AN ORDINANCE PROVIDING FOR REIMBURSEMENT
OF COST OF DEERBROOK -SEWER MAINS
WHEREAS, JOSEPH E. VALENTI is the owner, developer or'is
otherwise interested in the property commonly known as the Deerbrook
Shopping Center, Deerfield, Illinois, and is willing to undertake the
construction by private contract and pay the cost of certain underground
improvements consisting of a water main, sanitary sewer, stubs and
appurtenances in the right -of -way of Waukegan Road'in the Village of
Deerfield, all in accordance with certain plans and specifications
heretofore submitted; and
WHEREAS, said improvements, when constructed, may be made
available to and will benefit the following described property,
commonly known as the Werhane property):
That part of the North 1/2 of Section 4, Township 42 North,
Range 12 East of the Third Principal Meridian described as:
Commencing at the Southwest corner of Downey's Cook County
Country Home Addition to Deerfield, being a subdivision of
part of the North 1/2 of said Section 4, and running thence
South 25 degrees, -13 minutes,, 30 seconds East along the
Easterly right -of -way line of the Chicago, Milwaukee, St.
Paul and Pacific Railroad 365.03 feet to its point of
intersection with the Northerly right -of -way line of the
Northern Illinois Toll Highway; thence South 59 degrees
8 minutes 30 seconds East along said Toll Highway Northerly
right -of -way line 1259.80 feet; thence North 85 degrees
48 minutes 35 seconds East 855.62 feet to a point of inter-
section with the Westerly line of Waukegan Road'(said Westerly
line being 33 feet Westerly of, measured perpendicularly,
and parallel with the center line of said Road as occupied);
thence North 27 degrees 7 minutes 5 seconds West along said
Westerly line 1028.59 feet to its point of intersection with
the South line of said Downey's Subdivision extended Easterly;
thence South 89 degrees 56 minutes 30 seconds West along said
Easterly extension and said South line of said Subdivision
1621.44 feet to the place of beginning in Cook County, Illinois;
and
WHEREAS, the construction of said improvements by private
contractor may result in substantial savings to the owners of said
real estate having present or future use thereof; and
WHEREAS, the said Joseph E. Valenti proposes to construct
said improvements by private contract upon the condition that the
Village of Deerfield be not charged with any part of the cost
thereof, and with the understanding that the Village require the
owners of the benefited property desiring to connect to and utilize
said improvements to reimburse Joseph E. Valenti or his nominee
for such property owner's proportionate share of the cost of the
construction thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That upon completion of said improvements and
ONE: for a period of ten (10).years thereafter, no
person, firm or corporation, excepting Joseph E. Valenti or his
assignee shall connect to said improvements for the purpose of pro-
viding sanitary sewer and water service to the property being bene-
fited and hereinabove described without first obtaining a permit
from the Village. No such permit shall be issued by the Village
unless the applicant shall submit evidence of payment to Joseph E.
Valenti or his nominee or his successors and assigns, in reimbursement
of such owner's or owners' proportionate share of the cost of said
improvements, which is hereby determined to be the sum of FOUR
THOUSAND FOURHUNDRED NINETY -ONE DOLLARS ($4,491.00), which sum has
been computed in the following manner:

Such payment to Joseph E. Valenti shall be in addition to the usual
charges and fees established by ordinance and payable to the Village
for the issuance of such permits. From and after the expiration of
the ten -year period hereinabove provided, there shall be no obliga-
tion on the-Village to see to any reimbursement for the cost of said
improvements.
SECTION That the Village Clerk is hereby directed to
