VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-13-19 AN ORDINANCE AUTHORIZING AGREEMENTS WITH DEERFIELD SCHOOL DISTRICT NO.109 FOR THE REGULATION OF MOTOR VEHICLE TRAFFIC AND PARKING ON SCHOOL PROPERTY WHEREAS, the Board of Education of Deerfield School District No. 109 (the "District") has requested that the Village enter into agreements with the District to empower the Deerfield Police Department Village to regulate and enforce the parking of motor vehicles and motor vehicle traffic within the parking areas associated with Caruso Middle School, Kipling Elementary School, Shepard Middle School, South Park Elementary School, Walden Elementary School and Wilmot Elementary School (individually and collectively, the "Schools"); and WHEREAS, the Village and District have authority under the Illinois School Code (105 ILCS 5/10-22.42), the Illinois Municipal Code (6511,CS 5/1-1-7) and the Illinois Vehicle Code (625 ILCS 5/11-209) to contract as provided herein for the regulation of motor vehicle traffic and parking in parking areas on property of the Schools; and WHEREAS, the Deerfield Police Department has negotiated agreements for the regulation .and motor vehicle traffic and parking at the Schools, including specific motor vehicle parking and traffic regulations to'be established at each of the Schools (the "Agreements") effective July 1, 2013; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the public health, safety and welfare of the Village of Deerfield will be served by entering into said Agreements with the District for the regulation and enforcement of motor vehicle traffic and parking at Caruso Middle School, Kipling Elementary School, Shepard Middle School, South Park Elementary School, Walden Elementary School and Wilmot Elementary School; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are hereby incorporated and made a part of this Ordinance as if fully set forth herein. SECTION 2: That the Board of Trustees of the Village of Deerfield does hereby authorize and approve Agreements with the Board of Education of Deerfield School District No. 109 for the regulation of motor vehicle traffic and parking at Caruso Middle School, Kipling Elementary School, Shepard Middle School, South Park Elementary School, Walden Elementary School and Wilmot Elementary School, and authorize and directthe Village President and Village Clerk to respectively execute and attest said Agreements for and on behalf of the Village of Deerfield. SECTION 3: That the Village Clerk is authorized and directed to cause a copy of each duly executed Agreement to be recorded in the office of the Lake County Recorder of Deeds. -SECTION 4: That this Ordinance, and each of its terms, shall be the effective legislative act of.a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non -preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance -2- should be inconsistent with any non -preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. That the Village is hereby authorized and directed to establish and enforce motor vehicle parking and traffic control regulations within the parking areas associated with the School, including A. The prohibition, regulation, restriction or limitation of the stopping, standing or parking of vehicles in specified portions of the school parking areas. B. The designation of fire lanes in the school parking areas (meaning travel lanes for firefighting equipment upon which there shall be no standing or parking of any motor vehicles at any time so that firefighting equipment can move freely thereon). C. The enforcement of persons with disabilities parking areas where appropriate above -ground signs have been posted in compliance with state law. D. The enforcement of stop signs and other traffic control signs that may be located in the school parking areas. E. The establishment and regulation of loading zones with the consent of the School District. F. The prohibition or regulation of the turning of vehicles or specified types of vehicles at intersections or other designated locations in the parking areas. G. The designation of any separate roadway in the parking areas for one-way traffic only with the consent of the School District. H. The regulation of a crossing of any roadway in the school parking areas by pedestrians. I. The erection of stop signs, flashing signals, yield signs and persons with disabilities parking area signs at specified locations in the school parking areas with the consent of the School District. J. The designation of any intersection in the school parking areas as a stop intersection or as a yield intersection. K. The designation of no mobile telephone use areas by motor vehicle operators. Section 3: Traffic and Parking Enforcement. The Village hereby agrees to regulate the motor vehicle parking and traffic in the school parking areas of the School as depicted on Exhibit B attached hereto, and to enforce any regulations established for such pursuant to this Agreement. Except as otherwise expressly provided herein, the Village will bear all costs of enforcement of the regulations contained in this Agreement and the prosecution of any violators, and shall retain any and all revenues obtained as a result of the Village's enforcement of the Village's regulations and ordinances within the school parking areas of the School. Section 4: Posting of Signs and Installation of Signals. The Village shall have the right to post or install appropriate parking and traffic control signs as specifically preapproved in writing by the School District, and School District shall pay the cost of such signs and signals and the cost of installation and maintenance of such signs and signals. Section 5: Term. This Agreement shall be effective as of July 1, 2013, and following the execution by the parties and the recording of this Agreement with the Lake County Recorder of Deeds, and shall remain in full force and effect for a term of twenty (20) years expiring July 1, 2033, unless cancelled prior thereto by mutual agreement of the parties hereto or by written notice of one party to the other giving sixty (60) days' notice of said cancellation to the other party. In accordance with 625 ILCS 5/11-209(c), no traffic or parking regulation shall be effective or enforceable until three (3) days after this Agreement is duly recorded at the office of the Lake County Recorder of Deeds. Section 6: Notices. RECITALS WHEREAS, School District is the owner- of a school commonly known as Shepard Middle School ("School"), including the parking areas associated therewith, which is located within the limits of the Village of Deerfield and is legally described on Exhibit A attached hereto; and, WHEREAS, School District represents and warrants that it has the legal right, title and authority to control, operate, manage and maintain the School and the parking areas associated therewith and to enter into this agreement; and, WHEREAS, School District desires to enter into an agreement with the Village in order to empower the Village to regulate the parking of motor vehicles and motor vehicle traffic within the parking areas associated with the School, and to enforce motor vehicle parking and traffic regulations with the parking areas associated with the School pursuant to the provisions of Section 11-209 of the Illinois Motor Vehicle Code (625 ILCS 5/11-209) and of the Municipal Code of the Village of Deerfield; NOW, THEREFORE, in consideration of' the mutual covenants, promises, terms and conditions contained herein, the parties hereto agree as follows: Section 1: Incorporation of Recitals.The above and foregoing recitals, being material to this Agreement, are hereby incorporated and made a part hereto by this reference. Section Z: Traffic Regulations. That the Village is hereby authorized and directed to establish and enforce motor vehicle parking and traffic control regulations within the parking areas associated with the School, including A. The prohibition, regulation, restriction or limitation of the stopping, standing or parking of vehicles in specified portions of the school parking areas. B. The designation of fire lanes in the school parking areas (meaning travel lanes for firefighting equipment upon which there shall be no standing or parking of any motor vehicles at any time so that firefighting equipment can move freely thereon). C. The enforcement of persons with disabilities parking areas where appropriate above -ground signs have been posted in compliance with state law. D. The enforcement of stop signs and other traffic control signs that may be located in the school parking areas. E. The establishment and regulation of loading zones with the consent of the School District. F. The prohibition or regulation of the turning of vehicles or specified types of vehicles at intersections or other designated locations in the parking areas. G. The designation of any separate roadway in the parking areas for one-way traffic only with the consent of the School District. H. The regulation of a crossing of any roadway in the school parking areas by pedestrians. I. The erection of stop signs, flashing signals, yield signs and persons with disabilities parking area signs at specified locations in the school parking areas with the consent of the School District. .1. The designation of' any intersection in the school parking areas as a stop intersection or as a yield intersection. K. The designation of no mobile telephone use areas by motor vehicle operators. Section 3: Traffic and Parking Enforcement. The Village hereby agrees to regulate the motor vehicle parking and traffic in the school parking areas of the School as depicted on Exhibit B attached hereto, and to enforce any regulations established for such pursuant to this Agreement.Except as otherwise expressly provided herein, the Village will bear all costs of' enforcement of the regulations contained in this Agreement and the prosecution of any violators, and shall retain any and all revenues obtained as a result of the Village's enforcement of the Village's regulations and ordinances within the school parking areas of the School. Section 4: Posting of Signs and Installation of Signals. The Village shall have the right to post or install appropriate parking and traffic control signs as specifically preapproved in writing by the School District, and School District shall pay the cost of such signs and signals and the cost of installation and maintenance of such signs and signals. Section 5: Term. This Agreement shall be effective as of July 1, 2013, and following the execution by the parties and the recording of this Agreement with the Lake County Recorder of Deeds, and shall remain in full force and effect for a term of twenty (20) years expiring July 1, 2033, unless cancelled prior thereto by mutual agreement of the parties hereto or by written notice of one party to the other giving sixty (60) days' notice of said cancellation to the other party. In accordance with 625 ILCS 5/11-209(c), no traffic or parking regulation shall be effective or enforceable until three (3) days after this Agreement is duly recorded at the office of' the Lake County Recorder of Deeds. Section 6: Notices. That the Village is hereby authorized and directed to establish and enforce motor vehicle parking and traffic control regulations within the parking areas associated with the School, including : A. The prohibition, regulation, restriction or limitation of the stopping, standing or parking of vehicles in specified portions of the school parking areas. B. The designation of fire lanes in the school parking areas (meaning travel lanes for firefighting equipment upon which there shall be no standing or parking of any motor vehicles at any time so that firefighting equipment can move freely thereon). C. The enforcement of persons with disabilities parking areas where appropriate above -ground signs have been posted in compliance with state law. D. The enforcement of stop signs and other traffic control signs that may be located in the school parking areas. E. The establishment and regulation of loading zones with the consent of the School District. F. The prohibition or regulation of the turning of vehicles or specified types of vehicles at intersections or other designated locations in the parking areas. G. The designation of any separate roadway in the parking areas for one-way traffic only with the consent of the School District. H. The regulation of a crossing of any roadway in the school parking areas by pedestrians. I. The erection of stop signs, flashing signals, yield signs and persons with disabilities parking area signs at specified locations in the school parking areas with the consent of the School District. J. The designation of any intersection in the school parking areas as a stop intersection or as a yield intersection. K. The designation of no mobile telephone use areas by motor vehicle operators. Section 3: Traffic and Parking Enforcement. The Village hereby agrees to regulate the motor vehicle parking and traffic in the school parking areas of the School as depicted on Exhibit B attached hereto, and to enforce any regulations established foc• such pursuant to this Agreement. Except as otherwise expressly provided herein, the Village will bear all costs of enforcement of the regulations contained in this Agreement and the prosecution of any violators, -2- and shall retain any and all revenues obtained as a result of the Village's enforcement of the Village's regulations and ordinances within the school parking areas of the School. Section 4: Posting of Signs and Installation of Signals. The Village shall have the right to post or install appropriate parking and traffic control signs as specifically preapproved in writing by the School District, and School District shall pay the cost of such signs and signals and the cost of installation and maintenance of such signs and signals. Section 5: Term. This Agreement shall be effective as of July 1, 2013, and following the execution by the parties and the recording of this Agreement with the Lake County Recorder of Deeds, and shall remain in full force and effect for a term of twenty (20) years expiring July 1, 2033, unless cancelled prior thereto by mutual agreement of the parties hereto or by written notice of one party to the other giving sixty (60) days' notice of said cancellation to the other party. In accordance with 625 ILCS 5/11-209(c), no traffic or parking regulation shall be effective or enforceable until three (3) days after this Agreement is duly recorded at the office of the Lake County Recorder of Deeds. Section 6: Notices.
