ORDINANCE NO. 0 -70- 15 AN ORDINANCE AMENDING CHAPTER 28 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD. ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Chapter 28 of the Municipal Code of Deerfield ONE: of 1963, as amended, be and is hereby further amended by adding a new Section 28.034 as follows: "28.034 Inoperable Motor Vehicles.) (1) Definitions. The following definitions shall apply in the interpretation and enforcement of this Ordinance, (a) "Person" shall mean any person, firm, partnership, association, corporation, company or organization of any kind. (b) "Street or highway" shall mean the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. (c) "Property" shall mean any real property within the Village which is not a street or highway. (d) "Inoperable motor vehicle" shall mean any motor vehicle which for a period of at least six months, the engine, wheels or other parts have been removed, or on which the engine, wheels or other parts have been altered, damaged or otherwise so treated that the vehicle is incapable of being driven under its own motor power. (e) "Inoperable motor vehicle" shall not include a motor vehicle which has been rendered temporarily incapable of being driven under its own power in order to perform ordinary service or repair operations nor to any motor vehicles that are kept within a build- ing when not in use, to historic vehicles over 25 years of age. (2) Leaving of Wrecked, Non - Operating Vehicles on Street. No person shall leave any partially dismantled, non - operating, wrecked or junked vehicle on any street or highway in the Village. (3) Inoperable Vehicles Declared to be a Nuisance. Inoperable motor vehicles, as defined herein, - whether on public or private property; are hereby declared to be a nuisance. (4) Disposed on notice. All persons are required to dispose of any inoperable motor vehicle under their control upon written notice received from the corporate authorities or from the Chief of Police or any member of his department designated by him commanding such disposition of said inoperable motor vehicle. (5) Impounding. The Chief of Police or any member of his department designated by him is hereby authorized to remove or have removed any Vehicle left at any place within the Village which is are inoperable vehicle as defined herein. Such vehicle shall be impounded until lawfully claimed or disposed of in accordance with the provisions of Paragraph 4 -200, et seq., of the Illinois Motor Vehicle Act (Chapter 95,.1/2, Ill. Rev. Stats.) (6) Penalties. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding $500.00. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder." SECTION This Ordinance shall be in full force and effect TWO: from and after its passage and publication, as provided by law.
