AN ORDINANCE AMENDING CHAPTER 18
OF THE MUNICIPAL CODE OF DEERFIELD
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That Section 18.413 of Chapter 18 of the Municipal
ONE: Code of Deerfield of 1963, as amended, be and the
same is hereby further amended by striking said Section in its
entirety and substituting in lieu thereof the following:
"18.413 Smoke.)
(1) Definitions. Terms used in this Section shall
have the following meanings:
(a) Non - Stationary source: Any and all non -
stationary sources of smoke emissions, whether
privately or publicly owned or operated. With-
out limiting the generality of the foregoing,
this term includes automobiles, trucks, tractors,
buses, and other motor vehicles, railroad loco-
motives, and all portable fuel- burning equipment.
(b) Ringelmann Chart: The chart published and
described in the U.S. Bureau of Mines Information
Circular 8333 dated May, 1967, and on which are
illustrated the graduated shades of gray to
black for use in estimating the density of smoke.
(c) Smoke: Small gasborne particles resulting
from incomplete combustion consisting predomi-
nantly of carbon and other combustible material
and present in sufficient quantity to be observa-
ble independently of the presence of other solids.
(d) Stationary source: Any and all stationary
sources of smoke emissions, whether privately
or publicly owned or operated. Without limiting
the generality of the foregoing, this term
includes all types of business, commercial,and
industrial plants, works, shops, and stores,
and heating power plants and stations, buildings
and structures of all types, including single
and multiple family residences, apartment houses,
garages, office buildings, hotels, restaurants,
schools, hospitals, churches and other industrial
or institutional buildings, incinerators of all
types both indoor and outdoor, and all stacks
and other chimney outlets from any of the
foregoing.
(2) Emission of smoke.
(a) Stationary source: It shall be unlawful
within the Village of Deerfield for any person,
firm or corporation to permit or cause the
emission of any smoke, which smoke exceeds the
following permissible limitations, from any
stationary source except from fireplaces in
residential units and outdoor cooking facilities
accessory to residential units. The emission
limitations are as follows:
1. Smoke of a density, shade or
opacity equal to but not greater than
No. 1 on the Ringelmann Chart may be
emitted for a maximum period of four
minutes out of every half hour.
2. Smoke of a density, shade or
opacity equal to but not greater than
No. 2 on the Ringelmann Chart may be
emitted for a maximum period of four
minutes out of every two hours.
3. The emission of smoke of a density,
shade or opacity greater than No. 2 on
the Ringelmann Chart is not permissible.
(b) Non - stationary source: It shall be unlawful
within the Village of Deerfield for any person,
firm or corporation to permit or cause the
emission of any smoke from a non - stationary source
of a density, shade or opacity greater than No. 2
on the Ringelmn a t with the exemption of
diesel powered , during the first 15 *vehicles
seconds after accelerating from a stationary
position, when they,shall be permitted not greater
than No. 3 on the Ringelmann Chart, and with the
exemption of home grills.
SECTION That all ordinances or parts of ordinances in
TWO: conflict herewith are, to the extent of such
conflict, hereby repealed.
SECTION That the Village Clerk is hereby directed to
THREE: publish this Ordinance in pamphlet form.

SECTION That this Ordinance shall be in full force and
FOUR: effect from and after its passage, approval
and publication, as provided by law.
