O-69-47ORDINANCE NO. 0 -69- 47 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF THE ZONING ORDINANCE WITH RESPECT TO THE PROPERTY LOCATED AT 836 DEERFIELD ROAD, DEERFIELD, ILLINOIS WHEREAS, UNION OIL COMPANY has petitioned for certain variations from the strict provisions of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended; and WHEREAS, pursuant to notice duly published as rqquired by statute, a public hearing on said petition was held and conducted by the Zoning Board of Appeals of the Village of Deerfield; and WHEREAS, the Zoning Board of Appeals has filed with the President and Board of Trustees its written findings of fact and recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESBDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the findings of fact and recommendation ONE: of the Zoning Board of Appeals are hereby concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION That there are practical difffaculties and TWO: particular hardship in the way of carrying out the strict letter of the provisions of the Zoning Ordinance of the Village of Deerfield as applied to Petitioner's property which is legally described as follows: That part of the Southeast quarter of the Southeast quarter of Section 29, Township 43 North, Range 12, East of_the Third Principal Meridian, bounded by a line described as follows, to -wit: Commencing 285 feet West of the Southeast corner of Section 29, North 233 feet, thence West 50 feet, thence South 50 feet to the Southeast corner of the premises described in Warranty Deed dated February 3,. 1915 and recorded February 3, 1915, as Document No. 157425, thence West along th`e South lines of the premises described in said Document 157425, 119.8 feet to the Easterly line of Park Avenue, thence Southeasterly along Easterly line of Park Avenue 189.79 feet to the center of Deerfield Avenue, thence East on the center line of Deerfield Avenue 119.38 feet to the place of beginning in Lake County, Illinois, said property commonly known as 836 Deerfield Road. SECTION That variations from the strict provisions THREE: of Section XIII, D -1; XIII, D -2 -b; XVII, -B -1 -b and Section V, 18 of the Zoning Ordinance of the Village of Deerfield, passed May 4, 1953, as amended with respect to the property hereinabove described, are hereby granted so as to permit the construction of a new station, with a pump island 19'3" from the South property line, the canopy roof 9'3' and roof supports 20'9" from the South property line, and the location of a free - standing sign 18" from the South property line all in lieu of the otherwise required 50' front yard and 40' set back from Deerfield Road and all in accordance with plans presented and filed with the Zoning Board of Appeals. SECTION That the variations hereby granted are subject FOUR: to compliance by Petitioner with all other appli- cable provisions of the Zoning Ordinance and all other applicable ordinances of the Village and subject to the further condition that by the acceptance of the variations herein granted, Petitioner does waive and release any objection to the proposed vacation of Park Avenue and further releases any interest it may have as adjoining property owner in and to such portion of Park Avenue as may be vacated provided that such waiver and release of Petitioner is conditioned on the proposed relocation of Park Avenue along the East line of Petitioner's property in accord- ance with the proposed comprehensive plan under consideration by the Village Plan Commission. SECTION That this Ordinance shall be in full force and FIVE: effect from and after its passage and approval, as provided by law.
