O-68-56ORDINANCE NO. 0 -68- 56 AN ORDINANCE AMENDING ARTICLE VII OF CHAPTER 17 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD BE IT ORDAINED BY THE.PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS: SECTION That Article VII of Chapter 17 of the Municipal Code ONE: of Deerfield of 1963, as amended, be and it is hereby further amended by striking Section 17.704 and Section 17.705 thereof in their entireties and substituting in lieu thereof the following: . "17.704 Insurance required.) No license shall be issued under the provisions of this article unless the applicant for such license has first submitted proof of insurance in the form of a certificate of insurance issued by an insurer duly authorized to issue such policies in the State of Illi- nois. Such certificates shall show that the applicant for a license has public liability insurance covering his operation within the village, shall show the date of expira- tion of such insurance and shall certify that the'same shall not be cancelled without at least ten days' notice to the village manager. Upon the cancellation or expiration without renewal of such insurance, the license or permit issued here - under to the insured shall be void. Such insurance shall be in the amount of not less than $300,000 per person insured, not less than $500,000 for all personal injurieslio any one accident, and not less than $50,000 for property damage in any one accident. "17.705 Bond.) No scavenger license shall be issued unless the applicant therefor shall file a performance bond with sureties to be approved by the board of trustees, in the sum of one thousand dollars, with the village as bene- ficiary, conditioned upon the licensee continuing to pro- perly operate the business of scavenger for the period covered by the license on the following terms: 2 - "(a) The licensee will have at least one vehicle in operation in collecting garbage a minimum of five days each week except for holidays. "(b) Collection will be made of all garbage, refuse and garden waste properly placed in suitable containers and located on the premises served in accordance with the pro- visions of Article II of Chapter 18 of this Municipal Code, provided the person so served is not delinquent in paying proper bills rendered for such service; provided further, that after collection, the licensee shall return all garden waste containers to the same place on the premises where garbage and refuse containers are located. "(c) The licensee will collect garbage from each resident asking for such service and paying the established fee, at least twice each week. The licensee will collect garbage from each residence and each commercial and industrial establishment subscribing for such service and paynthe es- tablished fee therefor on a regular schedule not less than twice each week; provided, that where not more than three persons permanently reside in a dwelling unit, the owner of such unit may contract for and the licensee shall provide collection service once each week at an established fee therefor; provided further,.that in the case of dwelling units subscribing for such once- per -week service the licensee shall not be required toicollect and dispose of more than two containers 2 gallons^ maximum) per week from such dwelling units . ERGH "(d) The licensee will collect garden waste from each resident asking for such service and paying the established fee therefor at least once each week. "(e) The licensee shall collect all garbage and refuse and garden waste placed in suitable containers in accordance with the provisions of Article II of Chapter 18 of this Municipal Code without limit as to the number of such con- tainers and at the established fees therefor; provided, that the licensee may charge a special fee for the col- lection and removal of miscellaneous waste. - 3 - "(f) The licensee will comply with all ordinance pro- visions relating to the business, and will properly dispose of all garbage and refuse collected. "(g) The fee established at the commencement of the license year for garbage and refuse collection and the special fee for garden waste collection shall not exceed the fees approved by the president and board of trustees and shall not be increased during the license year without the consent of the president and board of trustees. "(h) A failure to comply with the provisions hereof because of conditions, acts or occurrences beyond the con- trol of the licensee, or mechanical failure of equipment repaired or replaced as promptly as possible, shall not be considered a breach of these conditions. "Provided that in lieu of such bond, the licensee may deposit cash or direct general obligations of the Federal, State or Village government in the sum of one thousand dollars, with the village treasurer; such deposit to be re- turned upon compliance with the foregoing conditions." SECTION That the Village Clerk is hereby directed to publish TWO: this ordinance in pamphlet form. SECTION That this Ordinance THREE: from and after its as provided by law.
