AN ORDINANCE APPROVING A PLANNED DEVELOPMENT (HOVLAND LOT 50) WHEREAS, the Plan has heretofore held a ALBERT 0. MOEN for the planned development of located in the Hovland District of the Zoning and Commission of the Village of Deerfield Dublic hearing on the application of approval of a single family residential certain real estate hereinafter described Subdivision and classified in the R -1 -B Ordinance of the Village of Deerfield; WHEREAS, the said hearing was held pursuant to duly published notice thereof and was in all respects held according to law; and WHEREAS, the Plan Commission of the'Village of Deerfield, after considering-the-evidence adduced, recommended that said planned development be appr®ved subject,.to certain conditions and restrictions. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That the proposed ONE: development of-the as follows: single family planned residential real estate legally described Lot 50 in the subdivision of J. S. Hovland First Addition to Deerfield, a Subdivision of the South- west Quarter (except the Northwest Quarter of the Northwest Quarter thereof) of Section 32, Township `43 North, Range 12, East of the Third Principal Meridian, in Lake County, Illinois, and as set forth and described on the attached plan of development and preliminary plat of resubdivision, which plan and plat of re- subdivision are mate a part of this Ordinance, be and it is hereby approved subject to the conditions and restrictions hereinafter set forth. SECTION That the approval of said planned development is TWO: conditioned upon the following: 1. That the developer, Albert Q. Moen, construct and install an 8 -inch water main along that portion of Laurel Avenue upon which Lot 50 fronts, and construct and install full storm sewer improvements (including all appurtenances and connections necessary to connect the same to a trunk storm sewer to be installed in Laurel Avenue), street lighting and street signs in accordance with the applicable provisions of the Village Code in the following streets or portions thereof: That portion of Laurel Avenue upon which Lot 50 fronts; That portion of Fairview Avenue upon which Lot 50.fronts; or contribute his proportionate share of the cost of such improve- ments in the event such improvements are installed by others. 2. That in the event all other owners of property fronting on the streets or portions thereof described in Paragraph 2 con- tribute their proportionate shares of the.. cost of street improve- ments, then the developer, Albert 0.- Moen,'shall construct and install full street improvements, including pavement, curb and gutter in said streets or portions thereof: 3. That in the event that the Village:of Deerfield shall, through special assessment proceedings, construct and install improvements in the streets or portions thereof described in Paragraph 2, the developer, Albert 0. Moen, in- addition to.such sum.as may be assessed against said Lot 50 pursuant to said special assessment proceeding, shall contribute and'pay to the public benefit fund of the Village of Deerfield the sum of $1,000 as a contribution toward the cost of the construction and installation of such street improvements in the intersection of Laurel Avenue and Fairview Avenue. SECTION That the approval of said planned development is THREE: hereby given with the understanding that in the event all of the owners of property fronting on the streets or portions thereof described in Paragraph 2 of Section Two hereof do not contribute their proportionate share of the cost of street improvements or make other provision with respect thereto acceptable to the developer, the Village � I r u of Deerfield, to the extent it is legally authorized, will undertake to construct and install said street improvements by special assessment proceedings. SECTION That the approval of the planned development hereby FOUR: given is subject to the further condition that the developer, Albert 0. Moen, submit for approval a final plat of resubdivision of the real estate described in Section One hereof and except as otherwise provided in this Ordinance comply with all requirements of the Village Code of the Village of Deerfield necessary for the approval of said final plat. SECTION That the Village Clerk is hereby directed to FIVE: • publish this Ordinance in pamphlet form. SECTION That this Ordinance shall be in full force and SIX: effect from and after its passage, approval and publication as provided by law.
