AN ORDINANCE TO ABANDON THE LOCAL IMPROVEMENT
CONSISTING OF THE CONSTRUCTION OF CONCRETE CURB
AND GUTTER, SIDEWALKS, AND A BITUMINOUS TRANSI-
TION PAVEMENT AND THE INSTALLATION OF A STORM
DRAINAGE SYSTEM AND OTHERWISE IMPROVING PORTIONS
OF WILMOT ROAD AND BERKELEY COURT IN THE VILLAGE
OF DEERFIELD, ILLINOIS, DESIGNATED SPECIAL
ASSESSMENT NO'.' '11:0 ............ .
WHEREAS, this Board, by Ordinance No. 0- 71 -11, adopted on
April 5, 1971, provided for a local improvement along portions of
Wilmot Road and Berkeley Court, which improvement was designated
Special Assessment No. 110; and
WHEREAS, a Petition to levy said Special Assessment and a
Report and Assessment Roll were thereafter filed in the Circuit Court
of the Ninteenth Judicial District, Lake County, Illinois, as pro-
ceeding number 71TX 34; and
WHEREAS, the total amount of land necessary for the con-
struction of the said local improvement had not been acquired by the
Village, and assessments totaling $8,051.31.against five properties
covered in the Report and Assessment Roll were subsequently, upon
hearing, determined to be improper, thus reducing the scope of said
local improvement and the amount of costs for constructing the same
to $19,151.86; and
WHEREAS, bids for constructing the local improvement as
reduced in scope were advertised for and were received and opened
by this Board on September 7, 1971, and the lowest bid in the amount
of $17,746.89, together with the additional cost for engineering, for
spreading and levying the assessment and for a reserve for deficiency
in interest, exceeded the amount available therefor in the said Report
and Assessment Roll.
THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION The construction of a local improvement to
ONE: portions of Wilmot Road and Berkeley Road
including therein the construction of concrete curb and gutter,

sidewalks and a bituminous transition pavement and necessary storm
drainage facilities, which improvement is designated as Special
Assessment No. 110,. and as number 71TX 34 in the'Circuit Court of
the Ninteenth Judicial District, Lake County, Illinois, and as
provided for in Ordinance No. 0- .71 -11, is herein abandoned.
SECTION The Village Attorney shall file a certified

of the Recommendation of the Board of Local Improvements in.the
Circuit Court of the Ninteenth Judicial District, Lake County,
Illinois.
