ORDINANCE NO. 0 -71 -16 AN ORDINANCE PROVIDING FOR REIMBURSEMENT OF COST OF DEERBROOK STORM SEWER WHEREAS, JOSEPH E. VALENTI is the owner, developer or is otherwise interested in the property commonly known as the Deerbrook Shopping Center., Deerfield, Illinois, and is willing to undertake the construction by private contract and pay the cost of a certain under- ground improvement consisting of a storm sewer under and across said property and the property of others, all in accordance with certain plans and specifications heretofore submitted; and WHEREAS, said improvement, when constructed, may be made available to and will benefit certain properties described and identi- fied as Lot 1- Parcel 1, Lot 1- Parcel 2, Lot 1- Parcel 3, Lot 2, Lot 2A, Lot 3, Lot 4, Lot 4A, Lot 5, Lot 6, Lot 7A, Lot 71 Lot 8, Lot 9 and Lot 10 on a certain Storm Outfall Sewer Recapture Exhibit, marked Exhibit A and attached hereto and made a part hereof; and WHEREAS, the construction of said improvement by private contractor will result in substantial savings to persons or property owners having present or future use thereof; and WHEREAS, the said Joseph E. Valenti proposes to construct said improvement by private contract upon the condition that the Village of Deerfield be not charged with any part of the cost thereof, and with the understanding that the Village require the owners of the benefited properties desiring to connect to and utilize said improvement to reim- burse Joseph E. Valenti or his nominee for such property owner's proportionate share of the cost of the construction thereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That upon completion of said improvement and for ONE: a period of ten (10) years thereafter, no person, firm or corporation,.excepting Joseph E. Valenti shall connect to said improvement for the purpose of providing drainage to properties being benefited as listed above without first obtaining a permit from the Village. No such permit shall be issued by the Village unless the applicant shall submit evidence of payment to Joseph E. From and after the expiration of the ten -year period hereinabove provided, there shall be no obliga- tion on the Village to see to any reimbursement for the cost of said improvement. SECTION That the Village Clerk is hereby directed to TWO: publish this Ordinance in pamphlet form.. SECTION That this Ordinance shall be in full force and THREE: effect from and after its passage, approval and publication, as provided by law. Exhibit "A" (the plat of the benefited properties) was recorded with the ordinance. Because there was no identification of location on Exhibit "A ", I added to the plat the following: Downey's Cook County Country Home Addition to Deerfield, f� N 1/2, Sec. 4, T 42 N, R 12, E of 3rd P.M., Cook County, Illinois It takes about two or three weeks to get a Village check issued so I sent a personal check for the recording fee of $11.00 (copy enclosed).
