AN ORDINANCE AMENDING CHAPTER 23 AND
CHAPTER 24 OF THE DEERFIELD MUNICIPAL CODE
(Sewer and Water Rates)
WHEREAS, the Corporate Authorities of the Village of
Deerfield are authorized under the provisions of Section 11 -139 -8
of the Illinois Municipal Code (Chapter 24, Illinois Revised Statutes,
1969) to establish reasonable charges for the use and service of the
Village's combined waterworks and sewerage system and are further
directed to fix such charges at a rate sufficient at all times to:
1) pay the cost of operation and maintenance of the combined water-
works and sewerage system; 2) provide an adequate depreciation fund;
and 3) pay the principal of and interest upon all outstanding revenue
bonds; and
WHEREAS, the City of Highland Park from whom the Village of
Deerfield purchases its water supply pursuant to contract has increased
its charge therefor three times since 1959 and contemplates further
increases in such charge, and the costs and expenses of operating the
Village's combined waterworks and sewerage system has and continues
to increase at a rapid rate by reason of the employment of additional
personnel and acquisition of additional equipment and supplies to meet
the demand for service and the higher quality standards of operation
and treatment required by the State of Illinois, normal wage increases
and increased costs of supplies, maintenance and repairs; and
WHEREAS, the Corporate Authorities of the Village of
Deerfield have determined that it is necessary to increase the charges
to users for the use and'service of the Village's combined waterworks
and sewerage system in order to meet the aforesaid increases in costs
of operation of said system and to comply with the mandate of the
applicable statute.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That Section 23.304 of Article III of Chapter 23
ONE: of the Municipal Code of the Village of Deerfield
of 1963, as amended, be and the same is hereby further amended by
striking said Section in its entirety and substituting in lieu thereof
the following:
"23.304 Rates.) The charge for water furnished to each
lot, parcel of land, building or premises, situated
within the corporate limits of the Village having
any connection with the municipal water supply shall
be the following rates per month:

"Where bills are rendered for more than one month
the amount of water used monthly shall be determined
by dividing the total cubic feet of water used by
the number of months, or portion thereof, the bill
covers.
"The minimum monthly charges shall be as follows:

"Where the premises served has more than one family
unit or business establishment, the minimum rate
for the premises shall be the minimum above
prescribed for each family unit or business
establishment, even though the premises are served
by one meter, and the amount shown above for cubic
feet of water used shall be multiplied by the
number of such units or establishments before -
determining the charge for the amount of water
used per month.
"The charges to premises outside the corporate
limits served by the municipal water system shall
be one and one -half times the charge for similar
service to premises inside the corporate limits.

"The charges to premises outside the corporate
limits served by the municipal water system shall
be one and one -half times the charge for similar
service to premises inside the corporate limits.
"Provided, however, that the charge to other taxing
bodies connected to the municipal water supply
shall be at the straight rate of forty cents per
one hundred cubic feet of water except where water
is purchased for resale in which event the rate
shall be as determined by the Board of Trustees."
SECTION That Section 24.1100 of Article XI of Chapter 24
TWO: of the Municipal Code of the Village of Deerfield
of 1963, as amended, be and the same is hereby further amended by
striking said Section in its entirety and substituting in lieu
thereof the following:
"24.1100 Rates.) There are hereby established
the following rates and charges for the use and
service of the sewerage system of the Village.
Such rates and charges shall be based on the
amount of water supplied by the municipal waterworks
system as shown by the water meter readings for
each water billing period, and shall be as follows:

SECTION That Section 24.1101 of Article XI of Chapter 24
THREE: of the Municipal Code of the Village of Deerfield
of 1963, as amended, be and the same is hereby further amended by
striking the fourth paragraph of said Section in its entirety and
substituting in lieu thereof the following:
"The.minimum charge shall be $1.00 per month."
SECTION That all ordinances and parts of ordinances in
FOUR: conflict herewith, are, to the extent of such
conflict, hereby repealed.
SECTION That the Village Clerk is hereby directed to publish
FIVE: this-Ordinance in pamphlet form.
SECTION That this Ordinance shall be in *full force and
SIX: effect from and after its passage, approval and
publication, as provided by law.
