AN ORDINANCE GRANTING A VARIATION
FROM THE PROVISIONS OF THE ZONING ORDINANCE
WITH RESPECT TO THE PROPERTY LOCATED
AT ONE WAUKEGAN ROAD, DEERFIELD, ILLINOIS
WHEREAS, STANDARD OIL COMPANY has petitioned for certain
variations from the strict provisions of the Zoning Ordinance of the
Village of Deerfield, passed May 4, 1953, as amended; and
WHEREAS, pursuant to notice duly published, as required
by statute, a public hearing on said petition was held and conducted
by the Zoning Board of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning Board of Appeals has filed with the
President and Board of Trustees its written findings of fact and
recommendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That the findings of fact and recommendation of
ONE: the Zoning Board of Appeals are hereby concurred
in and adopted as the findings of fact of the President and Board of
Trustees.
SECTION That there are practical difficulties and
TWO: particular hardship in the way of carrying out
the strict letter of provisions of the Zoning Ordinance of the
Village of Deerfield, as applied to Petitioner's property, which is
legally described as follows:
A parcel of land in the southwest quarter of the
southeast quarter of Section 33, Township 43 North,
Range 12 East of the Third Principal Meridian, said
parcel of land being designated as Lot 1 on a Plat
of Subdivision, by John A. Mallin, and being bounded
and described as follows: Beginning on a line which
is 50.00 feet, measured perpendicularly north from
and parallel with the south line of said southeast
quarter, at a point 150.00 feet east from the point
of intersection of said parallel line with a line
40.00 feet, measured perpendicularly, easterly from
and parallel with the center line of Waukegan
(Telegraph) Road, said point of intersection being
hereinafter referred to as -the northeast corner of
Lake -Cook and Waukegan Roads and running thence west
along said line which is 50.00 feet north from the
south line of the southeast quarter, said distance of
150.00 feet to the northeast corner of Lake -Cook and
Waukegan Roads; thence northwesterly along said line
which is 40.00 feet easterly from and parallel with
the center line of Waukegan Road, a distance of 150.00
feet; thence northeastwardly along a line perpendicular
to the last described course, a distance of 60.00
feet; thence southeastwardly along a straight line,
a distance of 97.26 feet to a.point which is 139.74 feet
northeasterly from said northeast corner of Lake -Cook
and Waukegan Roads; thence southeastwardly along a
straight line, a distance of 97.26 feet to a point which
is 60.00 feet north from the point of beginning and is
on a line drawn perpendicular to the first herein
described course through said point of beginning and
thence south along said perpendicular line, said
distance of 60.00 feet to the point of beginning;
containing 22,514 square feet of land, more or less
SECTION That a variation from the strict provisions of
THREE: Section XIII -D -3 of the Zoning Ordinance of the
Village of Deerfield, passed May 4, 1953, as amended with respect to
the property hereinabove described, is hereby granted so as to permit
the relocation and reconstruction of an existing gasoline service
station building so as to have a rear yard of four feet in lieu of the
required ten -foot rear yard.
SECTION That the variation hereby granted is subject to
FOUR: compliance by Petitioner with all other applicable
provisions of the Zoning Ordinance of the Village of Deerfield and all
other applicable ordinances of the Village and the execution of a
covenant in form satisfactory to the Village providing that the intensity
of the lighting on the subject premises shall not be increased from its
present level.
SECTION That this Ordinance shall be in full force and
FIVE: effect from and after its passage and approval
as provided by law.
