O-69-48ORDINANCE NO. 0 -69- 48 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING'ORDINANCE WITH RESPECT.TO THE PROPERTY LOCATED AT 3,6.0 COUNTY LINE. ROAD (D).,,. DEERFIELD, ILLINOIS WHEREAS, GOLDEN BEAR PANCAKE HOUSE RESTAURANTS, INC, has petitioned for a variation from the strict provisions of the Zoning Ordinance of the Village of Deerfield, passed May 4,1953, as amended; and WHEREAS, pursuant to notice duly published as required by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation ONE: of the Zoning Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difficulties and TWO: particular hardship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property which is legally described as follows: That part of the Southeast 1/4 of Section 33, township 43 North, Range 12 East of the Third Principal Meridian, described as follows: Beginning at a point on the South line of said Southeast 1/4 of Section 33, 300.0 feet East of the Southwest corner of said Southeast 1/4; thence North along a line parallel with the West line of said Southeast 1/4 282.78 feet, more or less, to a line drawn from a point on said West line of the Southeast 1/4 126.65 feet (128.44 meas.) North of the Southwest corner of said Southeast 1/4 to a point in the Center line of Waukegan Road 450.0 feet Northwesterly of the intersection of said center line of Waukegan Road with said South line of the Southeast 1/4; thence Northeasterly along the last described line 258.67 feet, more or less, to said point in the center line of Waukegan Road; thence Southeasterly along the center line of Waukegan Road 30.17 feet; thence Southwesterly at right angles to the center line of Waukegan Road 217.99 feet, more or less, to a line 350.0 East of and parallel with said West line of the Southeast 1/4 274.45 feet, more or less, to a point on the South line of said Southeast 1/4 350.0 feet East of said Southwest corner of the Southeast 1/4; thence West 50.0 feet to the point of beginning in Lake County, Illinois, commonly known as Parcel D of 360 County Line Road. SECTION That a variation from the strict provisions THREE: of Section XVII, B -1 -b of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended. with respect to the property hereinabove described,is hereby granted so as to permit the erection of a free - standing sign 2 feet 6 inches (2'6 ") from the front lot line in the required front yard in accordance with the plans presented and filed with the Zoning Board of Appeals. SECTION That the variation hereby granted is subject FOUR: to compliance by Petitioner with all other applicable provisions of the Zoning Ordinance and all other applicable. ordinances of the Village. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law.
