AN ORDINANCE AMENDING VARIOUS SECTIONS OF THE
ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD
RELATING TO SIDE AND REAR YARD ENCROACHMENTS
WHEREAS, the Plan Commission of the Village of Deerfield,
pursuant to proper notice, as provided by statute and ordinance,
has held a public hearing upon the subject matter of certain
Amendments to the Zoning Ordinance of the Village of Deerfield; and
WHEREAS, the said Plan Commission has recommended that the
corporate authorities amend said Zoning Ordinance in the manner
hereinafter provided.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, AS FOLLOWS:
SECTION That Section VI of the Zoning Ordinance of the
ONE: Village of Deerfield passed May 4, 1953, as .
amended, be and the same is hereby further amended in the following
respects:
1. By amending Section VI,A,6 so as to read as
follows:
"6. Accessory buildings including a private
garage, accessory living quarters, guest house,
recreation room, green house, bath house, stable,
corral, pen,coop or kennel."
2. By amending Section VI,C,6 so as to read as
follows:
"6. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are
closer to the lot line than ten (10) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section VI -A,C,6 of the Zoning Ordinance
TWO: of the Village of Deerfield passed May 4, 1953,
as amended, be and the same is hereby further amended so as to read
as follows:
"6. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are
closer to the lot line than ten(10) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section VI -B of the Zoning Ordinance of the
THREE: Village of Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended in the following
respects:
1. By amending Section VI -B,A,2 to read as
follows:
"2. Accessory buildings or structures."
2. By adding a new subsection VI -B,C,3 as
follows:
"3. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are
closer to the lot line than five ( 5) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section VII of the Zoning Ordinance of the
FOUR: Village of Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended in the following
respects:
1. By amending Section VII,A,6 to read as
follows:
"6. Accessory buildings or structures."
2. By amending Section VII,C,6 to read as
follows:
"6. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are

and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section VIII,C,6 of the Zoning Ordinance of
FIVE: Village of Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended so as to read
as follows:
"6. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,.
provided no buildings or structures are
closer to the lot line than ten (10) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section.IX,C,6 of the Zoning Ordinance of
SIX: the Village of Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended so as to read
as follows:
"6. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are
closer to the lot line than five (5 ) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section X,C,6 of the Zoning Ordinance of the
SEVEN: Village of Deerfield passed May 4, 1953, as
amended, began the same is hereby further amended so as to read
as follows:
"6. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are
closer to the lot line than five (5 ) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section XI,D,7 of the Zoning Ordinance of
EIGHT: the Village of Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended go as to read
as follows:
"7. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are
closer to the lot line than five (5 ) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section XII,D,7 of the Zoning Ordinance of
NINE: the Village of Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended so as to read
as follows:
"7. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are
closer to the lot line than five (5 ) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section XII.1,C of the Zoning Ordinance of
TEN: the Village of Deerfield passed May 4, 1953, as
amended, be and the same is hereby further amended by adding a
subsection XII.1,C,1 as follows:
"l. Accessory Buildings or Structures:
Accessory buildings or structures shall not
encroach upon the front yard. They may
encroach upon the side or rear yard,
provided no buildings or structures are
closer to the lot line than ten (10) feet,
and provided further that on a corner lot,
accessory buildings or structures shall not
encroach upon the front or side yards
adjacent to the abutting streets."
SECTION That Section XVII,A,2 of the Zoning Ordinance of
ELEVEN: the Village of Deerfield passed May 4, 1953, as
amended,.be and the same is hereby further amended so as to read
as follows:
"2. An accessory building may not be located
nearer than five (5) feet to any interior lot
and not nearer than five (5) feet to the
rear lot line. Notwithstanding the foregoing
provision, when a greater setback for
accessory buildings or structures from side
and rear lot lines is required by the applicable
district regulations, compliance shall be had
with such district regulations."
SECTION That the definition of "structure" contained
TWELVE: in Section III of the Zoning Ordinance of the
Village of Deerfield passed May 4, 1953, as amended,.be and the same
is hereby further amended by adding the following:
"Structures shall include but are not limited
to the following: swimming pools, air
conditioner units, outdoor permanent grills
or fireplaces, open -top enclosures for trash
storage, tanks, accessory pumps, semi - permanent
buildings, storage containers requiring more
than two men to move when loaded."
SECTION That all ordinances or parts of ordinances in
THIRTEEN: conflict herewith are, to the extent of such
conflict, hereby repealed.
SECTION That the Village Clerk is hereby directed to
FOURTEEN: publish this Ordinance in pamphlet form.
SECTION That this Ordinance shall be in full force and
FIFTEEN: effect from and after its passage, approval and
publication, as provided by law.
