ORDINANCE NO. 0 -70- 10 AN ORDINANCE AMENDING CHAPTER 17 OF THE MUNICIPAL CODE OF DEERFIELD BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Chapter 17 of the Municipal Code of the ONE: Village of Deerfield of 1963, as amended, be and the same is hereby further amended by adding a new Article XI as follows: "ARTICLE XI GASOLINE SERVICE STATIONS "17.1101 License Required.) It shall be unlawful to operate or conduct a gasoline service station in the Village of Deerfield without first having obtained a license therefor. "17.1102 Definition.) A gasoline service station within the meaning of this Article is any place of business where gasoline or other volatile fuels for motor vehicles or internal combustion engines are stored, sold or offered for sale at retail. The term gasoline service station shall also include premises used for the private storage or dispensing of gasoline or other fuels for motor vehicles or internal combustion engines whether such storage is maintained for the use or benefit of the owner, his employees or others. "17.1103 Applications.) Applications for such license shall be made to the building commissioner of the Village of Deerfield upon forms provided by the Village and disclosing such information with respect to the premises for which such license is sought and other matters as the building commissioner may reasonably require to enforce the provisions of this Article and shall otherwise comply with the provisions of Chapter 12 of this Code. No license shall be issued to any applicant therefor unless I I upon investigation, the building commissioner shall determine that the applicant and the premises for which such license is sought are in full compliance with the provisions of Chapter 26 of this Code. "17.1105 Underground Flammable Liquid Storage Tanks.) "a) New or replacement installation "1) Underground flammable liquid storage tanks shall be installed and tested in accordance with the National Fire Protection Association Flammable and Combustible Liquids Code No. 30 -1969, Chapter 2 Tank Storage and Chapter 7 Service Stations; and in accordance with the recommended practice of NFPA No. 329 -1965. Installations incorporating sub- mersible pumps shall be equipped with a pump - actuated leak detector. "2) Before the installation of any tank intended for the use of storage of flammable liquids is covered from sight, the building commissioner shall inspect the installation and give approval if the requirements of this and other applicable provisions of the Code have been observed. The installer, in the presence of the building com- missioner or his authorized representative, shall subject the tank and its piping to a leak test in accordance with NFPA No. 30 -1969, Section 26. The test shall be conducted after the tank has been set in place and all piping has been permanently connected, but before the tank or piping are covered. The test shall be run with air pressure if the water table permits. When air tested, all joints shall be examined for leakage with a soap solution or equivalent. Approval of the installation shall not be given unless there shall be no leakage detected and there shall be no drop in indicated gauge pressure in 30 minutes. Hydrostatic leak test- ing may be conducted with the product. "b) Tanks in service "1) Accurate inventory control records shall be maintained by the licensee for each under- ground tank in accordance with NFPA No. 30 -1969, Chapter 7, paragraph 7017 and NFPA No. 329 -1965, Chapter 2. The licensee shall promptly report abnormal loss of stock to the Building Commissioner. He shall make his stock control records available for checking by the Building Commissioner. "2) Retesting of the installed system shall be conducted in accordance with NFPA No. 329 -1965, Chapter 3. When testing is required, such tests shall be made by a person, firm or corporation qualified to test such underground flammable storage systems and shall be conduc- ted in the presence of the building commissioner or his authorized representative. The cost of such tests shall be paid by the licensee. "3) The building commissioner may require retesting at any time when it is suspected that an underground tank or its connected piping may be leaking or when stock control records indi- cate an abnormal loss. "4) Periodic retesting may be required after the 10th year of installation and every 5th year thereafter unless performed more frequently for cause. 115) Station owners shall conduct periodic (at least monthly) tests for the presence of water in submerged steel tanks in accordance with NFPA 329 -1965, Chapter 2." "17.1106 Drainage and Waste Disposal.) Provision shall be made to prevent flammable or combustible liquids which may be spilled at loading or unloading points from entering public sewers and drainage systems, or natural waterways. Connections to such sewers, drains, or waterways by which flammable or combustible liquids might enter shall be provided with separator boxes or other approved means whereby such entry is precluded. Crankcase drainings and flammable or combustible liquids shall not be dumped into sewers, but shall be stored in tanks or tight drums outside of any building until removed from the premises. 1117.11071 Penalty.) Any person, firm or corporation violating any provision of this Article shall be fined not to exceed $500 for each offense and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues." SECTION That all ordinances or parts of ordinances in TWO: conflict herewith, are, to the extent of such conflict, hereby repealed. SECTION That the Village Clerk is hereby directed to THREE: publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and FOUR: effect from and after its passage, approval and publication, as provided by law.
