O-70-23ORDINANCE NO. 0 -70- 23 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY LOCATED AT 663 WAUKEGAN ROAD, DEERFIELD, ILLINOIS WHEREAS, DEERFIELD OIL COMPANY has petitioned for certain variations from the strict provisions of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended; and WHEREAS, pursuant to notice duly published as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recom- mendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation of the ONE: Zoning Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and particular TWO: hardship in the way of carrying out the strict let- ter of the provisions of the Zoning Ordinance of the Village of Deerfield, as applied to Petitioner's property, which is legally described as follows: Lot 53 (except the S 15 ft thereof) in Goldman's North Shore Golf Links Subdivision, being a subdivision in the N 1/2 of the NW 1/4 of Section 33, Township 43 North, Range 12 East of the Third Principal Meridian, according to the plat thereof recorded June 7, 1924, in Book N of Plats, Page 7, as Document No. 241049, in Lake County, Illinois. SECTION That a variation from the strict provisions of THREE: Section V -18 and Section XVII -B -1 -b of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended with respect to the property hereinabove described, is hereby granted so as to permit the construction and maintenance of a double- faced, illuminated sign one foot within the front property line in lieu of the required 50 feet, and 34 feet from the center line of Waukegan Road rather than the required 40 feet, all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That.the variation hereby k y is subject to May 4, 1953, as amended with respect to the property hereinabove described, is hereby granted so as to permit the construction and maintenance of a double- faced, illuminated sign one foot within the front property line in lieu of the required 50 feet, and 34 feet from the center line of Waukegan Road rather than the required 40 feet, all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That.the variation hereby granted is subject to FOUR: compliance by Petitioner with all other applicable (1) provisions of the Zoning Ordinance and all other applicable ordinances of the Village. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval as provided by law. A copy has been given to the Building Commissioner and he can now issue the permit. If you wish the ordinance to be a matter of permanent record you may record it with the Recorder of Deeds of Lake County, County Building, Waukegan, Illinois 60085.
