ORDINANCE NO. 0 -70- 27 AN ORDINANCE AMENDING SECTION XIII OF THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD (B -1 NEIGHBORHOOD BUSINESS DISTRICT - PLANNED SHOPPING CENTER) WHEREAS, the Plan Commission of the Village of Deerfield, pursuant to proper notice, as provided by statute and ordinance, has held a public hearing upon the subject matter of a certain Amendment to the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the said Plan Commission has recommended that the corporate authorities amend said Zoning Ordinance in the manner herein- after provided. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Section XIII of the Zoning Ordinance of the ONE: Village of Deerfield, passed May 4, 1953, as amended, be and the same is hereby further amended by adding a new Subsection E, as follows: "E - Planned Shopping Center.) 1) In the case of a planned shopping center (a compact and contiguous parcel or tract of land having an area of not less than 20 acres under single ownership or, if the ownership is diverse, then under unified con- trol pursuant to an agreement of such owners proposed for use and development for retail business or service purposes in accordance with a general plan of develop- ment) the Plan Commission may recommend and the Trustees may authorize exceptions and variations from the otherwise applicable regulations of the B -1 District, so as to authorize and permit the following: a) The sale of garden supplies, shrubbery and similar items in other than completely enclosed structures provided that such sales areas are adequately enclosed by fencing b) The following additional uses: recreational centers (including but not limited to theatres, bowling alleys and billiard halls); banks; appliance sales and service; cigar, cigarette and tobacco sales; major department stores; jewelry sales; watch and jewelry repairs c) The erection of buildings or structures to a height of 45 feet d) The elimination of any side yard requirements between parcels under separate ownership within the planned shopping center e) The exclusion of covered mall areas in computing the maximum lot coverage permitted under the provisions of this Ordinance f) Exceptions from the screening requirements of Section XVI -F -4 -c of this Ordinance g) Exceptions from the parking area provisions of Section XIII -D -4 of this Ordinance h) Exceptions from the provisions of Section XVI -F -11 of this Ordinance with respect to the required number of parking spaces i) Exceptions from the provisions of Section XVI -G of this Ordinance with respect to off - street loading facilities j) Exceptions from the provisions of Section XVII -B with respect to the number, size, height and location of free - standing signs and with respect to the extension of flat -wall signs above the top of a parapet wall 2) The exceptions and variations set forth in Subsection 1 above may be authorized and permitted subject to such restrictions and conditions as the Plan Commission may recommend and the Board of Trustees may impose and, as are in keeping with the general purpose and intent of this Ordinance and, as may minimize the effect of the shopping center development on neighboring properties." SECTION That all ordinances or parts of ordinances in conflict TWO: herewith are, to the extent of such conflict, hereby repealed. SECTION That the Village Clerk is hereby directed to publish THREE: this Ordinance in pamphlet form.
