AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF PORTIONS
OF FAIRVIEW AVENUE, BIRCHWOOD AVENUE, KENMORE AVENUE,
GORDON TERRACE, LAUREL AVENUE AND ROSEWOOD AVENUE, BY
THE CONSTRUCTION OF PAVEMENT WITH INTEGRAL CURBING,
SIDEWALKS, AND INCLUDING A DRAINAGE SYSTEM WHERE
NECESSARY/
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS
FOLLOWS:
SECTION That a local improvement shall be made in the
ONE: Village of Deerfield, Lake and Cook Counties,
Illinois, the nature, character, locality and
description of which improvement is as follows:
The construction of a non - reinforced Portland Cement
Concrete pavement with an integral curb, Portland
Cement Concrete sidewalk, together with the necessary
drainage and other improvements of Fairview Avenue
from the north edge of the existing pavement of County
Line Road to a point 120 feet south of the south
right -of -way line of Hackberry Road, Birchwood Avenue
from the north edge of the existing pavement of County
Line Road to a point 120 feet south of the south right -
of -way line of Hackberry Road, Kenmore Avenue from a
point 8 1/2 feet south of the south right -of -way line
of Laurel Avenue to a point on the north right -of -way
line of Rosewood Avenue, Gordon Terrace from a point
8 1/2 feet west of the west right -of -way line of
Fairview Avenue to a point 8 1/2 feet east of the east
right -of -way line of Fairview Avenue, Laurel Avenue
and Rosewood Avenue, from the east edge of. the existing
pavement on Wilmot Road to a point 8 1/2 feet east of
the east right -of -way line of Fairview Avenue the
construction of a thirty -three inch (33 ") storm sewer
along Gordon Terrace beginning from a manhole to be
located four feet (4') east of the west right -of -way
line of Birchwood Avenue to an existing manhole located
four feet (4') east of the west right -of -way line of
Fairview Avenue, all in Section 32, Township 43 North,
Range 12 East of the Third Principal Meridian in the
Village of Deerfield, in Lake County, Illinois, including

the cost of all labor and materials, the cost of
engineering and inspection, and the cost of making, levying,
and collecting the assessment as provided by law.
SECTION Said improvement shall be constructed, and the
TWO: details concerning the same shall be in accordance
with the Plans entitled "Village of Deerfield
Proposed Improvements for Hovland Subdivision -- Special Assessment
Number 108 ", and the Specifications entitled "Specifications for
Hovland Subdivision (Pavement) Special Assessment Number 108- -
Deerfield, Illinois ", attached hereto and made a part hereof, and
in accordance with the Standard Specifications for Road and Bridge
Construction, prepared by the State of Illinois, Department of
Public Works and Buildings, and adopted August 1, 1968, which Stan-
dard Specifications are on file in the Office of the Village Clerk
and are incorporated herein by reference, and made a part of this
Ordinance.
SECTION All materials of every kind used in the construc-
THREE: tion of this improvement shall be of first -class
quality and suitable for the purpose for which
they are to be used. All construction shall be done in a workman-
like manner, under the supervision, and subject to the approval of
the Board of Local Improvements.
SECTION The recommendation of the Board of Local
FOUR: Improvements providing for the improvement and
the estimated cost thereof, made by the President
of the Board of Local Improvements both hereto attached and made
a part thereof, be and the same are hereby approved.
SECTION The said improvement shall be made and the whole
FIVE: cost thereof, together with an amount not exceed-
ing six per cent (6 %) of the estimated cost to-wit:
TWENTY -TWO THOUSAND SEVEN HUNDRED FORTY -THREE and 47 /100ths
($22,743.47) DOLLARS, which is hereby provided for to apply towards
the cost and expense of making, levying and collecting the special
assessment and all other expenses allowed by law, being the amount
included in the estimate therefor shall be paid by special assess-
ment levied in accordance with Article 9, Division 2, Chapter 24,
of the Illinois Revised Statutes, as amended, being an Act en-
titled "Illinois Municipal Code ", approved May 29, 1961, together
with all Amendatory and Supplemental Acts (excepting Article 9,
Division 3).
SECTION The aggregate amount herein ordered to be
SIX: assessed to pay the cost of said improvement
against the property and also the assessment on
each lot and parcel of land herein assessed shall be dividdd into
ten (10) installments in the manner provided by the statute in
such case made and provided and each of said installments shall bear
interest at the rate of six per cent (6 %) per annum, according to
law until paid.
SECTION For the purpose of anticipating the collection of
SEVEN: the .second and succeeding installments of said
assessment for the cost of said improvement, the
Village shall issue bonds payable out of said installments, bearing
interest at the rate of six per cent (6 %) per annum, payable annually,
signed by the President and attested by the Clerk of said Village
under the corporate seal. Said bonds shall be issued in accordance
with, and shall in all respects conform to the provisions of Article
9, Division 2, Chapter 24, of the Illinois Revised Statutes, as
amended, being an Act entitled "Illinois Municipal Code ", approved
May 29, 1961, together with all Amendatory and Supplemental Acts
(excepting Article 9, Division 3).
SECTION The Village Attorney be and he is hereby directed
EIGHT: to file a Petition in the Circuit Court of Lake
County in the name of the Village praying that
steps may be taken to levy a special assessment for said improve-
ment, in accordance with the provisions of this Ordinance and in
the manner prescribed by law.
SECTION All ordinances, or parts of ordinances in
- NINE.: conflict herewith, be and the same are hereby
repealed.
SECTION That this Ordinance shall be in full force and

passage and the approval thereof according to law.

The said non - reinforced Portland Cement Concretes pavement with an inte,ral
curb shall have a 6 inch uniform thickness and shall be 27 feet in width measured
back to back of curb.
The said Portland Cement Concrete sidewalk al6ng both sides of said improvement
shall have a uniform thickness 'of 4 inches and sl -gall be' 5 feet in width except that said
sidewa -lk shall be 6 inches in thickness across existing driveways leading into
adjoining lots.
The drainage to properly drain the said improvement shall consist of the
construction of concrete pipe connc•cted' to. ether to the proposed manholes, inlet
catch basins, inlets and to the. existingr, storm sewers within the.said improvement area.
