O-21-17VILLAGE OF DEERFIELD ORDINANCE NO. 2021- 0-21-171 AN ORDINANCE APPROVING AMENDMENTS TO A MULTIPLE USE UNIFIED DEVELOPMENT AND DEVELOPMENT PLANS, A SPECIAL USE FOR A FOR A DRIVE-THRU PHARMACY, AND EXCEPTIONS TO ZONING REGULATIONS AND SIGN CRITERIA (75 S. and 95 S. Waukegan Road) WHEREAS, Chick-Fil-A, Inc. ("Owner's is the record owner of that certain parcel of real property located in the C-2 Outlying Commercial District of the Village ("C-2 District"), commonly known as 99 S. Waukegan Road, Deerfield, Cook County, Illinois ("Property's and legally described in Exhibit A attached to and, by this reference, made a part of this Ordinance; and WHEREAS, on March 19, 2018, the Village Board adopted Ordinance No. 0-18-05 ("MUUD Ordinance") approving a special use for the development and maintenance of the Property as a Multiple Use Unified Development ("Original Development") pursuant to Section 2.00-C(3) of "The Deerfield Zoning Ordinance 1978," as amended ("Zoning Ordinance'), which Original Development including a 5,000 square foot Chick-Fil-A restaurant with a drive-thru at 95 S. Waukegan Road ("Restaurant") and an 8,000 square foot multi -tenant building ("Multi -Tenant Building") to be constructed and developed at 75 S. Waukegan Road pursuant to the plans set forth in Exhibit A of the MUUD Ordinance ("Development Plans"); and WHEREAS, the MUUD Ordinance authorized and approved, subject to certain conditions: (a) a special use to authorize and approve the Original Development to be constructed and operated as a Multiple Use Unified Development pursuant to the Development Plans; (b) a special use to allow the Restaurant to operate a drive-thru on the Property; (c) certain exceptions from the Zoning Ordinance, including to allow a Restaurant drive-thru without direct signalized access to an existing right-of-way and exceptions to requirements for parking, landscape screening, and signage locations and dimensions; (d) certain exceptions from the Signage Criteria and Design Guidelines for the Property approved by the Appearance Review Commission on February 26, 2018 (the "Sign Criteria"); and (e) text amendments to the Zoning Ordinance to establish multiple use unified developments as a form of special use planned unit development in the C-2 District; and WHEREAS, the Owner desires to modify the Original Development and the Development Plans to allow for the operation of a Walgreens pharmacy in the Multi -Tenant Building with a single lane drive-thru ("Pharmacy"), a reduction in the size of the Multi - Tenant Building from 8,000 to 6,000 square feet, and various landscape, parking, signage, and other site improvements (collectively, 'Proposed Development'); WHEREAS, in furtherance of the construction of the Proposed Development, the Owner filed an application with the Village seeking: (i) approval of amendments to the MUUD Ordinance to reduce the size of the Multi -Tenant Building from 8,000 square feet to 6,000 square Feet ("MUUD Amendment'); (ii) approval of amendments to the Development (00119224.2) Plans ("Amended Development Plans"); (iii) approval of a special use permit to operate the Pharmacy with a single drive-thru lane as depicted in the Amended Development Plans ("Pharmacy Drive-Thru SUP"); (iv) exceptions from the Zoning Ordinance and the Sign Criteria for the installation of wall signs on the north and west frontages of the Pharmacy at the height and in the locations depicted in the Amended Development Plans; ("Wall Sign Exceptions"); (v) an exception from the Sign Criteria to allow the monument sign in the Development to include red lettering in the panel identifying the Pharmacy, as depicted in the Amended Development Plans ("Sign Lettering Exception"); and (vi) an exception from the Zoning Ordinance and the Sign Criteria to allow for the illumination of the "Enter" and "Exit" signs on the Property, as depicted in the Amended Development Plans ("Sign Illumination Exceptions") (the MUUD Amendment, Amended Final Development Plans, Pharmacy Drive-Thru SUP, Wall Sign Exceptions, Sign Lettering Exception, and Sign Illumination Exceptions, are, collectively, the "Requested Relief); and WHEREAS, concurrently with the Requested Relief, the Owner has requested approval of an amended Final Plat of Subdivision for the Property to facilitate the Proposed Development and the Requested Relief by Resolution of the Village Board, which is presented concurrently with this Ordinance; and WHEREAS, pursuant to Section 2-158(a)(8)(2) of the "Municipal Code of the Village of Deerfield, Illinois, 1975," as amended ("Village Code', the Proposed Development in the C-2 District requires appearance review by the Appearance Review Commission of the Village ("ARC'S; and WHEREAS, on November 23, 2020 and December 22, 2020, the ARC reviewed the Owner's request for approval of the Amended Development Plans, Wall Sign Exceptions, a Sign Lettering Exception, and Sign Illumination Exceptions; and WHEREAS, on December 22, 2020, the ARC voted to recommend approval of the Amended Development Plans, Wall Sign Exceptions, Sign Lettering Exception, and Sign Illumination Exceptions; and WHEREAS, on January 14, 2021, the Plan Commission considered the Owner's application at its meeting and adopted findings recommending approval of the Requested Relief, and WHEREAS, the Village Board has determined that the Proposed Development and the Requested Relief comply with the required standards for special use permits and multiple use unified developments as set forth in Articles 5, 12 and 13 of the Zoning Ordinance; and WHEREAS, consistent with the Plan Commission recommendation, the Village Board has determined that it will serve and be in the best interests of the Village and its residents to approve the Proposed Development and Requested Relief for the Property, all in accordance with, and subject to, the conditions, restrictions, and provisions of this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE BOARD OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, as follows: {00119224.2) 2 SECTION ONE: RECITALS. The foregoing recitals are incorporated into, and made a part of, this Ordinance as the findings of the Village Board. SECTION TWO: APPROVAL OF AMENDMENT TO MULTIPLE UNIFIED USE DEVELOPMENT. Subject to, and contingent upon, the conditions, restrictions, and provisions set forth in Section Seven of this Ordinance, the Village Board hereby approves the MUUD Amendment for the Property, in accordance with, and pursuant to, Articles 2, 5, and 12 of the Zoning Ordinance and the home rule powers of the Village. SECTION THREE: APPROVAL OF AMENDED DEVELOPMENT PLANS. A. Approval of Amended Development Plans. Subject to, and contingent upon, the conditions, restrictions, and provisions set forth in Section Seven of this Ordinance, the Village Board hereby amends the Development Plans for the Deerfield Square PUD, to include the following documents (collectively, the "Amended Development Plan Documents': "Site Plan" prepared by HR Green, consisting of one sheet, with a latest revision date of August 25, 2020, a copy of which is attached to this Ordinance as Exhibit B; 2. "Preliminary Plan and Elevations" prepared by Detroit Architectural Group, consisting of one sheet, with a latest revision date of November 25, 2020, a copy of which is attached to this Ordinance as Exhibit C; "Building Section Dumpster Details" prepared by Detroit Architectural Group, consisting of one sheet, with a latest revision date of February 23, 2021, a copy of which is attached to this Ordinance as Exhibit D; 4. "Site Identification" prepared by Walgreens, consisting of nine sheets, a copy of which is attached to this Ordinance as Exhibit E; 5. "Tree Preservation Plan" prepared by HR Green, consisting of one sheet, with a latest revision date of August 25, 2020, a copy of which is attached to this Ordinance as Exhibit F; "Landscape Plan" prepared by HR Green, consisting of two sheets, with a latest revision date of August 25, 2020, a copy of which is attached to this Ordinance as Exhibit G; "Landscape Notes and Details" prepared by HR Green, consisting of two sheets, with a latest revision date of August 25, 2020, a copy of which is attached to this Ordinance as Exhibit H; S. "Diebold Drive-Thru Window Details" prepared by Walgreens, consisting of one sheet, with a latest revision date of October 14, 2019, a copy of which is attached to this Ordinance as Exhibit I; 9. "Deerfield Photometric Analysis", prepared by KSA, consisting of three {00119224.2) 3 sheets, with a latest revision date of December 4, 2017, a copy of which is attached to this Ordinance as Exhibit J; 10. Lighting Fixture Depictions, consisting of one sheet, undated, a copy of which is attached to this Ordinance as Exhibit K; 11. "1.2 Meter Series 1123 Ku -Band Receive/Transmit Antenna Geometry", prepared by Prodelin Corporation, undated, a copy of which is attached to this Ordinance as Exhibit L; 12. "Roof Plan", prepared by Walgreens, consisting of one sheet, with a latest revision date of September 1, 2020, a copy of which is attached to this Ordinance as Exhibit M; and 13. Satellite Dish Specifications, consisting of one sheet, undated, a copy of which is attached to this Ordinance as Exhibit N. B. Conflicts. In the event that any of the Amended Development Plan Documents conflict with the Development Plans, the Amended Development Plan Documents control. SECTION FOUR: APPROVAL OF THE PHARMACY DRIVE-THRU SPECIAL USE PERMIT. Subject to, and contingent upon, the conditions, restrictions, and provisions set forth in Section Seven of this Ordinance, a special use permit to allow the establishment of a single drive-thru lane serving the Pharmacy as depicted in the Amended Development Plans shall be, and is hereby, granted to the Owner pursuant to Section 5.02- C(1)(s) and Section 13.11 of the Zoning Ordinance and the home rule powers of the Village. SECTION FIVE: APPROVAL OF ZONING EXCEPTIONS WITHIN A PLANNED UNIT DEVELOPMENT. Subject to, and contingent upon, the conditions, restrictions, and provisions set forth in Section Seven of this Ordinance, the Owner's requests for the following exceptions from the Zoning Ordinance in conjunction with its MUUD Amendment and the Proposed Development are hereby granted for, and with respect to, the Proposed Development, in accordance with and pursuant to Sections 2.00-C(3) and 12.01-B.1 of the Zoning Ordinance and the home rule powers of the Village: 1. Maximum Wall Sign Height. Exceptions from Section 9.02-B(2)(d)(1) of the Zoning Ordinance to permit the Multi -Tenant Building to have wall signs on the north and west frontages at a maximum height of approximately one foot above the roof deck. 2. Illumination of Signs. An exception from Section 9.02-B(8)(f)(2)(e) of the Zoning Ordinance to permit the illumination of the exit informational sign on the Property as depicted in the Amended Development Plans SECTION SIX: APPROVAL OF EXCEPTIONS TO SIGN CRITERIA. Subject to, and contingent upon, the conditions, restrictions, and provisions set forth in Section Seven of this Ordinance, the Village Board hereby approves the following exceptions from the Sign Criteria in accordance with, and pursuant to, Article 12 of the Zoning {00119224.2) 4 Ordinance and the home rule powers of the Village. The Sign Criteria Exceptions shall apply only to the signs depicted in the Amended Development Plans, and shall not amend the Sign Criteria as they may apply to any other signs on the Property pursuant to the MUUD Ordinance and the Zoning Ordinance: Wall Sign Exception. An exception from Section IV(C) of the Sign Criteria to authorize the wall signs on the north and west frontages of the Multi -Tenant Building to have a height of approximately one foot above the roof deck. 2. Sign Lettering xception. An exception from Section III(C)(1)(c) of the Sign Criteria to authorize the portion of the monument sign on the Property designating the Pharmacy to have red lettering. Sian Illumination Exception. An exception from Section V(A) of the Sign Criteria to authorize the Sign Illumination Exception. SECTION SEVEN: CONDITIONS. Notwithstanding any use or development right that may be applicable or available pursuant to the provisions of the Village Code or the Zoning Ordinance, or any other rights the Owner may have, the approvals granted in Sections Two, Three, Four, Five, and Six of this Ordinance are hereby expressly subject to and contingent upon the redevelopment, use, and maintenance of the Property in compliance with each and all of the following conditions: A. Compliance with Regulations. The redevelopment, use, operation, and maintenance of the Property must comply with all applicable Village codes and ordinances, as the same have been or may be amended from time to time, except to the extent specifically provided otherwise in this Ordinance. B. Compliance with Amended Development Plans. The redevelopment, use, operation, and maintenance of the Proposed Development on the Property must comply with the Amended Development Plans, as approved by this Ordinance, except: (a) for minor changes and site work approved by the Village Principal Planner and the Village Director of Public Works and Engineering (for matters within their respective permitting authorities) in accordance with all applicable Village standards; and (b) for changes approved in accordance with Section 12.09 of the Zoning Ordinance. SECTION EIGHT: RECORDATION, BINDING EFFECT. A copy of this Ordinance shall be recorded in the Office of the Cook County Recorder of Deeds against the Property. This Ordinance and the privileges, obligations, and provisions contained herein run with the Property and inure to the benefit of, and are binding upon, the Owner and its personal representatives, successors, and permitted assigns. SECTION NINE: FAILURE TO COMPLY WITH CONDITIONS. Upon the failure or refusal of the Owner to comply with any or all of the conditions, restrictions, or provisions of this Ordinance, in addition to all other remedies available to the Village, the approvals granted in Sections Two, Three, Four, Five, and Six of this Ordinance ("Approvals' may, at the sole discretion of the Village Board, by ordinance duly adopted, (00119224.2) 5 be revoked and become null and void; provided, however, that the Village Board may not so revoke the Approvals unless it first provides the Owner with two months advance written notice of the reasons for revocation and an opportunity to be heard at a regular meeting of the Village Board. In the event of such revocation, the Village Manager and Village Attorney are hereby authorized and directed to bring such zoning enforcement action as may be appropriate under the circumstances. Notwithstanding the foregoing or anything else contained in this Ordinance, neither the Owner's failure to comply with this Ordinance, nor anything else contained herein, shall affect or restrict the Owner's rights to use the Property as otherwise permitted by the Zoning Ordinance. SECTION TEN: AMENDMENTS. Any amendment to any provision of this Ordinance may be granted only pursuant to the procedures, and subject to the standards and limitations, provided in the Zoning Ordinance for the granting of special use permits and planned unit developments. SECTION ELEVEN: EFFECTIVE DATE. A. This Ordinance will be effective only upon the occurrence of all of the following events: Passage by the Village Board by a majority vote in the manner required by law; 2. Publication in pamphlet form in the manner required by law; Recordation of this Ordinance, together with such exhibits as the Village Clerk deems appropriate for recordation, with the office of the Lake County Recorder; 4. The filing by Owner with the Village Clerk of a fully executed Unconditional Agreement and Consent, in the form of Exhibit O attached to and, by this reference, made a part of this Ordinance, to accept and abide by each and all of the terms, conditions, and limitations set forth in this Ordinance and to indemnify the Village for any claims that may arise in connection with the approval of this Ordinance. B. In the event that Owner does not file fully executed copies of the Unconditional Agreement and Consent, as required by Section 1 LAA of this Ordinance, within 30 days after the date of final passage of this Ordinance, the Village Board will have the right, in its sole discretion, to declare this Ordinance null and void and of no force or effect.
