O-68-20Ilk, 0J7'.DT1\TAN'1-1E. o -r,-t- 20 AN ORDINANCE .A14"EN.PTNG CHAPTER 17 .AND CHAPTER 27 OF Tf1E' INS UN_TC1-PAL CODE OF DEERFIELD BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK CO UNTIES, ILLINOIS, AS FOLLOWS: ;SECTION That Chapter 17 of the Municipal Code of Deerfield 01\TL: of 1963, as amended, be and it is hereby further amended by adding a new .Article X as follows: ARTICLE X .Real Estate Brokers Section 17.1001 Policy) It is hereby declared the policy of the Village of Deerfield that all persons should have right of equal access to the real estate market without discrimination because of race, color, religion, national origin, or ancestry, and that in furtherance of such right and to assure such full and equal opportunity, no owner, lessee, sublessee, assignee, managing agent, or other person, firm, or corporation having the right to sell, rent or lease any real estate, rs-.i•'.hin the Village of Deerfield, or any agent of any of these, should refuse to sell, rent, lease, or otherwise deny to or withhold from any person or group of persons such real estate because of the race, color, religion, national origin, or ancestry of such person or persons or discriminate against any person because of his race, color, religion, national origin, or ancestry in the terms, conditions, or privileges of the sale, rental, or lease of any real estate or in the furnishing of facilities or services in connection therewith. Section 17.1002 License Required.) It shall be unlawful for anyone to advertise.. represent, hold himself out as, engage in the business of, or act in any manner as a real estate broker in the Village of Deerfield, without having first obtained a State of Illinois real estate broker's license and "pan annual Village license for that purpose as provided herein. As used herein, 'Real Estate Broker" shall mean any person, association, co-partners hip, or corporation who for another or others, and for compensation or other valuable consideration, sells or offers for .sale, buys or offers to buy, or negotiates or solicits the purchase or sale or exchange of real estate, or who 1 sases, or offers to lease, rents or o.cfer. s for rent, any real estate, or shows any real estate to any pro nc alive pur. cnacser, tenant, or lessee, or negotiates or solicits leasf -s or rentals thereof or the improvements therein, or who utilizes a....ey person as a real estate salesman or agent to perform any of the a,_.ove acts. Section 17.1003 Application and Issuance of License.) .Application fa.- a real estate broker's license shall be made to the Village Manager in writing, signed by the applicant, if an individual, by a duly authorized partner if a partnership, by a duly authorized member, if an associa- tion, or by a duly authorized officer thereof if a corporation, verified by oath or affidavit. The application shall contain a representation by the applicant that he has read the provisions hereof and that in the case of a partnership, association, or corporation, all members and 'em- ployees subject to the terms hereof have similarly read the provisions hereof. Except as otherwise provided herein, the provisions of Chapter 12 of this Municipal Code shall govern the manner and form of the application and the issuance of the license. Any material falsehood, misstatement, or omission in the application shall be grounds for im- mediate revocation of the license. An application shall be accompanied by evidence of the issuance to the applicant of a real estate broker's license by the State of Illinois. The applicant shall be entitled to the issuance of a real estate broker's license upon the payment of the license fee herein provided. Said license shall be renewed annually, provided that said broker shall not have had his State or Village license revoked for violation of this Or- dinance or the statutes of the State of Illinois. Section 17.1004 Fee.) The annual fee. for a real estate broker's license shall be Ten ($10.00) Dollars. Section 17.100$ Standards of Conduct.) It shall be unlawful for any real estate broker, acting with respect to real estate located within the Village of Deerfield to do any of the following: 1) To make any substantial misrepresentation oRfalse promise likely to induce, persuade, or influence; or to engage in untruthful advertising; or to pursue a continued or flagrant course of misrepre- senting; or to make false promises, through agents or salesmen or otherwise; 2) To act for more than one party in a transaction without the kno wledgc of all parties to the transaction; 3) To fail to furnish copies, upon request, of all documents for which the broker is professionally responsible relating to a real esta {-e transaction to all parties executing the same, or fail to account for or IM remit any monies or documents coming into his possession r,;�ich belong to others; 4) To fail to maintain and deposit in a special account, separate and apart from his personal or other business accounts, all monies belonging to others entrusted to him while acting as a real estate broker, or as escrow agent, or as the temporary custodian of the funds of others, until the transaction involved is consummated or terminated; 5) To pay a commission or valuable consideration to any per- son for acts or services performed in violation of the provisions of this .Article; 6) To employ any person as a salesman or agent as a means of evading provisions of this Article; 7) To display a "for rent" or "for sale" sign on any property without the written consent of the owner or his duly authorized agent, or advertise that any property is for sale or for rent in a newspaper or other publication without the consent of the owner or his authorized agent; 8) To fail to promptly present to his principal any and all offers for sale, lease, or rental of real estate; or set the price, terms, conditions, or privileges of any kind relating to the sale, lease, rental, financing, repair, rehabilitation, construction, maintenance, or occup- ancy of real estate; 9J To solicit for sale, lease, or rental, real estate on the grounds of loss of value due to the present, prospective, or alleged entry into the vicinity of any person or persons of any particular race, color, religion, national origin, or ancestry, or distribute or cause to be distributed material or statements designed to induce any owner of real estate to sell, lease, or rent his property because of any present, prospective, or alleged_. change in the race, color, religion, national origin, or ancestry of � persons in the vicinity; 10) To 'refuse to show to any person who has specified his needs the list or other records identifying all properties reasonably meeting such needs which the broker is offering, including those on any multiple listing of real estate to which he has access in the course of his business; 11) To circulate, adverti.: e, display, or cause to be circulated, advertised, or displayed any communication, notice, advertisement, or sign relating to the sale, rental, or leasing of any real property which indicates or expresses any limitation in the sale, rental, or leasing of .G-!ch real estate predicated upon the race, color, religion, national o1- -igin, or ancestry of any prospective buyer, lessee, or renter of such property; 12) To fail to show real estate without regard to the race, color, religion, national origin, or ancestry of any prospective pur- chaser, lessee, or tenant, and without regard to the race, color, religion, national origin, or ancestry of the residents in the area in which the property is located; 13) To refuse to sell, . lease, or rent, any real estate within the Village of Deerfield because of the race, color, religion, national origin, or ancestry of the proposed buyer or renter, or because of the race, color, religion, national origin, or ancestry of the residents of the area in which the property is located; 14) To discriminate or to participate in discrimination in con- nection with borrowing or lending money, guaranteeing loans, accepting mortgages or otherwise obtaining or making available funds for the purchase, acquisition, construction, rehabilitation, repair, or mairten- ance of any real estate or improvements thereon in the Village of Deerfield because of race, color, religion, or national origin, or ancestry; 1$) To make any distinction, discrimination, or restriction against any person in the price, terms, conditions, or privileges or' any kind relating to the sale, rental, lease, or occupancy of any real estate in the Village of Deerfield or in the furnishing of any facilities or services in connection therewith, predicated upon the race, color, religion, national origin, or ancestry of the prospective or actual buyer or tenant thereof; 16) To enter into a listing agreement for the sale or rental of real estate which discriminates against any person because of race, color, religion, national origin, or ancestry; 17) To act or undertake to act as a real estate broker with respect to any real estate or housing .accommodation, the disposition of which discriminates against any person because of race, color, religion, national origin, or ancestry; 18.) To fail, within ten days after notice, to provide information requested by the person charged with enforcement of the provisions hereof as a result of a complaint alleging a violation of the provisions of this Article; -.5- 19) To cheat, exploit, or overcharge any person for residen- tial' housing accommodations; 20) To interfere with the performance of a duty or the exercise of a power by the Real Estate Re view board, as provided in Section 1?.1006, or one of its members or representatives. Section 17.1006 Review Board.) There is hereby created -a. Real Estate Review Board consisting of five (5) members. Said Review Board shall be composed of a member of the Village Board of Trustees of the Village of Deerfield, a real estate broker who shall have been licensed by the State of Illinois for a period of at least five (5) years prior to his appointment, a member of the Deerfield Human Relations Commission, and two adult residents of the Village, who are neither members of the Village Board of Trustees, members of the Deerfield Human Relations Commission, nor real estate brokers. All -members of the Review Board .shall be appointed by the President with the con- sent-of the Board of Trustees. The member of the Village Board of Trustees, the real estate broker, and the member of the Deerfield . Human Relations Commission herein designated shall serve for a term of one (1) year; the other members of the Review Board shall each serve for a term of four (4) years. The members of the Review Board shall select one of its members to act as Chairman and another to act as Secretary. Section 17.1007 Complaints.,) Any person aggrieved in any manner by any violation of any provision of this Article may, within thirty (30) days after the date of the alleged violation, file a verified written com- plaint setting forth his grievance with the Secretary of the Real Estate Review Board. Said complaint shall state the name and address of the complainant and of the persons against whom the complaint is brought, if known, and shall also state the alleged facts surrounding the alleged violation of the provisions of this Article. Section 17.1008 Procedures.) 1) The Review Board shall promptly investigate every complaint filed as provided in Section 17.1007 hereof.. If the Board shall deter- mine, after such investigation, that the person or persons named in . such complaint have not engaged in any unlawful practice, it shall make written findings of fact and dismiss the complaint. 2) If the Board determines, after such investigation, that prob- able cause exists for the allegations made in the complaint, the Board shall set a date for a conciliation hearing. At such hearing, the Board or a member thereof shall interview the complainant and the person or persons against whom the complaint has been directed and shall attempt i to resolve the complaint by all proper methods of conciliation and per- suasion. If such attempts at conciliation are not successful within thirty (30) days after the date of filing of the complaint, or at such earlier date as the Board may determine that further efforts at con- ciliation are not warranted, the Board shall then, upon the request of the complainant .a q t h r b F''' o Fe C F r ��, proceed promptly with a full hearing of the complaint. 3) Such hearing shall be conducted by the Board or any three members thereof, upon not less than five (5) days written notice to all parties. The Board shall have full power to subpoena witnesses and pertinent documents, which. power may be enforced by the Board by proper petition to any court of competent jurisdiction. The Board shall have power to administer oaths and to take sworn testimony. The Board shall cause a court reporter to be in attendance at such hearing and to record the proceedings. .Any. party shall be entitled to be re- presented by counsel and shall have the right to call witnesses on his own behalf and to cross - examine witnesses. The Board may adopt reasonable rules for the conduct of the hearing but shall not be bound by the strict rules of evidence. At the conclusion of the hearing, the Board shall render to the Board of Trustees a written report containing findings of fact and recommendations, which shall be served by mail upon the complainant and the respondent. No report shall be delayed more than sixty (60) days after the date of the issuance of notice for commencement of the hearing. 4) The Board shall be empowered at the conclusion of such proceedings and as part of its report, to recommend to the President and Board of Trustees of the Village the suspension or revocation for a period not to exceed one (1) year of a broker's license of any broker licensed by the Village of Deerfield who shall have been a respondent to any proceedings thus filed and found guilty of violation of any applicable provisions of this .Article. Any broker whose license has been sus- pended or revoked by the President and Board of Trustees of the Village, or any complainant aggrieved by the decision of the President and Board of Trustees of the Village, shall have full right to appeal from such order or suspension or revocation in accordance with pro- cedure specified in the .Administrative Review .Act of Illinois. The order of the President and Board of Trustees of the Village shall be . final and transmitted to the Board as part of its record and it shall serve a copy thereof upon the respondent, and any appeal may be taken thereafter. The Board may, in addition,, recommend that the corporate authorities of the Village cause to be filed with the Department of Re- gistration and Education of the State of Illinois, a complaint against any real estate broker found to have violated • any provision of this Article, seeking suspension or revocation of the license issued to such broker by the State of Illinois. $) The Review Board may request the Village Manager to make available such staff assistance as may be required to carry out As duties hereunder. 6) The Review Board shall retain copies of all complaints filed hereunder and keep written records of its actions with respect thereto. Such complaints and records shall not be available for public inspection, however, unless and until notice to the parties has been given that a full hearing as provided in Section 17.1008(3) hereof is to be held thereon. In the event a complaint is dismissed or withdrawn or conciliation is effected, records of such complaints and the action of the Review Board with respect thereto shall remain impounded by the Sec- retary of the Review Board and .shall be opened for inspection only upon specific order of a court of competent jurisdiction. When, in the opinion of the Board, its investigation would be more productive or its efforts at conciliation would be enhanced, such activities may be con- ducted in closed meetings.' Section 17.1009 .Acting Without a License.) No person, firm, part- nership,' association, or corporation shall be liable for any commission or other compensation to' any person, firm, partnership, association, or corporation who acts as a real estate broker in the Village of Deerfield for negotiating the sale, lease; or rental of real estate located in the Village of Deerfield unless he is a real estate broker licensed under this Article. Any person, association, co partnership, or corporation who acts as a real estate .broker in the Village of Deerfield while not validly licensed pursuant to this Article X is guilty of a misdemeanor and shall be fined not to exceed five hundred ($$00.00) Dollars for each offense, and every day that a violation of this Article shall occur, shall constitute a separate and distinct offense. If an unlicensed broker violates the provisions of Section 17.100$, such violation shall constitute a misdemeanor for which the fine shall be not to exceed five hundred ($$00.00) Dollars, and every day that a viola- tion thereof continues shall constitute a separate offense. Section 17.1010 Continuation of Business.) Nothing contained herein shall prevent a broker whose license has been suspended or revoked, and who has filed an appeal in accordance with the Administrative Re- view Act of Illinois as provided herein, from continuing the operation of such real estate business until. a decision on the appeal has been ren- dered by the court having jurisdiction of the cause. SECTION That Chapter 27 of the Municipal Code of Deerfield of TWO 1963, as amended, be and it is hereby further amended by adding thereto a new Article XII as follows: 27.1201 Policy.) of Deerfield: lf:M .ARTICLE XII Discrimination in the Sale and Leasing of Real Estate It is declared to be the public policy of the Village (a) That discrimination between persons because of race, color, religion, national origin, or ancestry undermines the dignity of the individual and his rights and privileges as guaranteed to him by the Constitutions of the United States and the State of Illinois, and that in particular discriminatory practices in the sale, rental, and leasing of real estate and in other transactions involving real estate tend to create conditions which contribute to segregated neighborhoods and produce other forms of discrimination and segregation, which adversely affect the continued orderly growth, development, and progress of the Village of Deerfield; and (b) That prohibitions against such discriminatory practices in- volving real estate are necessary and bear a reasonable and direct relationship to the public health, safety; morals, and welfare; and (c) That all persons should have right of equal access to the real estate market without discrimination because of race, color, re- ligion, national origin, or ancestry, and that in furtherance of such right and to assure such full and equal opportunity, no owner, lessee, sublessee, assignee, managing agent, or other person, firm, or corp- oration having the right to sell, rent, or lease any real estate within the Village of Deerfield, or any agent of any of these, should refuse to sell, rent, lease, or otherwise deny to or withhold from any person or group of persons such real estate because of the race, color, re- ligion; national origin, or ancestry of such person or persons or dis- criminate against any person because of his race, color, religion, national origin, or ancestry in the terms, conditions, or privileges of the sale, rental, or lease of any real estate or in the furnishing of facilities or services in connection therewith. 27.1202 Definitions.) For the purposes of this .Article: (a) "Board's or 'Board of Trustees" means the Board of Trustees of the Village of Deerfield. (b) "Review Board" means the Deerfield Real Estate Review Board as established under the provisions of .Article X of Chapter 17 of the Municipal Code of Deerfield. (c) 'Developer" includes and means any person who plans and develops for profit a subdivision in the Village of Deerfield and then offers for sale or lease the lots or houses in such subdivision. • (d) "Discriminate" includes and means any difference in terms, conditions, or treatment in the sale, lease, or financing of real estate because of race, color, religion, national origin, or ancestry. (e) "Holds out real estate to the public for sale or lease" in- cludes and means advertising or causing a notice to be published or broadcast in news media of any kind, including, without limitation, newspapers, radio, and television, advertising or notifying by the dis- play of a poster or sign, listing of real estate with a real estate broker or salesman, and making or circulating or causing to be made or cir- culated any public announcement or notification of the availability for sale or lease of real estate. (f) "Lease" or "leasing" includes and means rent, renting, assignment, sublease, and subletting. (g) "Lender" or !'lending agency" includes and means any person engaged in the business of lending money at interest, guarantee- ing loans or obtaining, arranging, or negotiating loans or guarantees for the purchase, acquisition, repair, or improvement of real estate in the Village of Deerfield, which loans or guarantees are secured by title to or a security interest in such real estate. (h) "Owner" includes and means any person who holds legal or equitable title to, or owns any beneficial interest in real estate in the Village of Deerfield, or in the shares of any real estate cooperative owning any such real estate., (i) "Person" includes and means one or more individuals, partnerships, associations, organizations, corporations, cooperatives, legal representatives, trustees, trustees in bankruptcy, receivers or other fiduciaries, and the Village of Deerfield. (j) "Real Estate" includes and means any land in the Village of Deerfield, and any improvements thereon. 27.1203 Unlawful Practices.) It is an unlawful real estate practice and a violation of this .Article for any owner, developer, lender, lending agency, or any other person to: (a) Refuse to sell or lease, or refuse to show for sale or lease any real estate because of the race, color, religion, national origin, or ancestry of any prospective purchaser, tenant, or lessee, or because of the race, color, religion, national origin, or ancestry of the residents of the area in which the real estate is located. (b) Discriminate or. make any distinction between persons or impose any restriction against any person in the price, conditions, or _10- terms of sale, lease or occupancy of any real estate, or in the furnish- ing of any facilities or services in connection therewith, because of the race, color, religion, national origin, or ancestry of the prospective or actual purchaser, tenant, or lessee. (c) Hold out real estate to the public for sale or lease in any manner which indicates or expresses an intention to discriminate be- cause of race, color, religion, national origin, or ancestry, or which indicates or expresses any limitation or restriction on the sale or . leasing of real estate predicated on the race, color, religion, national origin, or ancestry of any prospective purchaser or lessee of such real estate. (d) To discriminate or to participate in discrimination in con- nection with borrowing or lending money, guaranteeing loans, accepting mortgages or otherwise obtaining or making available funds for the pur- chase, acquisition, construction, rehabilitation, repair, or maintenance of any real estate or improvements thereon in the Village of Deerfield because of race, color, religion, national origin, or ancestry. (e) To solicit for sale, lease, or rental, real estate on the grounds of loss of value due to the present, prospective, or alleged entry into the vicinity of any person or persons of any particular race, color, religion, national origin, or ancestry, or distribute or cause to be distributed material or statements designed to induce any owner of real estate to sell, lease, or rent his property because of any present, prospective, or alleged change in the race, color, religion, national origin, or ancestry of persons in the vicinity. (f) .Aid, abet, incite, or coerce a person to engage in an un- lawful real estate practice, or willfully interfere with the performance of the duties or exercise of powers by the Review Board or Board of Trustees, or any member or representative of either, or willfully ob- struct, attempt to obstruct, or prevent any person from complying with the provisions of this .Article or any order issued puramant hereunder. 27.1204 Exemptions.) The provisions of this .Article shall not: (a) Bar any religious or den.ominationaliinstitution or organization, or any charitable or educational organization operated, supervised, or controlled by or in connection with a religious organization, from limiting living accommodations, or giving preference with respect thereto, to persons of the same religion or denomination. (b) .Apply to the leasing of rooms to boarders or lodgers in single-family dwellings occupied by the owner or lessee of the entire premises as a family household. -11- 27.120$ Powers and Duties.) The Real Estate Review Board, in addition to all other powers and duties which it may otherwise have, shall have the following powers and duties: (a) To receive and investigate complaints alleging unlawful real estate practices as defined in this .Article XII. (b) To seek conciliation of, hold hearings on, and render findings of fact and recommendations to the Board of Trustees regarding complaints received. 27.1206 Complaints.) .Any person claiming to be aggrieved by an un- lawful real estate practice, may file with the Secretary of the Review Board a written complaint within thirty (30) days after the alleged com- mission of such unlawful practice. The complaint shall state the name and address of the complainant and person or persons who allegedly committed the unlawful practice, and shall set forth the facts constitut- ing-the alleged practice. 27.1207 Procedures.) (a) The Review Board shall promptly investigate every com- plaint filed hereunder,, and, except as hereinafter provided otherwise, shall thereafter process such complaint and deal with it in accordance with the same procedures and within the same time limitations, and in the same manner as set forth in Section 17.1008 of .Article X of Chapter 17 of this Municipal Code for the processing of complaints of alleged violations of the provisions of said .Article. (b) Upon the conclusion of its proceedings, the Review Board shall submit a report to the Board of Trustees containing findings of fact and recommendations. If the Review Board finds that no unlawful real estate practice was committed, it shall recommend that the com- plaint be dismissed. If the Review Board finds that an unlawful real estate practice has been committed, it may recommend to the Board of Trustees that the Trustees order any person who has committed or is committing such a practice to cease and desist therefrom upon such terms and conditions as the Review Board shall deem to be in accord- ance with the intent and purpose of the provisions of this .Article, or that the Board of Trustees take such other action as it is hereinafter empowered to take. 27.1208. .Action by Trustees.) The Board of Trustees may approve, modify, or reject the recommendations of the Review Board, and may dismiss the complaint (in which event ,such dismissal shall be final) or may take such of the following actions as it deems to be proper and in accordance with the intent and purpose of this Article, including: -12- (a) Issuance of a cease and desist order upon such terms and conditions as the Board of Trustees shall deem proper and in accord- ance with the intent and purpose of this .Article. Upon the failure or refusal of any person to comply therewith within five (5) days after receipt of such order, the Board may seek to obtain any remedy or may invoke any sanction hereinafter provided. (b) Institution of proceedings to enforce the fine provided for in ,Section 27.1209 below. (c) .Application to any court of competent jurisdiction for an order: (1) Restraining any person from violating any provision of this .Article; (2) Granting such other and further relief as the court may deem appropriate for the enforcement of the provisions of this .Article. 27.1209 Penalty.) Any person found to have violated any provision of this .Article shall be subject to a fine not to exceed Five Hundred ($500.00) Dollars. 27.1210 Notice and Report Service.) Service by the Review Board of all notices and reports hereunder shall be made by personal service, or by registered or certified mail at the residence or principal place of business of the party served. .A return made and certified by the per- son making such service, or a returned Post Office receipt in -the case of registered or certified mail, shall constitute proof of service. 27.1211 .Appeal of Board .Action.) All applications and proceedings for judicial review of any order of the Board of.. Trustees issued pur- suant to the provisions of this Article shall be taken in accordance with the provisions of the "Administrative Review .Act" (Act of 11da.y 8, 1945, as amended, Ill. Rev. Stat. Chapter 110, Section 264, et seg.); and if any such order is affirmed) the Board may obtain an order of court for its enforcement in the same proceeding. SECTION If any section, subdivision, paragraph, sentence, clause or THREE : phrase of this Ordinance is for any reason held to be in- valid or unconstitutional, such decision shall not affect any remaining portion, section, or part thereof. SECTION The Village Clerk is hereby directed to publish this FO UR : Ordinance in pamphlet. form.
