O-71-11ORDINANCE NO. 0 -71- 11 AN ORDINANCE TO PROVIDE FOR A LOCAL IMPROVEMENT CONSISTING OF THE CONSTRUCTION OF CONCRETE CURB AND GUTTER, THE CONSTRUCTION OF CONCRETE SIDEWALK AND THE INSTALLATION OF A STORM DRAINAGE SYSTEM AND OTHERWISE IMPROVING PORTIONS OF WILMOT ROAD AND BERKELEY COURT IN THE VILLAGE OF DEERFIELD, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION A local improvement shall be constructed in the ONE: Village of Deerfield, Illinois, consisting of the construction of a Portland cement concrete curb and gutter and sidewalk; the installation of a storm drainage system; the restora- tion of the parkways by grading and seeding, as necessary; and such other incidental work as may be necessary to complete the improvement to the following streets in the manner hereinafter described: WILMOT ROAD On the west side of Wilmot Road from the end of the existing curb and gutter and sidewalk at Greenwood Avenue, northerly to the south pavement edge of Berkley Court, a distance of 1,383 feet. Said improvement to Wilmot Road consists of constructing concrete curb and gutter to provide a pavement width of 27 feet 6 inches back -to -back of curb; installing bituminous concrete surface course transition between the proposed gutter and the existing pavement surface; constructing concrete sidewalk four inches thick and five feet wide, the back of which is 24 feet from the center line of the proposed street; providing such new drainage facilities as are necessary; adjusting existing utility structures and driveway entrances as necessary; restoring the parkways and other such incidental work as may be necessary to complete the improvement. BERKELEY COURT On the south side of Berkeley Court from the west line extended of Lot 2 easterly to Wilmot Road, a distance of 300 feet. Said improvement to Berkeley Court consists of constructing concrete curb and gutter to provide a future pavement width of 27 feet back -to -back of curb; constructing bituminous concrete widening between the proposed gutter and the existing edge of pavement; constructing concrete sidewalk four inches thick and five feet wide, the back of which is 29 feet 3 inches from the center line of the proposed street; restoring the parkways and other such incidental work as may be necessary to complete the improvement. all of said streets being located in Lake County, Illinois. SECTION That said improvement shall be constructed, and TWO: the details concerning the same shall be in accordance with the Plans and the Special Provisions entitled, "Village of Deerfield, Illinois, Wilmot Road Curb and Sidewalk Improvement, Special Assessment No. 110," attached hereto and made a part hereof. SECTION That all materials of every kind used in the THREE: construction of this improvement shall be of first -class quality and suitable for the purpose for which they are to be used. All construction shall be done in a workmanlike manner, under the supervision and subject to the approval of the Board of Local Improvements. SECTION That the Recommendation of the Board of Local FOUR: Improvements of this Village providing for this improvement, together with the Estimate of the cost thereof made by the President of said Board, both attached hereto, are herein approved. SECTION That the improvement herein provided to be FIVE: constructed shall be made, and the whole cost thereof, including $1,497.71, being the amount included in the Estimate of the President of the Board of Local Improvements as the cost of making, levying, and collecting the assessment herein with an equal amount included as reserve for deficiency in interest, shall be paid for by special assessment in accordance with Article 9, Division 2, of the Illinois Municipal Code, approved May 29, 1961, and the amend- ments thereto; and $1,497.71 shall be applied toward the cost of making,-levying and collecting such assessment and an additional $1,497.71 shall be retained and used as reserve for payment of deficiency in interest. Each said amount does not itself exceed 6% of the amount of the assessment as estimated. SECTION The aggregate amount herein ordered to be assessed T- X: against the property, and also the assessment on each lot and parcel of land therein assessed, shall be divided into ten (10) installments in the manner provided by the Statute aforesaid, and each of said installments shall bear interest at the rate of 6% per annum according to law, until paid. SECTION That for the purpose of anticipating the collection SEVEN: of the second and succeeding installments of said assessment for said improvement, vouchers or bonds shall be issued payable out of said installments, bearing interest at the rate of 6% per annum,.payable annually and signed by the President of the Village of Deerfield, and attested by the Village Clerk under the corporate seal of the Village of Deerfield. Said vouchers or bonds shall be issued in accordance with and shall in all respects conform to the provisions of the aforesaid statute of the State of Illinois entitled, "Municipal Code," and the amendments thereto. SECTION That the Village Attorney is directed to file a EIGHT: Petition in the Circuit Court of Lake County, Illinois, in the name of the Village of Deerfield, praying that steps may be taken to levy a special assessment for said improvement in accordance with the provisions of this Ordinance in the manner pre- scribed by law. SECTION That all ordinances or parts of ordinances in NINE: conflict herewith are, to the extent of such conflict, Hereby repealed. SECTION That this Ordinance shall be in full force and TEN: effect from and after its passage and approval as provided by law.
