O-68-04ORDINANCE NO. 0 -68 -4 AN ORDINANCE ANNEXING CERTAIN LAND TO THE VILLAGE OF DEERFIELD, ILLINOIS WHEREAS, pursuant to a certain Annexation Agreement here- tofore entered into by and between the Village of Deerfield and Irene E. Clavey, Roy F. Clavey, Jr. and Haskell Richards, certain owners of land, a written Petition under oath signed by the owners of record of all land and all electors residing within the terri- tory hereinafter described has been filed with the Village Clerk requesting that said territory be annexed to the Village of Deerfield; and WHEREAS, said territory is not within the corporate limits of any municipality, but is contiguous to the Village of Deer- field. Said territory consists of a tract of land of approxi- mately 9.382 acres, and is commonly known as 1750 Deerfield Road, Deerfield, Lake County, Illinois, with a frontage of approximately 333.91 feet on the North side of Deerfield Road and a depth of approximately 1,320.49 feet (less Southerly part taken for Toll Road of approximately 93.61 feet as measured on. the West lime and 74.10 feet as measured on the Eat line). There is an existing 1-story brick residence on the Southeast corner of said tract, Which residence is owned and occupied by the Petitioners, IRENE E. CLAVEY and ROY F. CLAYEY, JR. 6. Your Petitioner, HASKELL RICHARDS, joins in and executes this Petition as an interested party by reason of.a.contract for the sale of said territory from the aforesaid IRENE E. CLAYEY and ROY F. CLAVEY, JR. to HASKELL RICHARDS, dated September 18, 1967, under which Contract the said HASKELL RICHARDS is authorized to present this Petition.to the Village authorities and to appear before the corporate authorities and represent the other Petitioners in connection with the matters set forth in this Petition. 7. Your Petitioners also respectfully request that, simul- taneously or concurrently with the annexation of said territory to the Village, the said territory be zoned as an R -lA One- Family District, pursuant to the current Zoning Ordinance of the Village of Deerfield, and that, if necessary, an amendment to the Zoning Ordinance of the Village of Deerfield be effected by the corporate authorities of the Village of Deerfield, In this connection, the Petitioners state that the above - described territory is, in effect, surrounded by property within the corporate limits of the Village, lies North of Deerfield Road and is immediately East of property which is zoned R -1 and immediately West of property zoned R -lA. 8. Your Petitioner, HASKELL RICHARDS, states that, after the requested annexation and zoning amendment have been approved and /or effectuated, it is his intention to have the subject territory platted and subdivided into buildable lots which will be developed for single- family residences in accordance with the amended zoning of R -1.A, all in accordance with a copy of the proposed or preliminary plat of subdivision attached hereto and made a part of this Petition as Exhibit C -A (Plan A) and Exhibit C -B (preferred Plan B) 9. Your Petitioners respectfully state that the annexation and future development of the subject territory will.be highly beneficial to the Village in that said annexation and development will increase the taxable values of the properties within.-the Village, will extend the corporate limits and jurisdiction of the Village, will otherwise enhance and promote the general wel- fare of the Village and will not adversely affect the public comfort, health, morals, safety or welfare. WHEREFORE, the undersigned Petitioners hereby petition and request that the above - described territory be annexed to the Village of Deerfield,,Illinois, and be made a part of the corporate limits of said municipality; that, in connection with said annexa- tion, the Village classify the subject property for and as R--1A One- Family District under the terms of its Zoning Ordinance, and that the Plan Commission and other appropriate corporate authorities of the Village approve the abovementioned preliminary plat of subdivision.
