AN ORDINANCE GRANTING A VARIATION FROM THE
PROVISIONS OF THE ZONING ORDINANCE WITH
RESPECT TO THE PROPERTY LOCATED AT
745 WAUKEGAN ROAD, DEERFIELD, ILLINOIS
WHEREAS, SINCLAIR ATLANTIC RICHFIELD OIL COMPANY has
petitioned for certain variations from the strict provisions
of the Zoning Ordinance of the Village of Deerfield, passed
May 4, 1953, as amended; and
WHEREAS, pursuant to notice duly published as required by
statute, a public hearing on said petition was held and conducted by
the Zoning Board of Appeals of the Village of Deerfield; and
WHEREAS, the Zoning. Board of Appeals has filed with the
President and Board of Trustees its written findings of fact and recom-
mendations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE.OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
AS FOLLOWS:
SECTION That the findings of fact and recommendation of the
ONE: Zoning Board of Appeals are - hereby concurred in and
adopted as the findings of fact of the President and
Board of Trustees.
SECTION That there are practical difficulties and particular
TWO: hardship in the way.of carrying out the strict let-
ter of the provisions of the Zoning Ordinance of the
Village of Deerfield, as applied to Petitioner's property, which is
legally described as follows:
A part of Lot 11 Owner's First Addition in Deerfield,
Illinois, located ih the North 1/2 of Section 33,
Township 43 North, Range 12 East of the Third Principal
Meridian County of Lake and State of Illinois more
particularly described, as follows: Beginning at a
point located 33.63 feet East of the center line of
Lincoln Avenue (now Waukegan Road) and 218.49 feet
Southeasterly of a point determined by the center
line of Deerfield Road and the @enter line of Lincoln
Avenue (now Waukegan Road),'said 218.4.9 feet measured
along the center line of Lincoln Avenue (now Waukegan

Road); thence Southerly along the Westerly lot
line of Lot 11 a distance of 86.53 feet to the
Southwesterly corner of said lot; thence
Northeasterly along the Southerly lot line of
Lot 11 a distance of 26 feet 6 inches; thence
Northwesterly on a line drawn parallel to the
Westerly lot line of Lot 11 a distance of 39
feet; thence East on a line drawn parallel to
the Northerly lot line of Lot 11 a distance
of 19 feet to a point ;. thence North on a line
drawn at right angles to the Northerly line of
Lot 11 a distance of 40 feet 6 inches; thence
Westerly on the Northerly lot line of Lot 11
a distance of 57 feet more or less to the point
of beginning; reserving, however, to the Lessor
an easement of way to furnish means of ingress
to and egress from the Lessor's garage building
located West of said premises over and across
the following described parcel of real estate:
beginning at a point on the Easterly line of
Waukegan Road 32 feet North of the Southwest
corner of said premises, thence at right angles
in an Easterly direction to the Easterly
boundary of said premises, thence in a
Southeasterly direction along the Easterly
boundary of said premises a distance of 15 feet,
thence in a Westerly direction to a point in
the Easterly boundary of Waukegan Road 17 feet
North of the Southwesterly corner of said
premises, thence in a Northerly direction along
said Easterly boundary of Waukegan Road to the
point of beginning; provided, however, that
Lessor shall not in any event use said parcel
of real estate for the parking of automobiles
or in any manner which will interfere with
Lessee's business, as hereinafter described;
and a 30 foot by 30 foot vacant parcel of land
located and described as follows: beginning
at the Northwest corner of the above - described
premises, thence East along the Northerly line
of subject property to a point in the Northerly
line of subject property to a point in the
Northerly line of said described property,
which point is 82 feet East of said Northwest
corner of the above - described property, thence
Southerly at right angles a distance of 30 feet,
thence Easterly at right angles a distance of
30 feet; thence Northerly at right angles a
distance of 30 feet, thence Westerly at right
angles a distance of 30 feet to a point in the
Northerly line of the said described property
that is 82 feet East of the Northwest corner
of the subject property.

SECTION That variations from the strict provisions of
THREE: Sections V -18, XIII -D -1, XVII -B -b and
XVII -B -3 -d of the Zoning Ordinance of the
Village of Deerfield, passed May 4, 1953, as amended with respect
to the property hereinabove described, are hereby granted so as to
permit:
1) The location and erection of the gasoline pump
island and building 12 feet and 28 feet, respectively,
from the front property line
2) The construction and maintenance of a 32 -1/3 square
foot double faced illuminated sign up to but not
beyond the front property line
3) The erection of one lighting standard not less than
33 feet from the center line of Waukegan Road (the
lighting standard referred to is the southernmost of
such standards as appears on the plans submitted and
this variation authorizes the erection of that standard
only in the location shown.)
and all in accordance with plans presented and filed with the
Zoning Board of Appeals.
SECTION That the variations hereby granted are subject
FOUR: to compliance by Petitioner with all other
applicable provisions of the Zoning Ordinance
and all other applicable ordinances of the Village.
SECTION That this Ordinance shall be in full force and
FIVE: effect from and after its passage and approval
as provided by law.
