O-90-51ORDINANCE NO. 0-90-51 AN ORDINANCE ANNEXING CERTAIN LAND TO THE VILLAGE OF DEERFIELD, ILLINOIS Published in pamphlet form this 3rd day of December , 1990, by the President and Board of Trustees of Deerfield. 2970987 JKS01215A2111790/50 ORDINANCE NO. 0-90 -51 AN ORDINANCE ANNEXING CERTAIN LAND TO THE VILLAGE OF DEERFIELD ILLINOIS WHEREAS, a written Petition for Annexation under oath by American National Bank and Trust Company of Chicago, as Trustee under the provisions of a Trust Agreement dated September 18, 1984, known as Trust No. 62258 and Deerfield -Saunders Joint Venture, an Illinois General Partnership as owner of the beneficial interest therein (collectively the "Owners") as the owner of record and beneficial owner of certain territory hereinafter described in Exhibit A hereto has been filed with the Village Clerk requesting that said territory be annexed to the Village of Deerfield pursuant to the terms of a certain Second Amendment to Annexation Agreement entered into by American National Bank and Trust Company of Chicago, as Trustee under those certain Trust Agreements dated September 18, 1984, October 4, 1985, March 6, 198,6.and November 11, 1988 and known respectively as Trust Nos. 62258, 65708, 66526 and 107008-05 as Owners and Deerfield -Saunders Joint Venture, an Illinois General Partnership as developer (the "Developer"), LP Equity Associates Limited, a Delaware Limited Partnership as managing General Partner of the Developer and the Village of Deerfield; and WHEREAS, said territory is not within the corporate limits of any municipality but is contiguous to the boundaries of the Village of Deerfield as described and depicted in Exhibit B; and WHEREAS, said territory is within the corporate limits of Deerfield -Bannockburn Fire Protection District and more than ten days prior to an action being taken with respect to the Petition to Annex said territory, the Trustees of said District were notified in writing of the filing of said Petition to Annex by certified mail; and WHEREAS, due and timely notice of the proposed annexation was given to the West Deerfield Township Highway Commission and the Board of Town Trustees, in the manner and form required by statute. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That all the territory legally described on ONE: Exhibit A and Exhibit B, the Plat of Annexation, each attached and made a part hereof and the full rights -of -way of all included and adjoining streets and highways as shown on said accurate map of such territory, be and the same 29 3'7 98 . " . , ORDINANCE NO. 0-90-51 are hereby annexed to the Village of Deerfield, Lake and Cook Counties, Illinois. SECTION That the Village Clerk of the Village of Deerfield TWO: is hereby directed to file in the office of the Recorder of Deeds of Lake County, Illinois, being the County in which said annexed territory is situated, a copy of this Ordinance together with an accurate map of the territory hereby annexed. SECTION That the Village Clerk of the Village of Deerfield THREE: is further directed to place of record the Affidavit of Service of Notice on the Trustees of the Deerfield -Bannockburn Fire Protection District and the West Deerfield Township Highway Commission and the Board of Town Trustees in the office of the Recorder of Deeds of Lake County as provided by law. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage and approval, and when a copy thereof with an accurate map is recorded in the Office of the Recorder of Deeds, Lake County, Illinois, thereupon said territory shall be subject to the jurisdiction and ordinances of the Village of Deerfield, Illinois.
