is more fully set forth on Schedule "A" which is attached hereto and made a part hereof, and a rebate thereof is hereby declared, provided that the public benefit fund of the Village first be reimbursed in the amount heretofore paid from said fund in connection with said special assessment and that there be deducted an amount equal to 5% of the surplus so remaining to reimburse the Village for the cost of declaring and making this rebate, and that the balance of said surplus funds be rebated to the owners of each lot, block, tract or parcel originally assessed in the amount indicated opposite the description of each such lot, block, tract or parcel on Schedule "B" which Is attached hereto and made a part hereof. SECTION That with respect to Village of Deerfield Special TWO: Assessment Warrant No. 97 (Sewer and Water Main along Rosewood Avenue), there is hereby found to be a surplus in the amount of $4,273.78, as is more fully set forth on Schedule "C" which is attached hereto and made a part hereof, and a rebate thereof is hereby declared, provided that the public benefit fund of the Village first be reimbursed in the amount heretofore paid from said fund in connection with said special assessment and that there be deducted an amount equal to 5% of the surplus so remaining to reimburse the Village for the cost of declaring and making this rebate, and that the balance of said surplus funds be rebated to the owners of each lot, block, tract or parcel originally assessed in the amount indicated opposite the description of each such lot, block, tract or parcel on Schedule "D" which is attached hereto and made a part hereof. -two- SECTION That the Village Treasurer is hereby authorized and THREE: directedm in pursuance of the rebates hereby declared to reimburse the appropriate funds of the Village and to make the rebate payments to the owners of record of those lots, blocks, tracts or parcels as set forth on attached Schedules "B ", "D ", upon submission of appropriate evidence of ownership by those persons claiming such rebate payments. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage, approval and publication, as provided by law.
